COMPLAINT-AFFIDAVIT
I, Katrina Magalpok Halili, Filipino, of legal age, and with residence at No.
69 Sitio Kalandian, Bautista St., Brgy. Pinagpala, Makati City, after having
been duly sworn in accordance with law, hereby depose and state that:
(1) This complaint-affidavit is being filed to charge Hayden Camera Kho
a.k.a Mang Kanor, Filipino, of legal age, and with residence at No.
666 Mabilis Street, Barangay Pinagpala, Makati City, of the crime of
Rape under Article (Art.) 266 of the Revised Penal Code(RPC), committed as
follows:
(a) On 11 February 2012, at around 10:00 in the evening, While Im on my
way home from school Mang Kanor told me his mother Aling inday and he
needed someone to accompany them to the hospital.

(b)On the way to their house, he told me that he needed my phone to text
someone and I gave it to him and afterwhich he said if he could use it for
the mean time and grabbed my bag.
(c) Upon entering the door of his house, Mang Kanor then shut the door
and locked it, and told me his mother was upstairs. I was hesitant from that
moment but I still manage to think theres nothing wrong. So I went
upstairs and then I see no one but cameras and computers. Mang kanor
was naked at that time and pushed me to towards the bed. And told me
Sumunod ka lang sa lahat ng sasabihin ko hindi ka masasaktan, babayaran
kita wag ka magalala!
(d)Mercado then pointed his gun that was on his waist and started opening
the computers and told me
walang makakalam nito kung hindi papatayin kita
(e) After such statement, Mang Kanor told me to put my hands on his penis
and out of fear I did it, eventually he told me to open my mouth and then
he inserted his penis on my mouth while his gun was pointing in my head.
(f) After satisfying himself he told me to undress myself and lie in the bed,
and there he without conscience inserted his penis onto my vagina while
putting his gun onto my mouth and raped me. When he was tired he told
me to masturbate while hes holding a camera. Then after recording he
injected me with something and then I fell asleep.
(g) After that night when I woke up at 1pm the following day, 6 men came
into his house and raped me one after another. I was weak and couldnt
make a sound because they put a handkerchief onto my mouth.
(h)After they satisfied their carnal needs Mang Kanor hand me 10 thousand
pesos and told me that if i told anyone about what happened they will do it
to my sister. He sent me home and told me
umuwi ka na sabihin mo nangaling ka sa trabaho, di tayo nagkita hindi ka
nangaling sa bahay at walang nangyari
(i) I went back home, I tried to be normal as possible and kept it to
everyone.

(2) Appalled by what happened, my mother and I went to the police station
to report the crime committed by Hayden a.k.a as Mang Kanor against me.
The police took my sworn statement, a copy of which is hereto attached
and made an integral part hereof as Annex A.
Thereafter, I was examined by their medico-legal officer.
A copy of Medico-Legal Report is likewise hereto attached and made an
integral part hereof as Annex B .
(4)Hayden upon forcing himself to succeed applied force and intimidation,
He also perpetuated the crime of rape with treachery and evident
premeditation to succeed on his plan.
(5)Based on the foregoing, it is beyond cavil that respondent Hayden Kho
committed the crime of rape punishable under Art. 266 of the RPC.
(6) Further, whenever the crime of rape is committed with the use of a
deadly weapon or by two or more persons, the penalty shall be reclusion
perpetua to death.

AFFIANT FURTHER SAYETH NAUGHT.
