1. Gene2-l.
(a) The software (including Boot ROM code and other embedded software), interfaces,
content, fonts, documentation and any data that came with your iPod, as may be updated
or replaced by software updates or system restore software provided by pple, whether in
read only memory, on any other media or in any other form (collectively the !iPod
"oftware!) are licensed, not sold, to you by pple #nc$ (!pple!) for use only under the
terms of this %icense$ pple and&or pple's licensors retain ownership of the iPod
"oftware itself and reserve all rights not e(pressly granted to you$
(b) pple, at its discretion, may ma)e available future updates to the software for your
iPod$ *pdates, if any, may not necessarily include all e(isting software features or new
features that pple releases for newer iPod models$ The terms of this %icense will govern
any software updates provided by pple that replace and&or supplement the original iPod
"oftware product, unless such update is accompanied by a separate license in which case
the terms of that license will govern$
3. Pe2/i))e4 Liense Uses -n4 Res)2i)i.ns.
(a) This %icense allows you to use the iPod "oftware on a single iPod$ This %icense does
not allow the iPod "oftware to e(ist on more than one iPod at a time, and you may not
ma)e the iPod "oftware available over a networ) where it could be used by multiple
devices or multiple computers at the same time$ This %icense does not grant you any
rights to use pple proprietary interfaces and other intellectual property in the design,
development, manufacture, licensing or distribution of third party devices and accessories
for use with the iPod$ "ome of those rights are available under a separate license from
pple$ +or additional information please visit http,&&developer$apple$com&programs&mfi&
(b) -ith respect to updates to the iPod "oftware and system restore software that pple
may ma)e available for download (.iPod "oftware *pdates/), you ac)nowledge that
some iPod "oftware *pdates, or portions thereof, may be specific to particular models or
generations of the iPod and may not be available for all iPod models$ "ub0ect to the terms
and conditions of this %icense, you are granted a limited non1e(clusive license to
download the iPod "oftware *pdates that may be made available by pple for your
model of the iPod to update or restore the software on any iPods that you own or control$
This %icense does not allow you to update or restore iPods that you do not control or
own, and you may not distribute or ma)e the iPod "oftware *pdates available over a
networ) where they could be used by multiple devices or multiple computers at the same
time$ 2ou may ma)e one copy of the iPod "oftware *pdates stored on your computer in
machine1readable form for bac)up purposes only, provided that the bac)up copy must
include all copyright or other proprietary notices contained on the original$
(c) 2ou may not and you agree not to or enable others to, copy (e(cept as e(pressly
permitted by this %icense), decompile, reverse engineer, disassemble, attempt to derive
the source code of, decrypt, modify, or create derivative wor)s of the iPod "oftware, iPod
"oftware *pdates, or any part thereof (e(cept as and only to the e(tent any foregoing
restriction is prohibited by applicable law or by licensing terms governing use of open
source components that may be included with the iPod "oftware or iPod "oftware
*pdate)$
(d) By storing content on your iPod you are ma)ing a digital copy$ #n some 0urisdictions,
it is unlawful to ma)e digital copies without prior permission from the rights holder$ The
iPod "oftware and iPod "oftware *pdates may be used to reproduce materials so long as
such use is limited to reproduction of non1copyrighted materials, materials in which you
own the copyright, or materials you are authori3ed or legally permitted to reproduce$
(e) 2ou agree to use the iPod "oftware and the "ervices (as defined in "ection 4 below) in
compliance with all applicable laws, including local laws of the country or region in
which you reside or in which you download or use the iPod "oftware and *pdates$
5. T2-ns6e2.
(a) 2ou may not rent, lease, lend, redistribute or sublicense the iPod "oftware$ 2ou may,
however, ma)e a one1time permanent transfer of all of your license rights to the iPod
"oftware to another party in connection with the transfer of ownership of your iPod,
provided that, (a) the transfer must include your iPod and all of the iPod "oftware,
including all its component parts, original media, printed materials and this %icense5 (b)
you do not retain any copies of the iPod "oftware, full or partial, including copies stored
on a computer or other storage device5 and (c) the party receiving the iPod "oftware
accepts the terms and conditions of this %icense$
(b) -ith respect to an iPod "oftware *pdate, you may not rent, lease, lend or sublicense
the iPod "oftware *pdate$ 2ou may, however, ma)e a one1time permanent transfer of all
of your license rights to the iPod "oftware *pdate to another party in connection with the
transfer of the computer or iPod on which it is installed, provided that, (a) the transfer
must include your computer or iPod, as applicable, and all of the iPod "oftware *pdate,

7. Te2/in-)i.n. This %icense is effective until terminated$ 2our rights under this %icense
will terminate automatically or otherwise cease to be effective without notice from pple
if you fail to comply with any term(s) of this %icense$ *pon the termination of this
%icense, you shall cease all use of the iPod "oftware and destroy all copies, full or partial,
of the iPod "oftware *pdates$ "ections 4, 6, 7, 8, and 99 of this %icense shall survive any
such termination$

(a) #f you are a customer who is a consumer (someone who uses the iPod "oftware
outside of your trade, business or profession), you may have legal rights in your country
of residence which would prohibit the following limitations from applying to you, and

PortalPlayer software$ This %icense is enforceable by PortalPlayer in addition to pple
with respect to such software$
11. C./*le)e Ag2ee/en)B G.?e2ning L-ngC-ge. This %icense constitutes the entire
agreement between the parties with respect to the use of the iPod "oftware and iPod
"oftware *pdates licensed hereunder and supersedes all prior or contemporaneous
understandings regarding such sub0ect matter$ >o amendment to or modification of this
%icense will be binding unless in writing and signed by pple$ ny translation of this
%icense is done for local reFuirements and in the event of a dispute between the :nglish
and any non1:nglish versions, the :nglish version of this %icense shall govern, to the
e(tent not prohibited by local law in your 0urisdiction$

(a) Portions of the iPod "oftware or iPod "oftware *pdate may utili3e or include third
party software and other copyrighted material$ c)nowledgements, licensing terms and
disclaimers for such material are contained in the electronic documentation for the iPod
"oftware or iPod "oftware *pdate, and your use of such material is governed by their
respective terms$
(b) *se of MP:@1J$ To the e(tent that the iPod "oftware and iPod "oftware *pdates
contain MP:@1J video encoding and&or decoding functionality, the iPod "oftware and
iPod "oftware *pdates are licensed under the MP:@1J Cisual Patent Portfolio %icense
for the personal and non1commercial use of a consumer for (i) encoding video in
compliance with the MP:@1J Cisual "tandard (.MP:@1J Cideo/) and&or (ii) decoding
MP:@1J video that was encoded by a consumer engaged in a personal and non1
commercial activity and&or was obtained from a video provider licensed by MP:@ % to
provide MP:@1J video$ >o license is granted or shall be implied for any other use$
dditional information including that relating to promotional, internal and commercial
