Dear Orly:
So what's this about addressing me (in your
Wednesday, December 9, 2009 letter below) as "Mr.
Lincoln?" If you're going to be artificially impersonal,
couldn't you at least call me "Dr. Lincoln?" I would
always give you the honorific title to which you are
entitled by education......if I didn't call you "Orly".....
You had previously told me not to write to you ever
again, but I guess the fact that you've written this
letter gives me license to respond....and I feel I must
respond, because you are putting me in a worse and
worse predicament. You have left me in the lurch in
a very serious way---in so many ways, in particular
on the litigation front, BUT:
Nothing that you said on that awful Wednesday
night, November 4, 2009, or at any time since
changed or could have changed the fact that I had
changed my life, especially my business and
litigation, around you and in total and abject reliance
and dependence on you. I still need you to be my
lawyer against Silverstein and the banks. You put me
in a position where I'm overextended because I

depended upon you and your promises to work with
me and support me even.
You had wanted me to be even more dependent
on you because you wanted me to live at an
apartment in Rancho Santa Margarita near your
office where you could see me conveniently and
without suspicious loss of time. You wanted me to
have the window third of your office in Rancho Santa
Margarita. You cleaned it out for me, you said it was
mine, you set up computers for me in it. I made that
my office address. I changed all my mailing
addresses to YOUR office in Rancho Santa Margarita.
And then on November 25, 2009, you wouldn't even
meet me at that office, because you see,
All that really happened when you called in a
fearful tremulous little voice at 9:56 P.M. on
Wednesday, November 4, 2009, sounding like
someone was holding a gun to your head, which
someone in particular I can think of may well have
been doing---all that you really said that night was
that you were cutting off our love affair and romance,
on which my heart depended. You told me that night
that we couldn't sleep together or have sex anymore
and that's all been bad enough.
As I told you a thousand times if I told you once:
you had re-awakened in my heart, body, and soul a
hunger that I had allowed to die, a hunger for life and
love and a woman's companionship and touch.

and the brightness of your eyes like bright flickering
candles, ORLY, my life has gone dark indeed---very
dark. I sit alone in the dark at night and miss you. I
wake up in the mornings and wish you were coming
through the door again as you did so many amazing
mornings here. I want to hear you say you love me
again, even if you say it in the softest whisper like you
used to.
I am a total wreck without you (physically,
emotionally, and yes, financially and professionally).
And even if I hadn't gotten sick, I couldn't have faced
you at court on Wednesday. Do you really want me
to get that strength? I miss you too much, I love you
too much, I need you too, too much. And really and
truly, I need you in court even more than I need you
in bed or in my life generally. I just need YOU Orly.
I desperately really and truly do need you NOT to
withdraw as my attorney, I need you to withdraw your
withdrawal, and to work with me on all the mortgage
cases on properties I now have in California---about a
dozen---and those can serve as the nucleus for a
genuine class action against every major bank in the
United States, just as we had planned.
You were with me when I first met the DeLeons.
You invited them to come over to your office in
Rancho Santa Margarita and you met them with me.
You recommended that they hire me in your office
way back in June. They were counting on your
involvement, on you and me working together. They
have now deeded me three houses. Even on the

Florida case where you kind of sabotaged me, with all
that crap about the First Amended Motion that you
say you didn't sign compared with the original motion
that you admit you DID sign, Judge Dimitrouleas did
not dismiss the case. I owe a First Amended
Complaint on Tuesday, December 15, 2009. You
were never rejected for ANY appearance pro hac vice
EXCEPT for failure to comply with the local rules.
Why would you not agree to the local rules? Why are
you using every excuse to duck out of your promises
to me? All for Yosi? After all that happened between
May 28/June 9 and November 4, 2009?
The case in Idaho is still going strong, but it can't
go far without a "lead attorney". I just need your
loyalty, I just need for you to honor your commitment
to me, and we can make great things happen. These
cases are worth millions and millions of dollars, and I
can do them if you'll help me---or should I ask Philip
J. Berg and Lisa Liberi to work with me? (They have
been in contact with me and expressed a willingness
to help me defend myself against your charges of
forgery in Florida---you might as well know this---I
have to defend myself as best I can---you are getting
the "heads up" from me before anything and
everything gets sunken into stone---I am not turning
on you except to the precise degree that you turn on
me, you know? At least I'm giving you fair warning of
what is happening, what will happen....how can I be
any fairer to you than that?).

