The Security Council,

PP1 Recalling its resolutions 2042 (2012), 2043 (2012), 2118 (2013) and 2139 (2014), and its
Presidential Statements of 3 August 2011, 21 March 2012, A!ril 2012 and 2 "cto#er 2013,
PP2 Reaffirming its strong commitment to the so$ereignt%, inde!endence, unit% and territorial
integrit% of the S%rian Ara# &e!u#lic, and to the !ur!oses and !rinci!les of the 'harter of the (nited
)ations,
PP3 Recalling its full endorsement of the *ene$a 'ommuni+u, of 30 -une 2012 .hich states that
accounta#ilit% for acts committed during the !resent conflict in the S%rian Ara# &e!u#lic must #e
addressed,
PP4 Taking note of the re!orts of the inde!endent international commission of in+uir% on the
S%rian Ara# &e!u#lic, mandated #% the /uman &ights 'ouncil to in$estigate all alleged $iolations of
international human rights la. since March 2011 in the S%rian Ara# &e!u#lic, to esta#lish the facts and
circumstances that ma% amount to such $iolations and of the crimes !er!etrated and, .here !ossi#le, to
identif% those res!onsi#le .ith a $ie. to ensuring that !er!etrators of $iolations, including those that
ma% constitute crimes against humanit%, are held accounta#le,
PP5 Recalling the statements made #% the Secretar%0*eneral and the (nited )ations /igh
'ommissioner for /uman &ights that crimes against humanit% and .ar crimes are li1el% to ha$e #een
committed in the S%rian Ara# &e!u#lic,
PP6 Noting the re!eated encouragement #% the (nited )ations /igh 'ommissioner for /uman
&ights for the Securit% 'ouncil to refer the situation to the 2nternational 'riminal 'ourt,
PP7 Determining that the situation in the S%rian Ara# &e!u#lic constitutes a threat to
international !eace and securit%,
PP !cting under 'ha!ter 322 of the 'harter of the (nited )ations,
"P1 Reaffirm" its strong condemnation of the .ides!read $iolations of human rights and international
humanitarian la. #% the S%rian authorities and !ro0go$ernment militias, as .ell as the human rights a#uses and
$iolations of international humanitarian la. #% non0State armed grou!s, all committed in the course of the
ongoing conflict in the S%rian Ara# &e!u#lic since March 20114
"P2 Deci#e" to refer the situation in the S%rian Ara# &e!u#lic descri#ed in !aragra!h 1 a#o$e since
March 2011 to the Prosecutor of the 2nternational 'riminal 'ourt4
"P3 Deci#e" also that the *o$ernment of the S%rian Ara# &e!u#lic shall coo!erate full% .ith and
!ro$ide an% necessar% assistance to the 'ourt and the Prosecutor, including #% im!lementing full% the
Agreement on the Pri$ileges and 2mmunities of the 2nternational 'riminal 'ourt, !ursuant to this
resolution and, .hile recogni5ing that States not !art% to the &ome Statute ha$e no o#ligation under the
Statute, strongl% urges all States and concerned regional and other international organi5ations to
coo!erate full% .ith the 'ourt and the Prosecutor4

"P4 Deman#" that non0State armed grou!s in the S%rian Ara# &e!u#lic also coo!erate full% .ith
and !ro$ide an% necessar% assistance to the 'ourt and the Prosecutor in connection .ith in$estigations
and !rosecutions underta1en !ursuant to this resolution4
"P $%&re""e" its commitment to an effecti$e follo. u! of the !resent resolution4
"P6 Recall" the guidance issued #% the Secretar% *eneral on contacts .ith !ersons .ho are the
su#7ect of arrest .arrants or summonses issued #% the 2nternational 'riminal 'ourt4
"P8 Deci#e" that nationals, current or former officials or !ersonnel from a State outside the
S%rian Ara# &e!u#lic .hich is not a !art% to the &ome Statute of the 2nternational 'riminal 'ourt shall
#e su#7ect to the e9clusi$e 7urisdiction of that State for all alleged acts or omissions arising out of or
related to o!erations in the S%rian Ara# &e!u#lic esta#lished or authori5ed #% the 'ouncil, unless such
e9clusi$e 7urisdiction has #een e9!ressl% .ai$ed #% the State4
"P8 Recogni'e" that none of the e9!enses incurred in connection .ith the referral, including
e9!enses related to in$estigations or !rosecutions in connection .ith that referral, shall #e #orne #% the
(nited )ations and that such costs shall #e #orne #% the !arties to the &ome Statute and those States
that .ish to contri#ute $oluntaril% and encourage" States to ma1e such contri#utions, noting the need
for funding of e9!enses related to in$estigations or !rosecutions of the 2nternational 'riminal 'ourt,
including in connection .ith situations referred to the 'ourt #% the Securit% 'ouncil, as stated in
*eneral Assem#l% resolution 68:294
"P9 (n)ite" the Prosecutor to address the 'ouncil .ithin t.o months of the date of ado!tion of
this resolution and e$er% si9 months thereafter on actions ta1en !ursuant to this resolution and re+uests
the Secretar%0*eneral to circulate the re!ort of the Prosecutor as a document of the 'ouncil, in ad$ance
of such #riefings,
