1. Introduction:

Drug abuse is considered a negative phenomenon which affects directly the performance of
employees, leads to misbehavior, unsafe work practice, spreads negligence and causes the sliding
of individuals into various criminal fields, in addition to obstructing the strategic goals of the
companies in general.

2. Purpose

The objective of this is to describe the procedures in carrying out alcohol and drug related tests on
employees and contractors in SCCT.

This policy aims to keep up SCCT staff's health and sustain the efficiency level of their
performance, which by end supports SCCT to achieve its goals.

3. Scope:

The application of this policy includes all port users in the following cases:-

1- If an employee causes an accident/near miss inside SCCT and:
A. Is not injured.
B. Is injured.

2- Random tests for detection of substance abuse.

4. Exceptions:
There are no exceptions to any outside items set in this policy.

5. Authorities and responsibilities:
This policy is the responsibility of HR department and HSSE department on in terms of
explanation, carrying out and upgrading.

6. Accident and near miss definitions
It is any accident that resulting in damage to the company's equipment or injury to the employee
(including injuring themselves intentionally).
A near miss is an unplanned event that did not result in injury, illness, or damage but had the
potential to do so.

7. Procedures:
The drug abuse detection will be conducted on employee in the following cases:-

1-A In cases whereby responsible person is not an injured party

Once the preliminary investigation of the circumstances surrounding the incident, the person who is
responsible for the accident will be sent to SCCT clinic conduct a drugs screening to detect whether he takes
narcotics led to this incident and that will be through the clinic team with the presence of:
Department escort.
Operations > OSM / SSI / Supervisor
Engineering > ESM / Snr Engineer
Others > Department Manager
Clinic Nurse.
Clinic Doctor
If Negative result, procedures will be ended and the employee continues with his scheduled
work.
If Positive results, the employee will be immediately suspended from work and sent to a
Governmental Hospital in Port Said for comprehensive testing accompanied by:
In case of SCCT staff: SCCT Consultant doctor, direct supervisor, and the Health
representative (if available) during day shift, and not less than 2 persons (supervisors) of concerned
department at night shift.
In case of subcontractor staff: direct supervisor of Subcontractor Company, and SCCT
supervisor of concerned department.

Under any circumstances the tested person should be accompanied by at least 2 persons.

NB: If any employee refuses the above mentioned examination, the results will be considered as positive
result. "The Article 69 in Labor Law No. 12 be applied - Annex 1"

Management to negotiate with the employee to resign from company and sign social insurance form 6
without any pay OR A police report to be filed to evidence and record the case officially to be used in the
procedures of dismissing the employee.

The Governmental Hospital comprehensive test:

If Negative result, employee will be advised to return to work on his next scheduled shift and no
further action will be taken.
If Positive results, the employee will be suspended from work until further notice. His departmental
manager will be informed by HR department of status and next steps as following:
1. An investigation with the employee should be conducted within 7 days of the incident date by
notifying him in written by the infraction ascribed to him, hearing his statements, actualizing his
defense and recording all that in the investigation report.

2. Management to negotiate with the employee to resign from company and sign social insurance form
6 without any pay OR to apply the discharge sanction which should be issued during 30 days of the
date of ending the investigation by sending a notification letter to the employee by a registered post
informing him by the discharge decision and termination of his contract.
3. Same could be handed to the employee but he should sign a copy confirming his receipt and
acknowledge.
4. Copy of above mentioned notification letter to be sent to the Labor office in Port Said in case of a
dismissal decision.
5. To sue the employee in the labor Court in order to obtain the labor court dismissing decision
pursuant to Article 71 of the Labor Law in case of a dismissal decision.

"The Article 69 in Labor Law No. 12 be applied - Annex 1"
IMPORTANT: The Governmental Hospital test results will ONLY be notified to the HSSE
Manager.

In case of subcontractor: the cost of the Governmental Hospital comprehensive test will be
loaded on the subcontractor company.

1-B In cases whereby the injured person is the responsible

If the person causing the accident is injured, the same procedures mentioned above will be applied
and therefore will be a screening test to detect substance abuse and that will be in the hospital, where
the employee having his treatment accompanied by SCCT consultant doctor.

If Negative result, this will close the process and the employee will continue his recovery and return
to work when deemed fit.
If Positive results, the employee will be suspended from work and arrangements will be made for an
appointment at Governmental Hospital in Port Said for comprehensive testing accompanied by HSE
Consultant Doctor or HSE representative. After comprehensive testing, the previous process on test
results will apply.
The previous steps that have been followed in the case (1-A) will be applied, in accordance with the
outcome of the test.

2- Random tests for detection of substance abuse:
Any random test should be done at the request of the HSSE manager, then the intended person will
be sent to the SCCT clinic for drugs screening to detect substance abuse through a clinic team and
the presence of:
Department escort
Operations > OSM / SSI / Supervisor
Engineering > ESM / Snr. /Engineer
Others > Department Manager
Clinic Nurse.

The previous steps that have been followed in the case (1-A) will be applied, in accordance with the
outcome of the test.

3 - Alcohol Testing - Breath Analysis Testing

If an employee is known to be, or strongly suspected of being intoxicated by alcohol during working hours,
his or her direct manager or supervisor shall arrange for the employee to be breath tested using a
breathalyzer.

Should the test be above zero, the employee shall be required to stop work immediately and will
subsequently undergo disciplinary action.
If the test is negative, the employee is free to return to work.
If a contracted employee has been tested positive with the breathalyzer, he/she shall be immediately
removed from his or her duties and the appropriate Contracting Company/Employer will be notified
of the result.

4 - Recorded hospitals for the drug test according to SCCT contract:

1- Governmental psychiatric hospital Port Said city.
2- Air port hospital Cairo city El-Nozha El-Gdida.

5- Transportation:

Carpool will manage the required transportation process for handling the suspected person and the
accompanied persons to the hospital.

During night shift operation department will support for the transportation process.

- Termination Cases According to labor law No. 12 year 2003
*Article 69: A worker shall not be discharged unless he commits a serious error:
- If during the working hours the worker is found to be in a state of plain drunkenness or affected by the
intoxicating substance he used.

It is the Companys policy to prevent all involvement with drugs, alcohol, illegal substances,
weapons and ammunition on the companys premises. Employee will be subject to random drug,
illegal substances and alcohol tests and search for weapons, ammunition drug and illegal substances,
by signing this contract the employee has agreed to submission of these random tests and inspection
as well as disciplinary procedures.
