On May 27th, 2014 Naresh Kadian, Chairman, People for Animals (PFA)
Haryana and representative of UN affiliated OIPA in India conducted raids at
Panipat along with the Police and AWBI co-opted Member and Honorary
Animal Welfare officer of AWBI, during their raid 15 sharp along with the 60
semi sharp thorn bits from Om Parkash trader in Panipat were recovered,
complaint has been lodged with the SHO, PS City and 75 banned thorn bits
were confiscated by the Haryana Police. In exercise of the powers conferred by
sub- section (2) of section 38 of the Prevention of Cruelty to Animals Act, 1960
(59 of 1960), the Central Government introduced the Prevention of Cruelty to
Drought and Pack Animals Rules, 1965. As per section: 8. Use of Spiked bits
prohibited:No person shall, for the purpose of driving or riding an animal or
causing it to draw any vehicle or for otherwise controlling it, use any spiked
stick or bit, harness or yoke with spikes, knobs or - projections or any other
sharp tackle or equipment which causes or is likely to cause bruises, swellings,
abrasions or severe pain to the animal. Abhishek Kadyan and Miss Sukanya
Kadyan, both Honorary Animal Welfare Officer, Animal Welfare Board of
India (Ministry of Environment and Forest) informed OIPA - Indian People for
Animals that thorn bits are openly traded in Haryana, which are manufactured in
UP adjoining area's of Haryana. on this tips, Naresh Kadian, Representative of
OIPA in India, Chairman, PFA Haryana and Master Trainer, AWBI visited
many bricks bhatha's in Haryana along with the baghiwala's in Delhi, Jaipur and
in Haryana, to check their bits used by them and shocked to know that
maximum horse owners are using ban thorn bits on their horses, violating the
IPC 188 read with section 8 of the Prevention of Cruelty to Drought and Pack
Animals Rules, 1965 along with the section 3 and 11 of the Prevention of
Cruelty to Animals Act, 1960 (59 of 1960). Hence Animal Welfare Division and
Animal Welfare Board of India here by requested to please direct all Chief
Secretaries and Director General of Police of all States and Union Territories, to
look in to for further directions to all District Magistrates and Superintendent of
Police for strict compliance of attached legislation. It is further advised that the
State Food and Civil Supplies are issuing licenses to brick bhath's and they can
impose the conditions while processing brick bhatha fresh license and at the
time of renewal for strict compliance of animal related legislation's, like wise
Khadi and Village Industries Commission - KVIC along with all Nationalized
Bank may kindly be advised to look in to, while sanctioning loan proposal for
brick bhatha's. Today DSP and SHO, Panipat City was contacted for updates but
SHO informed that rapat in rojnamcha entered and objectionable materials
confiscated and they wants prohibition order about thorn bits, when any material
ban by the Government, then automatically it presumed that violation of section
188 IPC, if ban article recovered from the possession of any one, where as
above said trader of thorn bits violating the sales tax rules and regulations as
well and with out billing and sales tax, these ban thorn bits were being traded,
hence AWBI may kindly be directed to write demi official letter to the Deputy
Commissioner and Superintendent of Police, Panipat and Palwal for immediate
strict legal action against the traders and manufacturers of ban thorn bits, users
as well.

as well. Besides it mongoose hair paint brushes were also identified by Naresh
Kadian, objectionable paint brushes also handed over to the Wildlife Inspector
for further legal action. Hence SHO, Panipat City needs directions to lodge FIR
against all offenders in both cases.

Rule 8 of the Prevention of Cruelty to the Draught and Pack Animals, Rules,
1965, prohibits the use of spiked bits causing wound and severe pain to the
animals. The Rules provide for the law enforcement officials to take action
against the offenders of this rule. Naresh Kadian submitted before the
Committee on Petitions, Haryana Legislative Assembly that he has recovered
thorn bits from the traders in Panipat and Palwal along with local Police but
both Police failed to lodge FIR against the manufacturer and trader of the ban
thorn bits, even they refused to book that person, who is having thorn bits in his
possession, due to USE words in above said rule No. 8. As per discussion with
the Assistant District Attorney at Palwal, no criminal case and offenses has been
made by the custodian of ban thorn bits, with out any competent Authority ban
orders, to impose 188 IPC on the manufacturers, traders and holding possession
of the ban thorn bits. Abhishek Kadian and Miss Sukanya Kadian, both
Honorary Animal Welfare Officer, AWBI / Member, District Public Relation
and Grievances Committee requested to please take up the said matter before the
Chief Secretary and Director General of Police, to issue ban orders of
manufacturing, trading and possession of thorn bits. It is further requested that
all brick bhatha's also have horse carts, to carry bricks and all these horse
owners are also using ban thorn bits, hence all Superintendent of Police may
kindly be directed for further directions to all SHO's to book these horse cart
owners for the violations of the section 3, 11 and 38 of the Prevention of Cruelty
to Animals Act, 1960 read with 120-B and 188 IPC because brick bhatha
owners are also involved in this crime, as promoter for personnel gain and
profit. It is further requested to please direct all District Food and Supplies
Controller to impose conditions not to use prohibit thorn bits, while issuing
license to brick bhatha, renewing as well.

Animal Welfare Board of India comments on Point No.13: Rule 8 of the
