Under general supervisiOn, to perform a variety of financial record keeping and
specialized clerical duties involved in the processing and preparation of the City's payroll

RE: Appeal of Case Number: UP- 13-17 da Giovanni Cellar
Mr. Mullane, Commissioners and Council Members;
It is the belief of the Carmel Wine Walk by-the-Sea r M that the noted case number UP 13-17
approval should be appealed and conditions should be reviewed. It is also t he belief of the Carmel
Wine Walk by-the-Sea that UP 13-7 preliminary approval should be appealed and denied.
In the case of UP 13-17 the re-writing of the existing conditions and guidelines to the wine
tasting room policies were done at the table, not by the applicant but by staff and the
.tOmmissioners in order to push through the approval of a tasting room in Carmel-by-the-Sea.
As Commissioner Paterson, Barbara Livingston of the CRA and Jack Galante of Galante
Vineyards stated in various and different ways: "the concept, licensing and representation is t oo
muddled and sketchy." We believe that it is imperative that the type of license be identified and
approved prior to the approval of any project to see if it is consistent with the conditions and
guidelines that are in force.
The concern of the Carmel Wine Walk by-the-Sea tasting rooms is that when we have new
tasting rooms coming to our city,
a) We do not want to undermine the experience of tasting Monterey County wines
a. the City Council, the Planning Commission, the Carmel Chamber of Commerce, the
Carmel Resident's Association, the Innkeepers Association, the Monterey County
Vintners and Growers Association and the Carmel Wine Walk by-the-Sea as well as
many others have worked diligently in creating a destination marketing program t o
bring in quality visitors and appeal to the Carmel locals in order to regulate and
responsibly represent Monterey County and our local growers vintners.
b. it is important to note that there is no condition that would prevent a large Napa,
Sonoma or other winery coming to Carmel-by-the-Sea and pouring their wines
b) Licensing issues for clarification:
a. All off-site tasting rooms require a Duplicate 02 License. This is the law.
b. Those who do pouring's to the public under a Type 42 License (like Southern
Latitudes and Neilson's) are NOT tasting rooms. They buy other people's wines and
sell them along with limited tastings allowed under their license. In addition, they
usually hold other licenses, such as a Type 20 or a Type 21 so they can sell the
wine.
c. A Duplicate 02licensee (Tasting Room) can only pour the wine that was made at
their 02 License (Winery).
d. A Type 17 License (Wholesaler) and Type 20 License (Sales to consume off
premise) don't have anything to do with pouring wine.
e. Current case: As far as anyone can tell, da Giovanni wines are made at a winery in
Sonoma (with an 02 License in
Sonoma). http://www. threecarmelrestaurants.com/carmel-restaurant -wine-
club.html Obviously, da Giovanni wines cannot be poured under a Duplicate 02
License from a Morgan Hill winery that doesn't produce da Giovanni wines.
f. Bringing in the new wines (Chateau Marie Antoinette) on this application has just
complicated the matter.
g. On this issue alone, the application should never have been approved.
h. As a side note; every other wine produced by that Morgan Hill winery CAN be
poured under a Duplicate 02 License if they get one.
c) The Alcoholic Beverage Control (ABC) may grant duplicate Type 02 business licenses (off-
site Wine tasting), however, it is the Planning Commissions responsibility to determine
how the licenses are utilized
a. It was very clear that the duplicate 02 license proposed for use is from a Morgan
Hill winery, not from the applicant's winery. This would not be allowed.
b. It was also clear that the applicant did not have a Type 02 license but seemed to
have a 17-20, which does not allow for a wine tasting room.
c. ft is also clear that the grapes grown and sourced by da Giovanni are from Sonoma.
d. What was not clear was where the grapes from Chateau Marie Antoinette were
from, Santa Clara, or according to Bill Temple "maybe they're Monterey County
wines."
i. When Chateau Marie Antoinette was questioned if they belonged to any of
our local wine growing organizations i.e. MCVGA, the ultimate answer was
"no"
e. The size and scope of the project was not clear nor was the wine shop element
f. The conditions of appeal were not clear
g. The Carmel Wine Walk contends that it was not appropriate to re-write the special
conditions regarding the implementation and use and with the ABC licensing
h. The Carmel Wine Walk also contends that the revised conditions of approval were
made under special circumstances and should be stricken and revisited at the next
meeting.
i. Licensing is not clear, conditioning of approval could allow the ABC to grant any
type of license and the City would grant any use permit without public comment or
approvaJ
j. In this case, the applicant may only apply for a Type 42 Onsale Beer and Wine
license but be granted all the t asting privileges of a Winery with a Type 02.
As the Carmel Wine Walk by-the-Sea attended the wine tasting room sub-committee
meeting and supplied our by-laws to the Planning Commission, we also would suggest and
immediacy and urgency that is needed by the Commission to update and implement the guidelines
to maintain a consistent adopted wine tasting policy by the City of Carmel-by-the-Sea. Including 1)
the 02 License (Winery) is located in Monterey County, 2) the wine to be poured is made from 90%
'pnterey County grapes, and 3) the location is stand-alone (i.e., no mixed use with furniture stores,
Jewelry stores, art galleries, etc.) tt is the suggestion of the Carmel Wine Walk that the City of Carmel
places a moratorium on all tasting room applications until the guidelines are created and adopted.
The special conditions, authorizations and terms as well as findings should be re-visited and
reviewed after the wine tasting room sub-committee and staff to create and maintain a consistent
wine tasting policy guideline that t he City should adopt and use for all future proposals including UP
13-1.

