1!1 "R/A($./ 1!1!1 4he +o#ernment of 1ndia is in the ,rocess of esta5lishing an 1nternational &entre for Drin)ing *ater 6uality (1&D*6) as a %orld class autonomous institution (registered as Society under the Societies Registration Act, 1860) fully funded and administered under o#erall guidance of the (inistry of Drin)ing *ater and Sanitation, +o#ernment of 1ndia! 4he ne% cam,us is ,ro,osed to 5e constructed at Co)a, Diamond 0ar5our road, 7ol)ata! 1!1!; 4he 1&D*6 cam,us %ill ha#e modern Administrati#e 5uilding, full<fledged research centre, li5rary, auditorium, training centre and other ancillary 5uildings along %ith +uest house, staff =uarters, etc! 4he total co#ered area is en#isaged to 5e in the range of a,,ro-imately 1D,000 s=m, %hich %ill 5e constructed at an estimated cost of a,,ro-! 1!1!3! 1t is ,ro,osed to engage a "ro@ect (anagement &onsultant ("(&) to act as >/ngineer<in< charge? for handling e-ecution of de#elo,ment E construction %or)s of the ne% cam,us on 5ehalf of the 1&D*6 (4he duties of the "(& along %ith detailed sco,e of %or) are gi#en in &ha,ter<;)! 4he "(& %or) %ill 5e titled .Providing Project Management Consu tant (PMC) Services !or Construction " #eve o$ment o! t%e &nternationa Centre For #rin'ing (ater Qua it) at *o 'ata?! 4he sco,e of %or) of "(& %ill include ,re,aration of designs, D"Rs, dra%ings E estimates, scrutiny E chec)ing of the D"Rs, design, dra%ings, estimates, tendering for e-ecution, a,,ointing contractors through com,etiti#e 5idding system and getting the construction acti#ities e-ecuted for 1&D*6 infrastructure! 1!1!B 4he engagement 'selection of "(& %ill 5e done 5ased on Re=uest for "ro,osals (R:") through t%o<co#er ,rocedure from among +o#ernment "u5lic Sector 9nderta)ings'&or,orations 5y 1&D*6! 4he "(& %ill 5e ,aid a ,ercentage of the ,ro@ect cost 5ased on selection ,rocess here in after descri5ed! 1n order to esta5lish the ne% cam,us, the a,,ointment of an architect, %ho has to ,re,are ur5an design, master ,lan, detailed designs, dra%ings (including 3<dimensional isometric ' ,ers,ecti#e dra%ings) and estimates of 5uildings, e-ternal ser#ices, site de#elo,ment %or)s and .andsca,e designs etc shall 5e underta)en 5y "(&! 4he o#erall design of the 5uilding should 5e as ,er the ational $uilding code, $// s,ecifications and +reen 5uilding conce,t! 1!1!G 4he cost of the ,ro@ect contingencies li)e ad#ertisement of the 14 in the ,ress, munici,al fees for a,,ro#al of dra%ings and ,ro@ect from +o#ernment Authorities etc %ill 5e 5orne 5y 1&D*6! 023 Se ection Process o! 4he "(& %ill 5e selected 5ased on the technical 5id, E financial 5id %hich each +OH/R (/ 4 "S9s'&OR"ORA41O S, is re=uired to su5mit to this office! 4here %ill 5e a mar)ing system and technical and financial 5ids %ill ha#e D0I and 30I %eightage res,ecti#ely! +OH/R (/ 4 "S9s'&OR"ORA41O s %ith the highest mar)s after final e#aluation %ill 5e selected as "(&!

