COMPLAINT
PLAINTIFF, by counsel, respectfully avers that:
1. Plaintiff is a Filipino Muslim, of legal age, and a resident of Mercedes, Zamboanga
City; Defendant is also a Filipino Muslim, of legal age, and a resident of Suterville, Zamboanga
City where he may be served with summons and other processes.
2. Plaintiff and defendant got married on July 22, 2005 in accordance with Islamic
Law, and stayed married, living as husband and wife until December 18, 2012 when plaintiff
divorced defendant by repudiation in accordance with Presidential Decree No. 1083.
3. During the marriage, plaintiff and defendant begot one (1) child who is healthily
living named Allih Abdurahman.
4. A month after the divorce, defendant cohabited with certain Livia Santos without
enjoying the benefit of marriage.
5. Said child is now and still under the care and custody of the plaintiff.
6. Plaintiff has no means of income and relies entirely upon the defendant during their
marriage and the latter has means of income to sufficiently provide basic needs and
education to the child.
7. Defendant stopped supporting the child after the grant of divorce and the child could
not go to school because the plaintiff has no means of income.
8. Plaintiff, for several times, demanded support of the child from the defendant but
proved futile and defendant persistently refused to do so to the prejudice of the
welfare of the child.
WHEREFORE, respectfully prays that judgment be rendered awarding financial support
of the child Allih Abdurahman without prejudice to the visitorial rights during such period as this
Honorable Court deems proper.
Plaintiff further prays for such other reliefs deemed just and equitable under the
premises.

correct.
4. I have not heretofore commenced any other action or proceeding involving the same
issues before any courts of law, or any tribunal or agency, and to my knowledge no such action
or proceeding is pending at the aforementioned courts.
5. Should I learn hereafter that a similar action or proceeding has been filed or pending
before any courts of law or any tribunal or agency, I undertake to report such fact to this
Honorable Court within five (5) days therefrom.

ANSWER
DEFENDANT, by counsel, respectfully alleges that:
1. Defendant admits the allegations of paragraphs 1, 2, 3, 4, 5 and 6 of the complaint.
2. Defendant specifically denies the allegations of paragraph seven (7) of the complaint
the truth being that the defendant the defendant lost his job from at the time they were
divorced and inasmuch as the latter wants to support his child, he cannot do so
because he does not have sufficient means to provide the daily needs and education of
his son.
3. Defendant specifically denies the allegations contained in paragraph 8 that the
plaintiff demanded support for several times from the defendant but proved futile
because the defendant is currently engaged in a part time job as a singer in a resto bar
and from his meager wage, he gives considerable amount to the child but such
amount is not enough to provide education to the latter.
4. The defendant manifests his intention to provide education to the child as soon as he
gets a stable job.
WHEREFORE, defendant respectfully prays that the complaint be dismissed for lack of
merit.
Other reliefs deemed just and equitable under the premises are also prayed for.
