Land Acquisition Act Sets

Out Unfavourable Terms


The right to fair compensation and
transparency in land acquisition, rehabilitation
and resettlement act, 2013, commonly known
as the land acquisition act (L! was framed by
the parliament to guide land acquisitions by the
go"ernment for public purposes and to pro"ide
proper compensations to the single or multiple
owners of the land#
Land which are owned by the pri"ate parties are
acquired by go"ernment with the help of L# $ow
is a land acquired usually% &n brief, cquisition of
land is a series of steps starting from the selection of land for acquisition# The
selected land is then announced to be acquired soon by the go"ernment for public
use in newspapers and is gi"en a specific time period before which the land will be
acquired if the owner of the land agrees for acquisition# &f not it's taken to
(urisdiction and the problem is set to be resol"ed there# compensation equal to
the "alue of land is pro"ided by the go"ernment to the respecti"e parties#
The purpose of the new L was to rectify the shortcomings of its predecessor
enacted during 1)*+# ,o was the new act better% The unfortunate answer to the
question is no# &t had many ambiguities on its rules and wasn't helping the
go"ernment to procure lands# -ederation of &ndian .hambers of .ommerce and
&ndustry (-&..&! and .onfederation of &ndian &ndustry (.&&! the two industrial
chambers are not happy with the current L and are e/pecting some changes by
the ne/t ruling party which is set to come# They argue that the new act may delay
the infrastructure de"elopment and industrial de"elopment pace# nother
unfortunate fact is that since the day the new act has been acti"e this year, there
ha"e not been any acti"e land acquisitions# The main reason for these delays is the
"ery long acquisition period stipulated by the act reaching up to 01 months# They
put forth a claim that it should be reduced to at the least a period of 2 years#
2arious bodies ha"e critici3ed the new L and e/press that it is impossible to
acquire land for any public purpose with these impossible rules# 4ost of the change
from its predecessor has been concentrated o"er the compensation and the
lawmakers might ha"e failed to see the drawback in the actual process# 5ectifying
these drawbacks might bring out a better act which could benefit the public and the
go"ernment at large#