Ma6imum mar's- 47 1 mar) for each of the "(& ,ro@ects ha#ing 5een com,leted %ithin the s,ecified time in the ,ast 10 years! Ma6imum mar's- 8 G mar)s each for similar ,ro@ects of Rs! ;0 crores and a5o#e in the ,ast 10 years (ending :J ;01;<13)! Similar ,ro@ects %ill mean RED 1nstitutes, 9ni#ersity &am,us ha#ing RED facilities, hos,itals, ational .a5oratories, etc! and other research institute<cum<cam,us ha#ing functions some%hat similar to 1&D*6)!4he +OH/R (/ 4 "S9s'&OR"ORA41O s can relist and claim mar)s for ,ro@ects similar in nature as defined a5o#e e#en %hen the same ha#e already 5een listed at (i) a5o#e! 4he Selection &ommittee may dis=ualify 5ids on account of 5ut not limited to the follo%ing reasonsF a) 5) 1f recei#ed after the last date and time! 1f the 5idder disregards any of the terms E conditions of the 5id and'or lea#es any am5iguity in calculation of the consultancy fee c) 1f the ,artici,ants attem,ts to influence any mem5er of the Selection 5oard! d) &onditional 5ids!

4he decision of the selection committee in the matter of dis=ualification shall 5e final and 5inding on the firms! 1!;!8 Termination o! t%e 1id a) 1f none of the ,artici,ating +OH/R (/ 4 "S9s'&OR"ORA41O s comes u, to the re=uirements of 1&D*6 ca,a5le of 5eing declared 5y the selection committee as the %inner of the 5id, the 5idding %ill 5e regarded as terminated!

L 4he Director, 1&D*6 reser#es the right to F i) "ost,one and'or e-tend the time schedule or date of recei,t of or to %ithdra% the 5idding notice %ithout assigning any reason thereof, entirely at the discretion of the 1&D*6! 1n such an e#ent, consulting firms shall not 5e entitled to any com,ensation in any form, %hatsoe#er! ii) Re@ect or acce,t ,ro,osalsM and iii) &ancel the 5idding ,rocess and re@ect all or any of the ,ro,osals and %ill not 5e 5ound to acce,t lo%est or any ,ro,osal or to gi#e any reasons for the decision! 1n case, the last date for su5mission E o,ening of tenders is declared as a &entral +o#t! ,u5lic holiday, the ne-t official %or)ing day shall 5e deemed as last date of su5mission and o,ening of ,ro,osals %ithout any change in time indicated! o se,arate notice to this effect shall 5e issued!

C%a$ter 3 SCOPE OF PMC SER<&CES


SER<&CES TO 5E PERFORME# 5= PRO>ECT MA+A?EME+T CO+SULTA+T (PMC) ;!0 5road Sco$e o! (or'

;!1! "(& %ill act as K/ngineer<in<&harge8 on 5ehalf of 1&D*6 for im,lementing the ,ro@ect! 4he acti#ities under the sco,e of %or) of "(& shall 5roadly include 5ut not limited to the follo%ingF

"(& %ill design, ,lan, coordinate and e-ecute the acti#ities leading to the construction of all 5uildings and cam,us de#elo,ments on 1&D*6 site! All the acti#ities from conce,tualiAation till the com,letion of 5uildings E their handing o#er to 1&D*6 %ill 5e ta)en care of 5y "(&! All functions re=uired for de#elo,ing the total infrastructure till handing o#er of the com,leted 5uildings and other infrastructure of the cam,us, %ill ha#e to 5e ,erformed 5y the "(&! "(& %ill engage an e-,erienced and com,etent Architect! 4he selected Architect %ill 5e re=uired to su5mit the Design "ro,osals! 4he "(& %ill shortlist at least three conce,t design ,ro,osals most suited to the re=uirements of 1&D*6 E ta)e the a,,ro#al of 1&D*6! "(& %ill ta)e a,,ro#al from 1&D*6 on s,atial layouts, landsca,ing, interior and e-terior design of all 5uildings and on any other issue %hich 1&D*6 may direct! "(& %ill re#ie%, study and analyAe the conce,ts, ,reliminary E detailed designs, estimates, $O6 for tender documents etc!! 4hereafter, "(& %ill issue 14, ,rocess E a%ard the %or)s and get them e-ecuted as ,er s,ecifications E re=uirements 5y follo%ing a,,lica5le +o#t! ,rocedures! As /ngineer<in<&harge, the "ro@ect (anagement &onsultant %ill a%ard the %or) to the &ontractor for timely e-ecution'com,letion of the ,ro@ects 5ased on functional re=uirement of 1&D*6! 1n addition to this "(& shall also administer the *or)s &ontract and ensure that the contract clauses %hether related to =uality or =uantities of %or) are res,ected and the %or)s are e-ecuted in accordance %ith its ,ro#isions! "(& %ill 5e re=uired to su,erintend and ,erform duties as /ngineer<in<&harge on 5ehalf of 1&D*6 as sti,ulated in the contract %ith 1&D*6! 4he "(& %ill su,er#ise the construction %or) to ensure adherence to the dra%ings, ,rescri5ed high standards of =uality and timely com,letion of the ,ro@ect and #erify and certify the contractorNs 5ills and monitor the ,rogress of the %or)! "(& %ill ma)e all engineering decisions including necessary corres,ondence %ith architects, contractors etc re=uired for the successful and timely im,lementation of the "ro@ect!

