committees allocated to the states and

territories shall proportionately
represent the presidential preference of
all candidates (including uncommitted
status) receiving the threshold
percentage used in that states
delegation to calculate the at-large
apportionment pursuant to Rule 13.E. of
the Delegate Selection Rules, provided,
however, that members of the standing
committees from primary states shall be
allocated to presidential candidates
(including uncommitted status) based
on the statewide popular vote.
2. The presidential preference percentage
of each candidate receiving the
applicable percentage or more within
the delegation shall be multiplied by the
total number of standing committee
positions allocated to that state or
territorial delegation. If the result of
such multiplication does not equal 0.455
or above, the presidential preference in
question is not entitled to representation
on the standing committee. If the result
of such multiplication is 0.455 but less
than 1.455, the presidential preference in
question is entitled to one (1) position.
Those preferences securing more than
1.455 but less than 2.455 are entitled to
two (2) positions, etc.
3. Where the application of this formula
results in the total allocation exceeding
the total number of committee positions,
the presidential candidate whose
original figure of representation is
farthest from its eventual rounded-off
total shall be denied that one (1)
additional position. Where the
application of this formula results in the
total allocation falling short of the total
number of committee positions, the
presidential candidate whose original
figure of representation is closest to the
next rounding level shall be allotted an
additional committee position.
4. Standing committee positions allocated
to a presidential candidate shall be

52
proportionately allocated, to the extent
53
practicable, to each of the three standing
54
committees. When such allocation
55
results in an unequal distribution of
56
standing committee positions by
57
candidate preference, a drawing shall be
58
conducted to distribute the additional
59
positions.
60
61 D. Presidential Candidate Right of Approval:
62
63
1. Each presidential candidate or that
64
candidates representative authorized
65
pursuant to Rule 12.D.1. of the 2012
66
2016 Delegate Selection Rules shall be
67
given adequate notice of the meeting of
68
the states delegation authorized to
69
select standing committee members.
70
71
2. The delegation shall select the standing
72
committee members from among
73
names submitted by the presidential
74
candidates (including uncommitted
75
status), and presidential candidates
76
shall not be required to submit the name
77
of more than one person for each slot
78
awarded to such candidate for members
79
of standing committees. Provided
80
further, that presidential candidates
81
(including uncommitted status) shall
82
use their best efforts to ensure that the
83
name or names of standing committee
84
members submitted help achieve the
85
affirmative action goals established by
86
the states Delegate Selection Plan.
87
88 E. Division Between Men and Women:
89
90
1. The membership of each of the standing
91
committees from a state or territory
92
shall be as equally divided among men
93
and women as possible under the state
94
allocation; if the number is even, the
95
membership shall be equally divided
96
between men and women; if the number
97
is odd, the variance between men and
98
women may not exceed one (1), and the
99
advantaged gender must not remain
100
constant for the three standing
101
committees. The DNC Rules and
102
Bylaws Committee shall have
Page | 10

2016 Call for the Democratic National Convention

1
continuing jurisdiction to ensure
2
compliance with this equal division
3
requirement. No standing committee
4
members from a state shall be officially
5
recognized unless the Rules and Bylaws
6
Committee has certified to the Secretary
7
of the Democratic National Committee
8
that such states standing committee
9
delegation complies with this equal
10
division rule. It is the duty of the DNC
11
Rules and Bylaws Committee to
12
determine such compliance as soon as
13
practicable following the certification of
14
the states standing committee
15
members.
16
17
2. The Party Leader and Elected Official
18
membership of the standing committees
19
elected by the Executive Committee of
20
the Democratic National Committee
21
shall be divided among men and
22
women so that the variance between
23
men and women does not exceed one
24
(1), and the advantaged gender must
25
not remain constant for the three
26
standing committees.
27
28 F. Chairs of Standing Committees:
29
30
1. The Chair(s) of each Standing
31
Committee shall be elected by the
32
Executive Committee of the Democratic
33
National Committee upon nomination
34
of the National Chairperson of the
35
Democratic National Committee. Co36
Chairs and Vice Chairs may also be
37
elected in this manner.
38
39
2. Individuals who are not otherwise
40
members of the standing committees
41
who are elected Chair(s), Co-Chair(s) or

43
voting privileges on the standing

82
written notice of the date, time, place,
83
and the tentative agenda of such
84
meeting shall be sent to all members of
85
the Platform Committee. A special or
86
emergency meeting of the Platform
87
Committee may be held upon call of the
88
Chair(s) of the Platform Committee with
89
reasonable notice to the members.

