GOVERNMENT ELECTI ON COMMI SSI ON CHAI R OF THE OFFI CI AL RESULTS


OF THE 2014 STUDENT GOVERNMENT ELECTI ON

I . EXECUTI VE SUMMARY

AIter the Student Government Election Commission (the 'Commission) disqualiIied Fatma
Jaber and Chris VanWashenova from the election for Student Government President and Vice
President pursuant to Section 6.4(I) oI the Student Government Bylaws (the 'Bylaws), the
Student Government adviser (Leigh Greden, the University`s Vice President Ior Government and
Community Relations) and the Commission Chair (Nto Agbor, the Student Senate Speaker)
reviewed the results of the 2014 Student Government elections for President/Vice President and
Senator pursuant to Section 6.13 of the Bylaws and determined the following:

There were 24 Senator seats available for election. The 21 candidates who appeared on
the ballot won a seat in the Senate. Two candidates who were pre-certified as write-in
candidates also won a seat in the Senate. The final seat in the Senate was won by Conner
Beausejour, who received the most eligible write-in votes.

Desmond Miller and Steven Cole won the election for President/Vice President because
they were the only ticket that appeared on the ballot (the only pre-certified write-in
candidates, Jaber and VanWashenova, were disqualified by the Commission). The
Student Government adviser and Commission Chair reviewed the write-in votes for
President/Vice President and determined that Miller and Cole received 1,169 votes plus
five valid write-in votes for a total of 1,174 votes. The Student Government adviser and
Commission Chair also determined that Miller and Cole would have won the election
even if Jaber and VanWashenova had not been disqualified because Jaber and
VanWashenova would have received 85 valid write-in votes.

The official results of the election are attached to this report and will be submitted to the
Student Senate for ratification pursuant to Section 6.13 of the Bylaws. The unofficial
results showing all votes cast are also attached to this report.

I I . SENATOR ELECTI ON

There were 24 Senate seats available for election. The 21 candidates who appeared on the ballot
won seats in the Senate. The two write-in candidates who were pre-certified by the Commission
Chair pursuant to Section 6.10 of the Bylaws Amir Khalid and Brialle Ringer each received
sufficient votes to win a seat in the Senate. Collectively, 23 of the 24 Senate seats were won
through this process and one seat was not filled.

Other than Greden and Agbor who are charged in Section 6.13 of the Bylaws with reviewing the
election results the members of the Commission have not seen the results of the election for
President/Vice President. The results were intentionally withheld from the Commission to prevent any
actual or appearance of bias by the Commissioners in their investigation of alleged violations of rules by
Jaber`s campaign.

Section 6.10 oI the Bylaws provides that, 'No write-in votes for a candidate shall be counted
unless they have properly filed as a write-in candidate, or the office they seek is not filled in
the election (emphasis added). Pursuant to this provision, write-in votes for non-certified
candidates were reviewed to determine the winner of the unfilled Senate seat.

Numerous write-in votes were cast for Senator with various spellings. To determine the validity
of those votes, the Student Government adviser and Commission Chair used the 'voter intent
standard which is used throughout the United States and concluded that reasonable spellings
and abbreviations oI a candidate`s name constitute valid write-in votes.

Applying these standards, Conner Beausejour received the most write-in votes (11) and thus he
wins the 24
th
seat in the Senate. This standard was also used to review and incorporate valid
write-in votes for candidates who appeared on the Senate ballot.

The winners of the election for Senator with updated results are attached to this report.

I I I . PRESI DENT / VI CE PRESI DENT ELECTI ON

A. Official Results

Desmond Miller and Steven Cole won the election for President/Vice President because they
were the only ticket that appeared on the ballot (the only pre-certified write-in candidates, Jaber
and VanWashenova, were disqualified by the Commission). The Miller/Cole ticket received
1,169 votes. The Student Government adviser and Commission Chair reviewed the write-in
votes to determine the number of write-in votes received by Miller/Cole. A write-in vote for the
President/Vice President ticket is valid iI it lists a reasonable variation oI both candidates`
names. A write-in vote for President/Vice President must list the names of both candidates
because:

Article III, Section 4, oI the Constitution provides that, 'The Student Body President and
Student Body Vice President shall be elected together as a ticket. (emphasis added).

Section 6.7 of the Bylaws requires the names of candidates for President and Vice
President to appear together as a ticket: 'Names oI candidates (grouped by ticket) shall
appear on the ballot (emphasis added).. A voter is thereIore prohibited Irom casting
separate votes for a presidential candidate and a vice presidential candidate (emphasis
added).

Section 6.7 oI the Bylaws requires votes to be counted by ticket: 'The ticket receiving
the greatest number oI votes shall be the winner (emphasis added).

Candidates wishing to run for President and Vice President including write-in
candidates must submit a Declaration of Intent containing both their names and must
each sign a Candidate Affidavit.


Application oI the 'voter intent standard supports the language in the Constitution and Bylaws
that write-in votes for the President/Vice President ticket are valid only if they include both
candidates` names. For example, it is not reasonable to assume that the 74 voters who wrote-in
'Desmond Miller or the voter who wrote in 'Steven Cole For Vice or Pres. but not
Desmond intended to vote for the Miller/Cole ticket, and thus those votes may not be counted.

Although both candidates` names must be written in to constitute a valid write-in vote,
reasonable variations oI the candidates` names are acceptable including misspelled and
abbreviated names as long as it can be reasonably determined that the voter intended to vote
for the ticket.

Applying these standards, the Miller/Cole ticket received five valid write-in votes, for a total of
1,174 votes. The official election results are attached to this Report.

B. Review of other write-in votes

Although Jaber and VanWashenova were disqualified from the election for President/Vice
President, the Student Government adviser and Commission Chair reviewed other write-in votes
to determine who would have won the election had Jaber and VanWashenova not been
disqualified.

As described above, a write-in vote for the President/Vice President ticket is valid if it lists a
reasonable variation oI both candidates` names. Jaber and VanWashenova knew that they must
campaign and be elected as a ticket because their campaign literature read, 'write in Fatma and
Chris. Write-in votes Ior 'Fatma Jaber or 'Chris VanWashenova (or reasonable variations oI
either name) would not have been accepted under this standard. Several examples illustrate this
point. One voter wrote-in 'Fatma Jaber and Matt V even though nobody named 'Matt V was
running for Vice President. One write-in vote was cast Ior 'Iatma and nino (which presumably
refers to the current Student Government Vice President Nino Monea, who was not a candidate
for office and graduates this month). Many write-in votes were cast Ior 'Fatma Jaber but it
cannot be assumed that those voters intended to vote for the ticket as required by the Constitution
and Bylaws. But the write-in votes for 'Fatma Jaber & Chris V. and 'Iatma chris would have
been valid.

Applying these standards to the results of the election, Jaber and VanWashenova would have
received 85 write-in votes had they not been disqualified. Accordingly, Miller and Cole would
have won the election by a margin of 1,174 85 even if Jaber and VanWashenova had not been
disqualified.
