CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF LEASE made and entered into by and between:
CONRADA BATE DELGADO, Filipino, of legal age, married and a resident of 28 San
Francisco St., Palompon, Leyte Purok Merkado,Agusan Canyon, Manolo Fortich,
Bukidnon, h, heereinafter referred to as the LESSOR;
-andATTY. HANAN A. ROMANDA-KAHALAN, Filipino, of legal age, married, with office
address at Unit 212 Lachmi Building, Bolton St. Davao City a corporation duly
organized and existing under and by virtue of the laws of the Philippines with
business and postal address at Powerhouse Bldg. Km. 8, Bo. Pampanga, Davao City,
hereinafter referred to as the LESSEE
WITNESSETH:
WHEREAS, the LESSOR is the owner of THE LEASED PREMISES, a house and lot,
scommercial building (Door three) situated at , Damilag, Manolo Fortich,
BukidnonPhase II San Fernando Ave., Dona Asuncion Village, Bo. Pampanga, Davao
City;

WHEREAS, the LESSEE is willing to lease from the LESSOR the above-described
premises for
residentialcommercial purposes under the following terms and
conditions:
1. The monthly rental shall be FIVE THOUSAND PESOSTEN THOUSAND PESOS
(Php105,000.00), Philippine currency, payable every ___________1st day of the
month with a maximum of ten (10) days grace period.
2. The term of this lease is __________________two (2) years commencing on
____________October 1, 2014 3 and expiring on _________________September 30,
2015. The same shall be renewable under such terms and conditions agreeable to
both LESSOR and LESSEE provided that the LESSEE shall inform the LESSOR in
writing within thirty (30) days prior to the expiration of this Contract of its intention to
renew, extend or terminate the lease. The LESSOR will then give his reply to the
LESSEEs proposal within ten (10) days from receipt of such notice.

3. This CONTRACT OF LEASE shall be valid and binding between the parties, their successorsin-interest and assigns. If there is a mortgage, sale or transfer to any party for valuable
consideration or the transfer or conveyance is by gratuitous title or hereditary succession, it shall
be a condition for the effectiveness of any such sale or transfer that this Contract shall be
respected and shall continue under the terms and conditions stipulated herein.
4. The LESSEE shall pay for and defray at his exclusive expense, the consumption of
water, electric light, telephone or other services in the leased premises; all minor
repairs in the utility service system therein shall be made by the LESSOR but for the
exclusive account of the LESSEE. Minor repairs shall pertain to repairs which does
not exceed the amount of One Thousand Pesos (PhP1,000.00).
1. 5. The LESSEE may introduce such improvements as may be necessary and
desirable to enhance the usefulness of the LEASED PREMISES. Ownership of the
improvements which are not permanent in character shall remain with the LESSEE.
At the termination or expiration of this LEASE, the LESSEE shall have the right to
remove such non-permanent improvements. All permanent improvements shall
inure to the benefit of the LESSOR, such that ownership thereof shall vest upon the

LESSOR without incurring any liability for the cost thereof, upon the termination or
expiration of the Lease; Provided, that the LESSEE shall not introduce any
permanent improvements without first securing the consent of the LESSOR.

6. The LESSEE hereby expressly acknowledges that the leased premises are in good
and tenantable condition and agrees to keep the same in such a good and
tenantable condition.
7. That all improvements or alterations to be made or introduced on the premises
shall require prior consent of the LESSOR, which consent shall not be unreasonably
withheld or delayed.
7. The LESSOR represents, warrants and covenants to the LESSEE that:
a) LESSOR is the absolute and legal owner of the building and land
constituting the leased premises, and has full right, title and, interest to grant
the leased premises to the LESSEE;
b) The land on which the building stands has been zoned for RESIDENTIAL
commercial use, and the use of the land and the building for RESIDENTIAL
purposes expressly allowed under applicable zoning regulations;
c) All taxes or government-imposed fees on the leased premises have been
paid in full by the LESSOR as of the signing of this Contract and the LESSOR
shall keep the payment updated. The LESSOR shall pay the annual real
property taxes.
d) LESSOR knows of no reason why the leased premise is not suitable for
occupancy;
The failure of the LESSOR to comply with his warranties and obligation under
the lease contract shall give the LESSEE the option to rescind the lease contract
without need for judicial recourse. In such case, the LESSOR shall be required to
return unused rentals and repair cost after the necessary deductions specified in
this Contract have been made, within thirty (30) days from receipt of notice of
rescission.
8. The LESSEE upon signing of this contract shall pay the amount of TEN THOUSAND
PESOS (Php10,000.00) as Security Deposit and TEN THOUSAND PESOS
(Php10,000.00) as one month advance rental.
It is agreed and understood that the LESSEE may apply the Security Deposit, in any
case whatsoever, against any overdue and unpaid rentals.
9. The LESSEE shall have the right to pre terminate the contract without paying any
penalty after giving written notice to the LESSOR at least thirty (30) days prior to
the intended date of termination.
10. This Agreement comes to effect upon signature by both Parties and shall be in
full force until the termination of the LEASE.

11. Any action on this Agreement shall be exclusively brought in the competent
courts of Davao City and shall subject the guilty party, aside from whatever
damages allowed by law to pay the non-guilty party for its reasonable attorneys
fees and litigation expenses.