2. A statement as to whether the
standing under Section 2.A. of the
challenging parties is in dispute.
3. A response to the challenge,
separately admitting or denying each

meet its substance, admitting those
parts that are true and denying those
parts that are false.
4. A plain, concise and specific
statement of each and every
affirmative defense to the alleged
violations.
5. A plain, concise and specific
statement of any other reasons why

1. A plain, concise and specific
statement that contains, by reference
to each numbered paragraph of the
challenging statement required by
Section 4.C.1., a response to each
alleged violation or request for relief.
A response to a proposition shall
fairly meet its substance, admitting
those parts that are true and denying
those parts that are false. Wherever a

part, the proposition supported by
the challenged party on that point
shall be stated.

50
2. A list of the name, address and

56
offered in opposition to the
57
challenge, together with copies of
58
those documents.
59
60
C. Challenged parties may consolidate their
61
answers.
62
63 6. Dismissal and Decision on the Pleadings
64
65
A. Dismissal:
66
67
1. The Chair of the Credentials
68
Committee shall dismiss any
69
challenge, or part of a challenge,
70
which does not fall within the
71
jurisdiction of the Credentials
72
Committee.
73
74
2. If a state party has adopted and
75
implemented an approved
76
affirmative action program, the Chair
77
shall dismiss any challenge, or part of
78
a challenge, which is based solely on
79
composition of the Convention
80
delegation, except in the case of a
81
challenge based upon the failure to
82
achieve equal division.
83
84
3. The Chair shall have authority to
85
dismiss any challenge which is
86
brought by persons lacking standing
87
under Section 2.A., or which
88
otherwise fails to comply
89
substantially with these rules, or
90
which is otherwise manifestly
91
insufficient.
92
93
4. Any dismissal shall be accompanied
94
by a written opinion by the Chair.
95
96
B. Decision on the Pleadings: The Chair of
97
the Credentials Committee shall have
98
authority to make a decision on the

1
pleadings where it is plain from the
2
challenge and the answer, together with
3
the documents accompanying those
4
pleadings, that there is no genuine issue
5
of material fact between the parties. Any
6
decision on the pleadings shall be
7
accompanied by a written opinion by the
8
Chair.
9
10
C. Review of Dismissal or Decision on the
11
Pleadings: Within five (5) calendar days
12
after service of a notice of the entry of a
13
dismissal under Section 6.A. or under
14
Section 1.B., an aggrieved party may file
15
a Petition for Review by the Credentials
16
Committee stating the objections to the
17
Chairs action, and may file a brief.
18
Within five (5) calendar days after service
19
of the petition, any other party may file a
20
brief. Consideration of the challenge by
21
the Credentials Committee shall proceed
22
as in other cases, except that the
23
challenge shall be given precedence on
24
the committees docket.
25
26 7. Decision of State Party Body
27
28
A. The Chair(s) of the Credentials
29
Committee may defer, for such period as
30
is appropriate, proceedings on a
31
challenge in order to give time for the
32
consideration of any challenge or other
33
related matter under State Democratic
34
Party procedures. The deferral period
35
shall not be so long as to interfere with
36
the processing and consideration of the
37
challenge by the Credentials Committee
38
if that should prove necessary.
39
40
B. The State Democratic Party body may
41
take such action with respect to the
42
challenge or other related matter as it is
43
authorized to take under state law and
44
state party rules.
45
46
C. After a decision by a state party body on
47
a challenge or other related matter, any
48
party to the challenge pending before the