help me, but my association with you has tainted me
for life, especially if this is the last chapter, if you
dump me here after making my name almost
inextricably intertwined with yours. Is this fair? I am
tarnished by you forever when you promised to build
me up? When you promised you would do everything
you could to build up my life again? Why are you
deserting me this way after building up my hopes so
very much? Even Peyton was pressuring me to
accept your offer to live at an apartment near you in
Rancho Santa Margarita until we got 4 Via Corbina
back.
I heard from Renada that you performed very well
against Silverstein on Wednesday. So that was good.
People ask about the contradictory things I say about
you, but they're really not contradictory: you have
wonderful dramatic presence in courtroom for
oratory, you just like discipline and knowledge of the
rules. You have great passionate delivery and
capacity to sway the emotions of a judge or jury, you
just lack a really solid education in the law. You can
inspire confidence and belief even under the most
adverse of circumstances.
So I am happy that you aimed that passionate
dramatic delivery and presence against Silverstein,
and it is something I desperately need you to
continue to do---or hire someone as good as you in
court to do it for me---to replace you in court. But
among many other things it is ridiculous to say that I
have all the papers on the Silverstein case. I have

absolutely nothing. It is just as ridiculous as saying
that I can do all the cases I've taken on in Orange
County against Silverstein without you (there are
three plaintiffs against Silverstein now---with more
possible and on the way).
It is just as ridiculous to say I can handle all the
California litigation I took on believing that you would
be working with me as it is to say that I forged your
name or ever signed anything on your behalf without
your permission. You've surely seen the unbelievable
flood and rush of such forged motions I signed
without your permission both before and after
November 4, haven't you?---Well, why would I ever
have forged or signed without your permission an
amended version of a motion which you ADMIT to
signing? I didn't forge anything, I didn't sign
anything without your permission, but since it was
an amended version of a motion you admit you
signed, WHY DO YOU CARE?
And why have you made such a monstrous big
deal about it? Let me guess: you promised your
husband Yosi that you wouldn't have any dealings
with me after a certain day and then you did, but I'll
bet you didn't tell him what we did on your dentists'
chairs on Tuesday November 3, of if you did, I'll bet
you didn't describe it in much detail.....
Anyhow, Renada said you did very well against
Silverstein, and she said she told you that we needed
you to continue the litigation against him. We really

now that we could mount all the class action suits
right from here if you'd just take the lead---the
nominal lead---the courtroom lead. Your Motion to
Withdraw was horrid---said I was a former lawyer but
didn't say how much you had promised me.
All the promises you made to me about how we'd
be working together and seeing each other forever.
You even promised to cover my medical expenses,
and a comprehensive health program with Dr. Ester
Mark? Well, I ended up in the emergency room at
noon on Wednesday because I couldn't sit up. I felt
like I was having a heart attack. I was very dizzy. I
couldn't drive and when she saw me to pick me up
Renada didn't want me to go to court with her so she
took me to the Emergency Room.
So let's see, you promised me a lifetime of
professional collaboration with you as attorney for my
estate trust and property management business in
exchange for my support in your constitutional
litigation. You promised me a free place to live and
free medical care so long as I lived in Rancho Santa
Margarita and would be your "boy toy" even though I
resisted that, and said you should tell your husband
about us, and that I preferred to live by the beach in
San Clemente....which at 20 minutes is not that far
from Rancho Santa Margarita except in the very worst
of traffic jams.
You promised in particular first to protect, then to
save, and finally to recover my house at 4 Via Corbina
only in part because you wanted it to be our long-

term "love nest"---4-5 minutes away from your office,
again depending on traffic. And now you want to
withdraw from that lawsuit?
It is so ironic. It is all so ironic. The only part of
our "relationship" that you ever actually paid for was
the part where I helped you defend against Berg's
lawsuit. Well, guess who's been just warm and
friendly and super-supportive to me and sympathetic
to me in the aftermath of the collapse of our
relationship? Well, Lisa Liberi has been. She doesn't
seem quite like the monster you portrayed her to be.
She's not judgmental and I'm quite convinced that
she didn't "off" her sister.... that was a terrible thing
you said about her. After talking to her I can't quite
believe you would come up with such a thing. And
furthermore, she's apparently a very sharp paralegal
(very well educated all around, she seems to me)---her
role with Philip Berg is she helps Berg much the way I
was helping you---except that she has a husband and
apparently a fairly decent life. Imagine what the
world would have been like if we all could have
worked together against Obama?
You and I are both basically conservatives (even if
you get confused about my anarchistic-
Libertarianism sometimes) while Lisa and Berg are
both liberals, but maybe we could have dethroned the
usurper if we had all been on the same team? As it
is, you say that they're working for Obama and Berg
says that you're a plant for the communist Chinese. I
joked to Berg that since you each think the other is

plant, you should just keep in mind that two plants
produce double the oxygen and consume double the
carbon dioxide so two plants together are better than
one.... there is so much more to be gained from
cooperation than meaningless competition in such a
difficult fight as to remove the worst President in
American history.
You have left me so very alone and kind of
helpless in the face of everything we started to create
together. I counted on you. I depended on you. I
believed in you and all your promises, even about
helping me restore my health to something more than
it is, which is pretty substandard. I never asked you
for those promises but you repeated them often
enough that I came to believe in them and rely on
them, and for five months I was rebuilding my life
around yours.
Thanks to Lucas Daniel Smith, in whom you
believed before I did, and whom I came to like after
you decided to ignore him, our private lives became
public. No one will ever understand why Lucas did
that, least of all me, but I HAD previously told you on
a dozen or more occasions that I thought it was too
risky and immoral to keep a secret, that I prefer to
live in the Sunshine, to keep no secrets from anyone,
and I wanted you for real, and would have preferred
you would have left your husband in the sunshine of
day than try to dump me in a dark jail cell, that's for
sure.

