NOTE : For Participation in lot nos. 1, 2 and 6 of this e-auction, Pre-bid EMD as per deatils below must be deposited with MSTC
in the form of DD/PO in favour of Senior Accounts Officer, EPAD, HTPS, Kasimpur latest by 14.05.2014.

Pre-Bid EMD deposited after 14.05.2014 will not be accepted. Only those parties who have submitted the Pre-Bid EMD, as
above, will be allowed to participate in this e-auction.
IF THE SUCCESSFUL BIDDER FAILS TO PAY POST BID EMD FOR ANY LOT, ENTIRE PRE BID EMD WILL BE FORFEITED.
NOTE: PAYMENT CLAUSE: Incase the date of submission of payment happens to fall on a Public Holiday, the next day shall
be considered as the date of submission of payment.
DDs of Cooperative Bank shall not be accepted and will be returned without any action being taken on them.
NOTE: FORM "C" WILL NOT BE ACCEPTED.
NOTE: BUYERS HAVE TO INSPECT THE MATERIAL THOROUGHLY AND SATISFY THEMSELVES ABOUT THE NATURE ,
HAZARDOUS/EXPLOSIVE PROPERTIES, IF ANY, BEFORE SUBMITTING THE BID. IN CASE THEY COME ACROSS ANY
MATERIAL BEYOND THE SCOPE OF THE DESCRIPTION OF MATERIAL, IT SHOULD BE INFORMED TO SELLER/MSTC. MSTC
WILL NOT BE RESPONSIBLE FOR ANY COMPLAINT IN THIS REGARD.
1. MSTC Ltd shall hereinafter be referred to as MSTC and UPRVUNL Harduaganj as owners.
2. The offer shall be valid for a period of 90 days from the date of closing of E-Auction.
3. The materials offered for sale must be inspected prior to due date of E-Auction.
4. The bidders shall submit Earnest Money deposit by Bank draft in favour of Sr Account Officer, EPAD, Kasimpur,
payable at Kasimpur within 07 days of confirmation of bid.The EMD must be @ 10% of the net sale value quoted
(excluding taxes & duties) .Upon issue of the sale order the EMD shall automatically be converted into Security
Deposit.The Security deposit as specified in sale Order shall be adjusted only at the time of Final Payment.
5. The contract shall be treated as having been entered into as soon as the bid is confirmed in favour of the successful
bidders .The period of contract shall be sixty days form the date of last Delivery Order by MSTC against full payment
made by the party .The contract shall be deemed to be complete as soon as the Area is cleared of the entire material
allotted or on completion on the period of contract as mentioned above ,which ever is earlier.
6. All the materials are offered for sale on AS IS WHERE IS basis Ex works Owers. Rate must be quoted on unit Basis
i.e. in Rupees per M.T. only. The quantity indicated against the lot are purely indicative. SOME SCRAP MAY BE
WRAPPED WITH MUD, CEMENT, MORTAR, REFRACTORIES OR INSULATION MATERIAL. REMOVAL OF THIS
MATERIAL WILL BE THE RESPONSIBILITY OF THE SUCCESSFUL BIDDER. THE SUCCESSFUL BIDDER CANNOT
DENY TO LIFT SCRAP ON ACCOUNT OF THIS REASON. THE SCRAP OF 'B' & 'C' POWER PLANT SCRAP WILL BE
LIFTED FIRST AND AFTER COMPLETION OF LIFTING OF SCRAP OF 'B' & 'C' POWER PLANT SCRAP YARD, THE
SUCCESSFUL BIDDER WILL BE ALLOWED TO LIFT SCRAP OF 'A' POWER PLANT SCRAP YARD.
6.1 The quantity in actual may turn out to be more or less than the estimated quantity . In the event of quantity turning out
to be more than the estimated quantity the buyer has to lift the allotted quantity (+/-25%). In the event of actual quantity
turning out to be less than the estimated quantity, the buyer shall not be entitled to claim any damages, loss of interest
or compensation on this account.
7. Rate must be quoted exclusive of VAT and TCS. VAT and TCS as applicable will be charged. Any variation in Excise
Duty /VAT/TCS will be borne by the buyers. FORM "C" WILL NOT BE ACCEPTED.
8. Bidders shall submit his/ their income tax clearance certificate (Latest), partnership deed of organisation as and when
demanded by MSTC/ Owners.
9. The Bidders/ customers workmen shall have to abide by the rules regulation including safety & security regulation of
the relevant statutory Acts. Entry inside the works should only be against gate pass for the men and equipment for
which purchaser will have to apply well in advance before lifting commences.