49
Credentials Committee may request the
50
Committee to process the challenge and
51
the Committee shall do so. The party
52
making the request shall file any written
53
decision or order made with respect to
54
the challenge by the state party body.
55
The decision of the state party body shall
56
be given such weight as the Credentials
57
Committee finds warranted in the
58
circumstances.
59
60
D. Records of proceedings conducted by the
61
state party body with respect to the
62
challenge or other related matter, and
63
other papers relating to the state party
64
proceedings, shall be admissible in
65
Credentials Committee proceedings on
66
the challenge.
67
68 8.
Hearing
69
70
A. With respect to any challenge or part of a
71
challenge not dismissed or decided on
72
the pleadings under Section 6., an open
73
and public hearing shall be held on the
74
specific factual and legal matters in
75
dispute. An electronic or stenographic
76
recording or clerical notes shall be made
77
of the proceedings at any such hearing.
78
79
B. The hearing shall be held in Washington,
80
D.C. unless the Chair(s) of the
81
Credentials Committee determines that
82
in the interest of justice it should be held
83
elsewhere.
84
85
C. The hearing shall be conducted by a
86
Hearing Officer appointed by the
87
Chair(s) of the Credentials Committee.
88
The Hearing Officer shall be a Democrat,
89
neutral in the context of the challenge,
90
experienced in the law, known by
91
reputation to be fair and shall not be
92
involved in or identified with any
93
presidential campaign or any group
94
promoting or opposing credentials
95
challenges. The Chair(s) shall make a
96
reasonable effort to secure the agreement

of the parties to the Hearing Officer.

D. The Hearing Officer shall have all power
necessary to conduct the hearing in such
manner, consistent with these rules, as to
secure the just, speedy and inexpensive
determination of the challenge, including
the right to require the parties to
participate in a pre-hearing conference.
E. Prior to the commencement of the
hearing, the Hearing Officer shall
announce a ruling identifying, on the
basis of the papers filed in the challenge
and any pre-hearing conference, the
specific issues in dispute. The Hearing
Officer shall have power to rule that on
certain issues only documentary
evidence shall be received. Any party
objecting to a ruling under this
paragraph may make a proffer of the
evidence that would have been presented
but for the ruling.
F. The Hearing Officer shall hear the
evidence, dispose of procedural requests
and similar matters and, to the extent
possible, obtain stipulations of the parties
as to the facts of the challenge.
G. A challenging party shall have the
burden of proof by clear and convincing
evidence on all factual issues necessary
to the challenge, except that the burden
of proof shall rest with the challenged
party in the case of:
1. any unresolved challenges to a states
affirmative action program filed
thirty (30) days or more prior to the
initiation of the states delegate
selection process other than a
challenge made on the basis of nonimplementation of a specific
requirement of a state plan; and,
2. any challenge for failure to submit
and implement an approved
affirmative action program by the

50
deadline specified in the Delegate
51
Selection Rules.
52
53
H. The Hearing Officer shall have authority
54
to receive all competent evidence
55
relevant to the specific matters in issue
56
and to assign to it appropriate weight.
57
58
I. The Hearing Officer shall have authority
59
to order for good cause, on application or
60
sua sponte, that a party produce at the
61
hearing designated evidence in the
62
interest of justice. Where a party fails to
63
produce such evidence, the Hearing
64
Officer may make findings of fact
65
adverse to the party on all issues to
66
which the evidence would have been
67
material.
68
69
J. Subject to any ruling under Section 8.E.,
70
each party shall have the right to present
71
competent oral and documentary
72
evidence relevant to the specific matters
73
in issue and to conduct cross74
examination.
75
76
K. The Hearing Officer may require parties
77
to consolidate their challenges or
78
defenses for purposes of the hearing.
79
80
L. The Hearing Officer shall make and file a
81
written report to the Credentials
82
Committee, which shall include findings
83
of fact, conclusions of law and a
84
recommendation for disposition of the
85
challenge. The reports shall be served on
86
all parties to the challenge.
87
88
M. Any transcript or other papers in the
89
record from any proceedings before the
90
DNC Rules and Bylaws Committee shall
91
be part of the record.
92
93 9.
Consideration by the Credentials
94 Committee
95
A. The Credentials Committee shall begin
96
meeting at the call of the Chair(s) in
97
Washington, D.C., or elsewhere at the
98
call of the Chair(s), to hear challenges.