This letter is in response to your California Public Records Act request received by
the City of Carmel-by-the-Sea ("City") on March 17, 2014 (the "Records Request"). This
response is sent on my authority as City Administrator.
The City has determined that it has disclosable public records responsive to your
Records Request as follows: one (1) letter of engagement and one (1) legal investigation
invoice. Please be advised that the City has determined that the entirety of the foregoing
letter of engagement is attorney work-product created in preparation of litigation and
therefore must be withheld from disclosure pursuant to the Attorney Work-Product
Exemption codified in California Code of Civil Procedure section 2018 et seq. and
applicable to the Public Records Act via Government Code Section 6254(k). Please also be
advised that the City will disclose a redacted version of the legal investigation invoice
pursuant to the same exemption stated above in order to protect certain attorney work-
product contained within said invoice. Please contact Daryl Betancur to schedule a time for
you to pick up the investigation invoice.
Please also be advised that every effort has been made to search for all of the
records which might fall within the scope of your Records Request, and, as such, the City

Thank you for accepting Councilman Steve Hillyard's request for placing the Ocean
Ave holiday lights on the City Council agenda for April 1st, Steve's last Council
meeting.
From my perspective, turning off the holiday lights is simply complying with the City's
Policy on Hol iday Lighting. A flip of the switch would do it.
The up-lights have been on in addition to the holiday lights, why, I don't know.
While the Planning Commission sub-committee considers lighting, along with signage
and awnings, we could all be evaluating the Ocean Avenue median islands without any
lights. It would provide a respite from lights, and allow our creativity to imagine more
tasteful illumination, if year round lighting on Ocean Avenue is deemed preferable.

Sharon and I briefly conferred on this. The next step is to have the Planning Commission's sign subcommittee (or
convene a new subcommittee to) review the use of the Ocean Avenue median lights, and make recommendat ions on
any changes t o that, as well as any changes recommended for holiday lights elsewhere i n the City.
Ultimately, any changes to our Muni Code or poli cies would need input from the full Planning Commission and the City
Counci l. This will be a several month effort and require staff t i me in excess of what we currently have- unless ot her
t hings are put on hold.
A reasonable goal is to have the first meeting of the subcommittee sometime in December or January, and t hen shoot
for any revisions t o our practices or code compliance effort s by summer or f all of 2014.
We' re open to your input and suggestions on this. Thank you.

