Plaintiff Jafium International Inc. ("Jafrum") brings this action against Defendants
Crorama, Inc. ("Crorama") and Husnain Alamdar ("Alamdar") (sometimes referred to
collectively as "Defendants"), alleging as follows:

Jafrum is a North Carolina corporation with its principal place of business at 3731-

website vikingbags. com.

Further, this Court has personal jurisdiction over Defendants because Defendants
Defendants also have substantial, continuous, and systemic contacts with the State of Norttr
Carolina. Upon information and belief, Defendants offer to sell and ship goods into the State of
North Carolina, and sell and offer to sell goods into the State of North Carolina to residents of
the State of North Carolina and the public at large via telephone orders, and orders taken over
Crorama's website. By virtue of these actions, Defendants have purposefully availed themselves
of the privilege of conducting business in the State of North Carolina. Moreover, Defendants
have sought

Jafrum has for many years sold motorcycle accessories and apparel, including
motorcycle saddlebags.

Based on ten patent applications simultaneous filed on March 20,2013, the United
(the "Alamdar Patents"), each entitled "Saddlebag", and each listing Alamdar as the sole
inventor (a true and correct copy of each being attached as indicated below):

On information and belief, Crorama is the owner of all right, title and interest in the Alamdar
Pate,nts.

During prosecution
of
each
of the Alamdar
individuals associated with the prosecution of the Alamdar Patents, failed to cite material prior

art information, publications and other material showing, among other things, the availability
of
anticipatory technology more than one year prior to the priority dates of each of the Alamdar
Patents. On information and on belief Defendants, and other individuals associated with the
prosecution of the Alamdar Patents, withheld this material prior art information, publications and
other information from the USPTO with deceptive intent. As a result, the inventors obtained the
Alamdar Patents by knowingly and willfully misrepresenting facts to the USPTO. And, but for
this withholding of material prior art, the Alamdar Patents would not have issued.
12. By letter dated December 27, 2012 (Exhibit K), attorney Robert H. Appert,
representing Crorama, accused Jafrum of violating the intellectual property rights
of Crorama
d/b/a Viking Bags. By letter dated January 21,2013 (Exhibit L), Jafrum's counsel explained to
Crorama's counsel that Crorama, unlike Jafrum, was producing replicas of bags sold by a third
party, Saddleman. In reply, on March 27,2013 (Exhibit M), Crorama's counsel cited the patent
applications listed above as Exhibits B, C, G, and
H.
Novenrber 10,2014 (Exhibit N), attorney Dr. Dariush G. Adli, representing Crorama, accused
Jafrum of infringing patents allegedly owned by Croram4 namely the patents listed above as
Exhibits A, B, c, D, G, H, I, and J.

These false and misleading accusations have been repeated to individuals active in
the motorcycle accessory and apparel market, and have disparaged Jafrum and its reputation,
causing and continuing to cause irreparable harm, for which money damages are inadequate.

representation.
We are writing to notify you that your unlawful copying of motorcycle bag sales
infringes upon our client's exclusive copynghts. Accordingly, you are hereby directed to
INFRINGEMENT.
Viking Bags is the owner of copyrights, trademarks and patents used in various aspects of
motorcytle bag sales. Under United States copynght law, Viking Bags' intellectual property
rights have been in effect since the date that motorcycle bag sales were created. All
copynghtable aspects of motorcycle bag sales and instructions are copynghted under United
States copynglrt law.
Our client has recently learned that your company, Jafium International, is involved in
the distribution, marketing and advertising of merchandise violating the intellectual property
rights of Viking Bags. The merchandise bears trade dress and designs that are either identical
clear imitation or derivatioas of Viking Bags. Please be advised that we have evidence of your
sale of such bags attached @xhibit A)

rectangular and are closer to the buckles of Saddtemen.
ln addition, the Viking flap has a profile that is different from my client's. One
can divide the lower edge of the flap into a front, middle and rear interval. Viking's rear

interval is inclined and its middle interval bows slightly upwardly (see Exhibit A),
whereas my client's middle and rear intervals are straight and horizontal (see Exhibit B).
Viking's front interval curyes more sharply towards the front, whereas my client's front
interval has a fairly uniform curvature.
It is my understanding that the Saddlemen bag design predates Mking's design.
This willbecome clear if you carefully compare the product image taken from the
Saddlemen website (Exhibit C) and that taken from the Mking websit (ExhibitA).
There is no doubt the Mking bag was electronically inserted onto the photograph taken
by Saddlemen using Photoshop software or the like. You will notice the obvious
rnanipulation of the motorcycle image just below the loroer tip of the rcar strap, as well
as the removal of the Saddlemen logo from the motorqycle seat. ln any event, the
preexisting Saddlemen bags negate your argument of trade dress.
Moreover, this taking of the Saddlemen photograph brings into question whether
your clienfs instruction sheets are original. Please review this question with your client
before asserting rights in a document that may not be your client's creation.
Regardless, my client has completely changed its instruction sheet for all bags in its
inventory, even though such changes may have been unnecessary.
Although somewhat unclear, your letter proposes releasing my client against
claims of copyright infringement if my client ceases further use of its motorcycle bag
instructions. Since my client has already ceased such use, I believe your client should
have no further concenis. Unless I hear frorn you othenryise I will assume that this
disposes of the issues raised in your letter.
On a different topic, your client sent an e-mailto my client contending that
"according to Google adword reseller policy you are prohibited to place a bid on our
Trade mark for example Viking Bags." This e-mail gives a link to Google policy that
contradicts your client's contention. Specifically, the policy page states that "Google will
not investigate or restrict the use of trademark terms in keyivords, even if a trademark
complaint is received."
This policy statement by Google is consistent with its recent victory in Rosetta
Stone Ltd. v. Google lnc., 676 F.3d 144 (4th Cir. 2012). After that victory Google
entered into an undisclosed settlement agreement with Rosetta Stone, but the general
conclusion is now anyone can bid on a trademarUkeyrord, even if the bidder is not an
owner of the trademark.