either. Why have you been carrying on this way?
You know I love/loved you for real. You know I was
not ashamed of our love affair, even with the whole
wide world-making fun of me and you and saying
horrible and hateful things. People are curious,
people are envious---people are just PEOPLE!
Various people among your supporters have
asked me if it's true about you and me---Evelyn
Bradley called me up while I was in Florida for
instance, "Is it true that you were having an affair
with Orly?" "You wouldn't be making this up, would
you?" Well, as you know, I wasn't. I didn't drag us
out into the light of day but when you started
accusing me of things I had to show the world what
the context was. Never mind the fact that you've
accused many other people of forgery this year: it is,
after all, the accusation that goes back and forth over
and over again. Go over your own blog: how many
different people HAVE you accused of forgery or
stealing from you this year? More than a few. How
many of those people ever said "I love you" to you the
way I do? I'm guessing none. But is it your "poison
of choice?" Is it the accusation you make when you
have nothing else to say to people?
All these people like Evelyn Bradley and Kaatcya
have a great deal of faith in you, just as I did. That
was very hard to take, but harder still has it been to
take you attacking me pointlessly to try to cover up
your own indiscretions with your husband. Is he

representing me against Silverstein based on
CONFLICTS OF INTEREST, I think we'll have to
inform the Court what the Conflicts of Interest really
are, won't we? You're probably right, he'll grant your
motion to withdraw as my counsel, but is it worth it?
Wouldn't it be better for us to work together, really
and truly?
Wouldn't it be one thousand percent better? Do
you really want to give up all our dreams and risk
letting Philip J. Berg and Lisa Liberi outshine you on
the mortgage front as some think they have done on
the Obama front? You had told me, once or twice,
and you were right, that Lisa Liberi is both interested
in and acquainted with the mortgage note issue.
I feel disloyal to you when I am talking in a
friendly manner to Lisa Liberi and Philip J. Berg, as
nice and friendly as they are to me. But I am only
doing this after and since you're writing multiple
letters Judge Dimitrouleas in Florida basically asking
him to have me arrested and put me in jail....when
you know I never did anything to hurt you at
all....because I never could have done anything to
harm you except in self-defense, although that's the
issue now: the law of the jungle and all that.....
So after you've shown me such treatment, I guess
I don't know what loyalty is or means anymore. You
told me not once but dozens of times you loved me,
on multiple trips to Atlanta, New York, St. Louis, and
everywhere around here. You invited me on more

eaten.... but I have random people writing to me and
asking whether you have "thrown me to the wolves" or

Judge Horn gave you 10 days from today to submit to court a motion to
amend the demur. I have notified you on 11.04.09. that I cannot work with
you any more. You had over a month to hire another attorney or proceed pro
se. I do not have any documents relating to the case. If you recall, you have all
the documents, you have to assume the case pro se and draft the response. I
don't know if you ever found the original deed and if you ever recorded the
property as I advised you to do.
Judge Horn didn't grant Mr. Silverstein a judgment on slap motion, as he
requested. Mr. Silverstein claimed that your allegations were an attack on his
protected speech of an attorney representing clients, and it was frivolous to
include him as a defendant. I responded that he was included as a defendant
not because of his protected speech as an attorney, but due to the fact that he
committed fraud on the court, namely he knew your address in Texas due to
ongoing Federal case, however he did not serve you with eviction notice there,
but rather had his process server drop the notice at the vacant house in CA. He

later defrauded judge Flynn by claiming that he properly served you with
notice and evicted you based on that fraud.
Silverstein got all red, he tried to get out of the tight spot by claiming that his
client bought this property sometime in July-August and was not aware of the
deed that you had and was not aware of the law suit in Federal court. I caught
him on lie yet again and told judge Horn that here is an example of Mr.
Silverstein defrauding this court as well (Horn), as he is claiming now that
his client bought the property only in July- August, however the deed that he
presented in demur papers shows that GRE recorded the property in Spring,
sometime in April-May.
Judge Horn said that he is not comfortable to grant Silverstein judgment in his
slap complaint, he will take it under submission and he gave 10 days to
respond to his order of demur- as it is an order with leave to amend
Your friend Renata has told me about you going to the emergency room. I am
sorry about your condition. I don't know why you didn't answer until now, but
the judge gave you 10 more days to throw away this demur motion.
I will file tomorrow a new notice and motion to withdraw, the hearing will be
in 2 weeks on Wd the 23rd of December, 1:30. I believe it is to your best
interest to simply sign a substitution. If you do not sign, the judge will grant it
in 2 weeks. as you know it is just a formality. After you submitted to court in
Florida pleadings on my behalf without my consent and with forged signature,
this is only the matter of time.
