The Council of the City of Birmingham met in the Council Chambers of the City Hall of
Birmingham on December 31, 2013 at 9:30 a.m., in regular meeting.
The meeting was opened with prayer by Reverend Chris Lamb, Pastor of Glen Iris Baptist
Church.
The Pledge of Allegiance was led by Councilmember William Parker.

The minutes of October 1, 2013 and October 8, 2013 were approved as submitted.

Councilmember Abbott arrived and assumed her seat as a Councilmember.

Mayor William A. Bell, Sr. recognized Police Chief AC Roper and Deputy Fire Chief
Brooks who spoke on the safety tips during the New Year's Eve celebration. Chief Roper reminded
everyone that celebratory gunfire is illegal. There will be over 100 additional officers on the streets
tonight.

Deputy Chief Rooks reminded everyone that it is better to attend only official places that
have fireworks and be careful with space heaters and kerosene heaters. Please don't put fireworks
in the hands of children.

Mayor Bell wished the Council and citizens a Happy New Year.

The following resolutions and ordinances designated as Consent Agenda items were
introduced by the Presiding Officer:
RESOLUTION NO. 2392-13
BE IT RESOLVED by the Council of the City of Birmingham, that the application
submitted by Aman Asin LLC to the City of Birmingham, Alabama, October 15, 2013 for an Off
Premise Retail Beer and Table Wine License to be used at Fifth Avenue Marathon, 4701 5th
Avenue South, Birmingham, be and the same is hereby approved and recommended for grant by
the Alabama Alcoholic Beverage Control Board.

RESOLUTION NO. 2393-13


BE IT RESOLVED by the Council of the City of Birmingham, Alabama, that the
application submitted by the Birmingham AIDS Outreach for renewal of an Annual Bingo Permit
to conduct bingo games at 205 32nd Street South, Birmingham one (1) Monday per calendar month
be and hereby is approved for issuance to be valid for one year from date of issuance and subject to
the provisions of Title 12, Chapter 3.5 of the General Code of the City of Birmingham, 1980, as
amended.

RESOLUTION NO. 2394-13


WHEREAS, on November 26, 2013, the Birmingham City Council at its regularly
scheduled meeting declared the property described below to be a public nuisance existing in the
City of Birmingham;
WHEREAS, all proper notices were posted and delivered by certified mail to the persons,
firms, associations or corporations last assessing the below described property for state taxes as
required by Act No. 105 of the Third Special Session of the Alabama Legislature 1971, as

WHEREAS, on Tuesday, 5/14/2013, by Resolution No. 975-13 the Council of the City of
Birmingham, at its regularly scheduled meetings declared the properties described below to be a
public nuisance
WHEREAS, all proper notices were posted and delivered by certified mail to the persons,
firms, associations or corporations last assessing the below described properties for state taxes as
required by Act No. 105 of the Third Special Session of the Alabama Legislature, 1971 and as

WHEREAS, on Tuesday, 6/18/2013, Resolution No. 1202-13 by the Council of the City of
Birmingham, having heard all protests or objections presented, declared the noxious or dangerous
weeds on said properties to be a public and nuisance and directed that said nuisance be abated by
the removal of said weeds by the City; and
WHEREAS, said weeds have been cleared from the properties described below and the
cost of such clearing has been reported to the council; and
WHEREAS, notice has been given as required by law that on this date and time the
Council would consider a resolution fixing the costs and assessing said costs against the properties

RESOLUTION NO. 2427-13


WHEREAS, the Council is periodically called upon to support public events that are
organized and coordinated by local organizations for the purpose of projecting a positive image
and goodwill in the City; establishing rapport with the public and core constituents; gathering
knowledge about community interests and issues; as well as showing appreciation to those
participants who benefit from various projects and programs; and
WHEREAS, recently, the Council received an invitation from the Empowerment Congress
determining that the 2014 Empowerment Congress Leadership Institute that is being held January
13-18, 2014 in Los Angeles, California is a valuable and worthy event; and
WHEREAS, the Council has reviewed and considered relevant factors concerning this
event and has determined that it serves a public purpose; and
WHEREAS, the Council finds that participation and representation at this worthy event is
in the best interest of its citizens; and
BE IT RESOLVED that the Council of the City of Birmingham finds that the abovementioned and similar events are determined to be public purposes that promote goodwill and
serve a public interest. Therefore, we request that City of Birmingham funds be administered to
pay for this event in accordance with Section 3-1-7 of the General Code of the City of
Birmingham.

Works a department of the City of Birmingham, his 2014 resolution to accept people the way they
are., to call for a People's agenda.
