Reference is made to your memorandwn of February 12, 1953, req s

ing I'Iij'" comments with respect to the possibility of instituting extra­
dition proceedings against the subject under the 1909 Treaty with
France. .

It is noted that the Passport Office of the State Department


has advised you that France has been very lenient in permitting Americans
to remain there without valid United States passports. It is further
noted that;.;although the subject can be requested to return to the
United States since his passport has been taken from him, it is the
considered opinion of the Passport Office that France would not cooperate
should the subject be unwilling to comply with the request.

In view of these circumstances, it is concluded that extradition


Proceedings should not be instituted, since it is likely .that France

Iwould refuse extradition under 18 U.S.C. 1001, using the Eisler case
as a precedent. Should the subject learn of the indictment outstanding
against him by reason of an unsuccessful attempt at extradition, there
would be little likelihood of his returning to the United States voluntarily.

evidence either the documents or the information contained therein
which pertain to Frank Malina t S membership in the Conununist Party and
which are now in the possession of the Immigration and Naturalization
Service, in view of the prohibition against the admissibility of hearsq
evidence and the recent deaths of the authors of these documents,