"(& %ill ensure adherence to rele#ant local 5ody norms, &"*D s,ecifications, $1S codes, &H& guidelines, en#ironment and other regulatory re=uirements and %ill also ensure o5ser#ance of all formalities'documents'day to day acti#ities as defined in &"*D *or)s (anual for e-ecution of N*or)s &ontractN and as directed 5y 1&D*6 from time to time! ART&CLE/07 - FORCE MA>EURE 3!10!1 Any delay in or failure of ,erformance 5y a "AR4J shall not constitute default here under or gi#e rise to any claims for damages against said "AR4J if and to the e-tent caused 5y reasons %hich are 5eyond the control of the said "AR4J, including 5ut not limited to acts of +od, stri)es or other concerted acts of %or)man, ,o%er cuts, fires, floods, e-,losions, riots, %ar (declared or undeclared), re5ellion, sa5otage, e-tra<ordinary se#ere %eather, ci#il commotion and criminal acts of third ,arties! 3!10!; $oth "AR41/S shall )ee, a record of the circumstances referred to a5o#e %hich are res,onsi5le for causing delays in the e-ecution of the ,ro@ect! 3!10!3 1f the e-ecution of the ,ro@ect is li)ely to 5e delayed 5y or as the result of one or more of the circumstances referred to in Article 3!10!1 hereof, O* /R and "(& shall discuss the situation %ith a #ie% to find the means to minimiAe the im,act and effect of such circumstances and to reduce the costs and e-,enses %hich the "AR41/S or either of them may incur! 3!10!B 4he ,arties agree herein that in the e#ent of the :orce (a@eure conditions, the ,eriod of the &ontract shall 5e e-tended accordingly for the duration',eriod for %hich such conditions e-ist! 3!13!1!1 4he O* /R may terminate the "(& contract due to any non<,erformance 5y "(&! 3!13!1!; 1n the e#ent of termination ,ursuant to Article 3!13!1!1 hereof, "(& shall carryout any reasona5le instructions of O* /R in connection %ith such termination! 4he decision of the O* /R shall 5e final and 5inding on the "(&! 3!13!1!3 4ermination of this &O 4RA&4 shall not relie#e either "AR4J of their o5ligations im,osed 5y this &O 4RA&4 %ith res,ect to the S/RH1&/S ,erformed 5y either "AR4J ,rior to such termination! 3!13!1!B 1n the e#ent of termination ,ursuant to Article 3!13!1!1 here of, O* /R shall ,ay to "(& for all the S/RH1&/S ,erformed 5y "(& u,to the stage of %or) e-ecuted immediately 5efore termination! 3!13!1!G 1n case due to any circumstances, the O* /R decides to curtail the sco,e of %or) or totally a5andon the %or), the ,ayment to the "(& %ould 5e made u,to the stage of %or) e-ecuted 5y them immediately 5efore ta)ing such a decision!