10. The Buyer will employ his own labour and means at his own cost and risk for removal / collection. Shifting of scrap as
per schedules and payment of wages/ compensation to the labourers will be the sole responsibility of the buyer. The
purchaser shall ensure that his workmen do not loiter around within the store area or the factory areas. They shall not
touch any material except those material shown to them. If any of his workmen is even found violating these
restrictions, the purchaser shall be responsible for making good the loss to the owners on which the owner's decision
shall be final and binding .
11. PAYMENT PERIOD : The cost of each lot of material along with all taxes and duties must be paid by the buyer in equal
installments as per table given below in favour of SAO EPAD Kasimpur payable at Kasimpur.

Note:- (i) Above payment schedule shall supersedes the payment schedule as state in clause 4 of General Terms &
Conditions.
(ii) Payment dates for installments shall be strictly adhered to irrespective of whether lifting of earlier installments are
completed or not.
(iii) If payment against basic cost only is deposited and amount of VAT and late payment Fee, if any , etc . is not
deposited by purchaser, then UPRVUNL at its own discretion shall issue relevant site delivery order for reduced
quantities after adjusting the VAT / Late payment charges etc.
11.1 LATE PAYMENT PENALTY:- If the payment is not made within the free payment date mentioned in the Acceptance
Letter, the payment may be accepted at the discretion of MSTC/ UPRVUNL upto a period of two weeks only from the
due date of payment , on payment of additional late payment penalty @ 1% per week on the installment sale value, and
thereafter on the sole discretion of UPRVUNL Harduaganj.
11.2 DELIVERY PERIOD:- On submission of payment for each installment, Delivery Orders shall be issued against each
installment payment. The delivery period shall be 30 days from the date of issue of delivery advice by UPRVUNL for
each installment. The successful bidders shall lift the material allotted to them by employing their own labour and
transport at their own cost
11.3 Ground Rent @ 2% per week or part there of beyond 30 days on balance quantity of that installment will be levied
and up to 2 weeks maximum, provided written request is received before the expiry of 30 days free lifting period, if no
such request for extension is received, the sale order stands cancelled & security deposit forfeited on completion of 30
days of free lifting period.
11.4 UPRVUNL reserves the right to withdraw in part or full or to close the contract any time during the currency of
contract without assigning any reason thereof . This will not entitle the buyer to demand compensation or right for
delivery of full qty. by way of extension of contract.
12 MSTC/ UPRVUNL reserves the right to call all the eligible bidder (s) for revised bid along with requisite EMD .
13. After the submission of bid (s) by the Buyer, a presumption would be drawn that the buyer has inspected the material
and has satisfied himself about the nature , quantity, quality , other technical specification, taxes- duties and legalities
prior to the e- auction . No complaint, whatsoever, on the points referred above, would be entertained after the
submission of the bid.
14. THE TERMS AND CONDITIONS OF THE E-AUCTION HAS TO BE FOLLOWED IN TOTALITY. NON-ADHERANCE TO ANY
OF THE TERMS AND CONDITIONS OF THE E-AUCTION SHALL LEAD TO AUTOMATIC FORFEITURE OF THE
SECURITY DEPOSIT.
14) The Sale will be governed by the Material List & Special Terms & Conditions (STC) displayed on the Live eAuction Floor (and not under
Forthcoming Auctions) as well as the General Terms & Conditions (GTC) and Buyer Specific Terms & Conditions ( BSTC ) already accepted by the
Bidder at the time of eAuction Registration with MSTC. The Material List & STC displayed under View Forthcoming Auctions on MSTC's eAuction
Website are tentative and subject to change at MSTC's sole discretion before the start of eAuction. Bidders should therefore download the Material List
and STC displayed only under View Live Auctions for their record purpose, if required. The BSTC and GTC can be seen and downloaded by going to
the Home Page of the eAuction Website and clicking on NEW USER. Participation in the eAuction will be deemed to imply that the Bidder has made
himself thoroughly aware of and accepted the STC, BSTC and GTC. In case of any conflict between the STC and BSTC , the STC shall prevail. MSTC
shall have the right to issue addendum to the STC or BSTC, to clarify, amend, modify, supplement or delete any of the conditions, clauses or items
stated therein and the Addendum so issued shall form a part of the original STC.
15) The Principal/Owner of the materials reserves the right to withdraw at any stage the sale of any item or quantity of material either by number or by
weight or any other specific unit etc, even after issue of Sale Order/Delivery Order. The Principal/Owner will not be bound to assign any reason or
details thereof. Value of the materials so withdrawn, if any, and paid by the buyer will be refunded. The Principal will however, not be responsible
for any damage, loss, direct or consequential compensation whatsoever to the buyer nor for payment of any interest.