Perhaps we should meet to discuss this. Issue-specific Planning Commission subcommittees (Signs, Awni ngs, Wine-
Tasting Rooms) had been set up prior to my arrival. We have a General Plan and Commercial Design guidelines that
provide guidance on the broader issues.
In my opi ni on, taking each issue separately (though with overlap as workload allows) is an effective way to make
progress on desired changes. Each issue has its own complexities and controversy, and trying to address t hem in a
general way or on a broader scale would be challengi ng.
Beyond the t hree established subcommittees I note above, there probably is a need to establish a lighting subcommittee
to address commercial lighting, holiday lighting, and the City' s median.
What I suggest ed to the Counci l was taking up the hol iday lighting pol icy (includi ng t he median lighting) through a
subcommittee, and then to t he full Planning Commission, and finally to the Council, with t he goal of having the Counci l
make any appropriate policy revisions by the start of t he next holiday l ighting season (late November).
We could also take each of these separate issues through t he Planning Commi ssion portion of t he process, and then
, undle them together for the City Council to consider all of the potential policy changes, and t he broader commercial
.esi gn issues, at a single workshop or meeti ng. We may not be able to have each of the inciividual issues through the
Planning Commission process by November, t hough.

Dear J, K, S, C, J and D,
I'm sorry to have left so abruptly after delivering Skip's written comments regarding the
Flanders' prel iminary options report. I felt like a rat abandoning a sinking ship, but I
needed to get my ail ing larynx to the warmth of home.
I apologize for not identifying myself, not once, but twice when I came forward to speak
to you. I'd planned to apologize in front of you, but forgot. It's said that the mind is the
first to go. I thought it was my cataracts and bum knees!
I do hope you take to heart the kernel of truth in the resolution I presented. Almost two
years ago I suggested to the Council that it not vote on something that would change
the face of Carmel, but refer the median lighting issue to the Planning Commission.
Although a motion to do so was formulated, it was voted down. Hence, the motion to
keep the holiday lights on year round passed.
However, a Resolution reflecting that motion was never passed by the Council. Hence,
the Council Policy C95-08 should be honored and the holiday lights in town, both
commercial and municipal , be doused.
Meanwhile, the subject of what to do in the future regarding the median lighting can be
discussed at the Planning Commission. I hope, a committee comprised of residents,
both in town and the sphere of influence, members of the business community and
Staff can meet to discuss options. Surely, there are other towns our size, with our
sense of dignity and heritage, that have addressed and solved this same issue.
At the April 3, 2012, Council meeting I offered to serve on such a committee. My offer
still stands. I can be reached by email or at home, 624-8422.

Thank you for your letter (attached) and for reaching out to City staff regarding improvements to the aesthetics on San
Carlos Street. The City appreciates your leadership in coordinating with other merchants and the City towards mutual
goals.
A coordinated approach for lighting along this block would be welcomed by the City. The City's Municipal Code allows
installation and illumination of holiday lights beginning with the third Wednesday in November and continuing until the
second Wednesday in January (City of Carmel-by-the-Sea Policy No. C95-08).
Sharon Friedrichsen (the City's Director of Public Services) and I are conferring on a re-evaluation of the City's holiday
lighting policy, as there is interest in the existing lighting policy and a more-effective compliance effort. Any policy
revisions will also need review and approval by the City Planning Commission and potentially City Council. The Planning
Commi ssion may also have a subcommittee work with staff and the business community on this issue. These efforts will
start sometime next year, likely in the summer.
I will keep your contact information, as we would like to invite your participation in these discussions and meetings.
For the other items you note in your letter: tree trimming, street lamp maintenance, and cleaning under trash
receptacles, these are under Ms. Friedrichsen's purview. I have copied her on this email, so that she can follow up with

My name is Stephen Ferry. I am the new gallery director for the Art of Dr. Seuss on San
Carlos. I recently spent some time visiting with a few of the merchants to discuss the
business trends on San Carlos Street. There were many suggestions to promote the
awareness that San Carlos is the jewel of Carmel By The Sea. Many years ago this was
"the street" to find a variety of fme artworks. Crossroads Jewelers, Elite Gallery, Bennett
Sculpture, to name a few, are involved with a print and television campaign tci help
promote the street. "Around Carmel with Hunter Finnell" recently began airing a
program showcasing a few of the merchants on San Carlos Street. Hunter refers to San
Carlos Street as "The jewel of Carmel By The Sea." We have combined advertising
dollar to create a San Carlos Street section in the upcoming issue of Carmel Magazine.
In the short term, a few of us have agreed to decorate the exterior for the holiday season
with white lights. We bope to encourage the rest of the block to use white lights in
accordance with the city's policy on holiday decorations.
In the long term, we have complied a short list of improvements that the city can make to
help beautify the street.
Tree trimming. Trees need to be cut back from the buildings for fue safety and to
allow display windows to be seen more clearly. Cut foliage blocking parking signs and
street lamps. Cut any limbs below 6-8 feet hanging over sidewalk. (Safety hazard)
Street a ~ Clean glass lenses and fixtures. Replace burned out bulbs. Lamppost
number 53 looks like the top is about to fall off. (Safety hazard)
Trash receptacles._ Unbolt wooden receptacles and power wash the sidewalk beneath.
Replace any rusted lids or rotted wood.

