SINGHANIA VS SINGHANIA Narrator: We present you the most talked about divorce case of the town between Mrs. Reema Singhania, celebrated socialite and feminist activist and Mr. Aeman Singhania, the multimillionaire business tycoon. The divorce suit was filed by Mrs. Singhania on the context of Mr. Singhania devoting no time for family leading to a bland and loveless marriage for 10 years and unbearable and ceaseless drinking habits of her alcoholic husband. In retaliation Mr. Singhania has also agreed for divorce on the context of the irrational cribbing and nagging attitude of Mrs Singhania and her alleged extra marital affair. It has been cited as one of the most complicated and tough divorce cases which can be inferred from the fact that even after 49 hearings and three futile out of court settlement attempts the veil of uncertainty looms. It is an acid test for Mr Chadda representing Mr. Aeman and who has a record of 100% success rate for divorce cases as well Ms. Anukriti representing Mrs. Reema and popularly known as Jodi breaker. However the recent developments in the last few hearings have given the impression that today might well be the final day of judgement. Ms Mishra you may start. L1 (wife)>> Your Honor , Ive presented the facts before you for my client in the last hearing. My client wants a fair terms of settlement. She has the following demands ( Custody of child, alimony of 3 lacs per month, Land at Dehradun, Farm house at Goa, Dealership at Chandigarh, House at 11th Janpath, 2 cars ( Mercedes, BMW) Judge >> Mr Chadda, what have you got to say? L2 (husband) >> Your Honor, these are ridiculous figures. My client has worked really hard to reach the position he has. At best, we can offer the following terms of settlement ( 1.5 lacs per month, Honda City & Esteem gifted at the time of marriage, Farmhouse at Goa). Judge >> Hmmm..Madam, how do you respond to that? L1 (wife)>> Your Honor, my client has supported him in all phases of life. Her social influence has helped him to gain goodwill for his business. We believe that our demands are reasonable. To begin with, at this tender age, the child needs the care & support of its mother. Further his drinking habit & busy lifestyle would have bad influence on the child. The rest of our demands are legitimate considering the existing costs of living. L2 (husband ) >> My client is not a habitual drinker. During the recession, his business took a hit and he indulged in drinking for a brief period, but he now drinks only sparingly and that too at parties. Your client has an affair which will be bad for the child. Besides, when my client was out for business , she did not take proper care of the child who got a head injury because of her irresponsibility. Wife >> I did not know you could go this far. I am not having any affair, you are trying to cook stories. Husband >> I saw you with him several times.

This is not your drawing room but a courtroom. Please maintain decorum. L1 (wife) >> Your Honor , I propose that we discuss other issues.. my client would be happy with custody of child, 2. 5 lacs pm as alimony , farmhouse at goa , house at Janpath & the 2 cars ( BMW & Mercedes) L2 ( Husband) >> My client is agreeable for alimony of 2.5 lacs, farmhouse at Goa, 2 cars ( BMW & Esteem). He would not part with the house but is agreeable for paying rent for a house of her choice. L1 ( wife) >> My client is not okay with the rent proposition however if she is bought a house at Dehradun, then she is fine. We are okay with the other terms proposed but my client would not negotiate on the custody of child for he is a chronic drunkard. At best my client is agreeable for allowing him to stay with the child for 8 hours only on Sundays. L2 ( husband) >> We agree to the proposition for giving a house at dehradun, but we dont agree to the proposition regarding the terms of custody of the child. As far as the drinking problem is concerned, for their satisfaction, my client would join a rehab centre. If the rehab centre certifies that he is in control of his habit, then I propose joint custody. Wife >> Your Honor, I would be willing to trust him this one time and agree to the terms proposed. Narrator s role ( Aranab) During the proceedings of the case, the judge goes through all the relevant documents and discovers that as per the will laid down by late Mr Arshindar Singhania , grandfather of Mr Aeman Singhania, Mr & Mrs Singhania are eligible to receive a lumpsum amount of Rs 10 crores if their marriage lasts for at least 15 years, else the amount shall be transferred to a trust. Hence the judge advises them to go for a post settlement settlement. Judge >> Mr & Mrs Singhania , considering that you are married for the last fourteen years and also that you have a young child , it is in your best interest to keep the marriage for at least for one more year so that you can have a relook at your marital issues with the help of a experienced counselors. ,both of you have an incentive to have a fair share of Rs 5 crores each as per Mr Ashinders will . You always have the option of walking out in case things are not working as desired. Meanwhile both of you will have to jointly report to the marriage council on fortnightly basis. Wife & Husband >> Your Honor we agree to this proposition. Narrators role (Aranab) Weve demonstrated the tools of persuasion like reciprocity, authority, scarcity. Weve used the techniques of integrative bargaining for unbundling the common interests and values for achieving private gains, based on relative valuations, forecasts, risk aversion & capabilities. We have also leveraged the contingency clauses to break the deadlocks and looked at post settlement settlement technique to increase the common gains by looking at aspects which were hitherto ignored by both the parties.
