Iwould refuse extradition under 18 U.S.C. 1001, using the Eisler case
as a precedent. Should the subject learn of the indictment outstanding
against him by reason of an unsuccessful attempt at extradition, there
would be little likelihood of his returning to the United States voluntarily.

Upon re-examination of the subject's file, the Department is .
of the belief that the Government would be unable to introduce into
evidence either the documents or the information contained therein
which pertain to Frank Malina t S membership in the Conununist Party and
which are now in the possession of the Immigration and Naturalization
Service, in view of the prohibition against the admissibility of hearsq
evidence and the recent deaths of the authors of these documents,
The Department, therefore, agrees with

is available pertaining to the subject t s Connmmi.st Party membership.
The Department was previously cognizant of the difficulty in prosecuting

the opinion that the United States Attorney's views concerning the
feasibility of prosecuting the subject for fraud against the Government