THE-SEA REGARDING YEAR-ROUND ILLUMINATION OF THE OCEAN
A VENUE MEDIAN LIGHTS
AND
DIRECTING CERTAIN ACTIONS TO BRING THE CITY'S PRACTICES INTO
CONFORMITY WITH ITS ADOPTED POLICIES REGARDING DOWNTOWN
LIGHTING
WHEREAS, on April3, 2012, the City Council voted 3-2 on a motion approving the
year-round illumination of holiday lights in the Ocean Avenue medians; and
WHEREAS said motion was not supported by a Resolution authorizing year-round
illumination of the Ocean Avenue median holiday lights; and
WHEREAS, the motion was in contradiction to adopted City Council Policy C95-08
which pertains to the allowance for and regulation of holiday lighting in the public rights
of way and on commercial properties; and
WHEREAS, City Council Policy C95-08 was not rescinded to facilitate the
implementation of said motion;
NOW, THEREFORE, BE IT RESOLVED TI:IA T THE CITY COUNCIL OF THE CITY
OF CARMEL-BY-THE-SEA DOES:
1. Rescind the motion of April 3, 2012 pertaining to the year-round illumination of
holiday lights in the Ocean A venue medians;
2. Reafiirm City Council Policy No. C95-08 limiting the holiday lighting season from
the third Wednesday in November until the second Wednesday in January;
3. Directs the City Administrator to enforce City Council Policy C95-08 by having the
holiday lights in the Ocean A venue medians immediately removed and notifying private
businesses which continue to display holiday lights to abate said lighting immediately as
the continuance of such lighting is also in violation of adopted Policy C95-08;
4. Directs the City Administrator to undertake an analysis of the condition of existing
"up-lighting" system which is in the medians and to report back to the Council the cost to
initiate any remedial work needed to activate said lighting system;
5. Directs the City Administrator to notify commercial businesses in the CC and SC
zones and commercial enterprises operating in residential districts that per adopted Policy
C95-08, the authorized period for displaying holiday lighting commences as of the third
Wednesday in November and concludes on the second Wednesday of January of each
year.

ThiJJ Policy applies to the public r i ghts-of-way and private prop-
erti.. in the CC and SC zones and to camaercial entexpri.soe in
the reeidential district.
The following guidelines shall ba
1. As of the second Wednesday in January, all holiday light-
ing be removed from businesses and f r om City-owned
trees.
2. All l ights and extensi on cords used outdoors shall be

exterior type UL listed.
3 . Lighting shall be secured, not loose or dangling, and
well' out of the public s way. Electrical cords shall
bo at a m.inimwD of eight ( 8) feet above tho
public right-of-way.
4. Lights are not permi.tted on trees which have a
diameter of less than three ( 3) inches, measured four
and one-half ( 4 1/2) feet above the ground.
5. L.1qhts lllUSt be hung i.n a. manner that will not da:m4qo a
tree or other public property. Nothing that will cause
holes in trees -- such as nails, pusbpins, or staples
-- lll&.y be used.
6. Lights shall be removed if, in the opinion of the For-
eat, Parks and Beach Director, tbey are damaging a tree.

8 . Peraanent exterior lighting changes are pe:r:misa.ible only
through P l anning Commission approval o an exterior de-
sign ' change. appl ication for whic h aay b6 made at the
Community Planning and Building Department.
9. Only liqhts may be instal led on public trees. No other
form of decoration -- such as ornaments, ribbons, tinsel,
artificial snow or coloring -- shall be
