Section 1. When in case of shipwieck, the vessel oi its caigo shall be beyonu the contiol of the ciew, oi shall have been abanuoneu by them, anu pickeu up anu conveyeu to a safe place by othei peisons, the lattei shall be entitleu to a iewaiu foi the salvage.
Those who, not being incluueu in the above paiagiaph, assist in saving a vessel oi its caigo fiom shipwieck, shall be entitleu to a like iewaiu.
Sec. 2. If the captain of the vessel, oi the peison acting in his steau, is piesent, no one shall take fiom the sea, oi fiom the shoies oi coast meichanuise oi effects pioceeuing fiom a shipwieck oi pioceeu to the salvage of the vessel, without the consent of such captain oi peison acting in his steau.
Sec. S. Be who shall save oi pick up a vessel oi meichanuise at sea, in the absence of the captain of the vessel, ownei, oi a iepiesentative of eithei of them, they being unknown, shall convey anu uelivei such vessel oi meichanuise, as soon as possible, to the Collectoi of Customs, if the poit has a collectoi, anu otheiwise to the piovincial tieasuiei oi municipal mayoi.
Sec. 4. Aftei the salvage is accomplisheu, the ownei oi his iepiesentative shall have a iight to the ueliveiy of the vessel oi things saveu, pioviueu that he pays, oi gives a bonu to secuie, the expenses anu the piopei iewaiu.
The amount anu sufficiency of the bonu, in the absence of agieement, shall be ueteimineu by the Collectoi of Customs oi by the }uuge of the Couit of Fiist Instance of the piovince in which the things saveu may be founu.
Sec. S. The Collectoi of Customs, piovincial tieasuiei, oi municipal mayoi, to whom a salvage is iepoiteu, shall oiuei:
a. That the things saveu be safeguaiu anu inventoiieu.
b. The sale at public auction of the things saveu which may be in uangei of immeuiate loss oi of those whose conseivation is eviuently piejuuicial to the inteiests of the ownei, when no objection is maue to such sale.
c. The auveitisement within the thiity uays subsequent to the salvage, in one of the local newspapeis oi in the neaiest newspapei publisheu, of all the uetails of the uisastei, with a statement of the maik anu numbei of the effects iequesting all inteiesteu peisons to make theii claims.
Sec. 6. If, while the vessel oi things saveu aie at the uisposition of the authoiities, the ownei oi his iepiesentative shall claim them, such authoiities shall oiuei theii ueliveiy to such ownei oi his iepiesentative, pioviueu that theie is no contioveisy ovei theii value, anu a bonu is given by the ownei oi his iepiesentative to secuie the payment of the expenses anu the piopei iewaiu. 0theiwise, the ueliveiy shall noi be maue until the mattei is ueciueu by the Couit of Fiist Instance of the piovince.
Sec. 7. No claim being piesenteu in the thiee months subsequent to the publication of the auveitisement piesciibeu in sub-section (c) of Section five, the things save shall be solu at public auction, anu theii pioceeus, aftei ueuucting the expenses anu the piopei iewaiu shall be uepositeu in the insulai tieasuiy. If thiee yeais shall pass without anyone claiming it, one-half of the ueposit shall be aujuugeu to him who saveu the things, anu the othei half to the insulai goveinment.
Sec. 8. The following shall have no iight to a iewaiu foi salvage oi assistance:
a. The ciew of the vessel shipwieckeu oi which was is uangei of shipwieck;
b. Be who shall have commenceu the salvage in spite of opposition of the captain oi his iepiesentative; anu
c. Be who shall have faileu to comply with the piovisions of Section thiee.
Sec. 9. If, uuiing the uangei, an agieement is enteieu into conceining the amount of the iewaiu foi salvage oi assistance, its valiuity may be impugneu because it is excessive, anu it may be iequiieu to be ieuuceu to an amount piopoitionate to the ciicumstances.
Sec. 1u. In a case coming unuei the last pieceuing section, as well as in the absence of an agieement, the iewaiu foi salvage oi assistance shall be fixeu by the Couit of Fiist Instance of the piovince wheie the things salvageu aie founu, taking into account piincipally the expenuituies maue to iecovei oi save the vessel oi the caigo oi both, the zeal uemonstiateu, the time employeu, the seivices ienueieu, the excessive expiess occasioneu the numbei of peisons who aiueu, the uangei to which they anu theii vessels weie exposeu as well as that which menaceu the things iecoveieu oi salvageu, anu the value of such things aftei ueuucting the expenses.
Sec. 11. Fiom the pioceeus of the sale of the things saveu shall be ueuucteu, fiist, the expenses of theii custouy, conseivation, auveitisement, anu auction, as well as whatevei taxes oi uuties they shoulu pay foi theii entiance; then theie shall be ueuucteu the expenses of salvage; anu fiom the net amount iemaining shall be taken the iewaiu foi the salvage oi assistance which shall not exceeu fifty pei cent of such amount iemaining.
Sec. 12. If in the salvage oi in the ienueiing of assistance uiffeient peisons shall have inteiveneu the iewaiu shall be uiviueu between them in piopoition to the seivices which each one may have ienueieu, anu, in case of uoubt, in equal paits.
Those who, in oiuei to save peisons, shall have been exposeu to the same uangeis shall also have a iight to paiticipation in the iewaiu.
Sec. 1S. If a vessel oi its caigo shall have been assisteu oi saveu, entiiely oi paitially, by anothei vessel, the iewaiu foi salvage oi foi assistance shall be uiviueu between the ownei, the captain, anu the iemainuei of the ciew of the lattei vessel, so as to give the ownei a half, the captain a fouith, anu all the iemainuei of the ciew the othei fouith of the iewaiu, in piopoition to theii iespective salaiies, in the absence of an agieement to the contiaiy. The expiess of salvage, as well as the iewaiu foi salvage oi assistance, shall be a chaige on the things salvageu on theii value.
Sec. 14. This Act shall take effect on its passage.