Chair(s) of the Credentials Committee
with reasonable notice to the members.
B. All meetings of the Credentials
Committee shall be open to the public;
provided that the Chair(s) of the
Committee shall exclude from the
specific area where the committee is
conducting its business all persons
whose presence in that area is not
required for the proper conduct of the
business.
C. Request for hearing by Full Committee:
Within two (2) days after service of the
Hearing Officers report, an aggrieved
party may file a written Petition for
Review by the Credentials Committee.
The petition shall contain a plain, concise
and specific statement of the reasons for
appeal and the procedural and/or
substantive errors claimed by the
petitioner.
D. Briefs:
3. Within three (3) calendar days after
filing the Petition for Review, the
petitioner for review may file a brief.
4. Within three (3) calendar days after

E. Argument:
1. Each side of a challenge shall be
entitled to present oral argument
before the Committee for a period
determined by the Chair(s) of the
committee, generally not to exceed
fifteen (15) minutes.
2. The Chair(s) of the committee may
require parties to consolidate or
separate their challenges or defense
for purposes of oral argument.
3. The Chair(s) of the committee shall
notify the parties of the time and
place of oral argument.
F. Resolutions:
1. All proposed resolutions relating to
the disposition of a credentials
challenge shall be in writing and
signed by the proponent and at least
one (1) second. Proposed resolutions
relating to the seating or unseating of
delegates or alternates shall be
seconded in writing by at least seven
(7) members, no more than two (2) of
whom may be members elected by
the delegation from the same state as
the proponent of the resolution.
2. All proposed resolutions relating to
the disposition of a credentials
challenge shall be framed so as to be
dispositive of the entire challenge
and, to that end, shall be specific in
stating the action recommended to be
taken by the Convention.
3. Following the submission of all
proposed resolutions to the Chair(s),
the resolution having the largest
number of signed seconds shall
become the pending order of
business. Twenty (20) minutes of
debate shall be allotted to each

proposed resolution, equally divided
2
between the proponents and the
3
opponents. At the conclusion of the
4
debate, the resolution shall be put to
5
a vote. In the event the resolution is
6
not adopted, the proposed resolution
7
having the next largest number of
8
signed seconds shall become the
9
pending order of business, and so on
10
until the challenge is disposed.
11
12
4. No amendment to any proposed
13
resolution shall be permitted, except
14
with the consent of the proponent,
15
and no resolution or propositions on
16
a subject different from that under
17
consideration shall be admitted in the
18
form of such an amendment.
19
20
G. Presidential Preference of Delegation:
21
Except where the issue is the expressed
22
presidential preference of the level at
23
which delegates to the National
24
Convention are elected represented by
25
the challenged delegates, any remedy for
26
a violation shall fairly reflect the
27
expressed presidential preference of that
28
level.
29
30
H. Voting: A member of the Credentials
31
Committee elected by a state delegation
32
shall not vote on a challenge arising in
33
that state. All matters shall be
34
determined by a majority vote of those
35
present and voting, a quorum of the full
36
Committee being present. A quorum
37
shall consist of members present in
38
person representing a majority of the
39

least twenty percent (20%) of the total votes
of the Credentials Committee, a minority
report shall be prepared for distribution to all
Convention delegates, alternates and the
public as part of the Committees report.
This minority report shall be distributed at
the same time the Credentials Committee
Report is distributed. No member elected to
the committee by a state delegation may join
in such request as to a proposed minority
report relating to a credentials challenge to
any delegate from his or her state. The
committee staff shall assist in the preparation
of such report.

12.

Footnotes:
(a) Each member of the Democratic National Committee, as duly certified to the Party Secretary, is a delegate from the state or territory in which he or she legally resides at the time of the
2016 Democratic National Convention. This allocation reflects the current legal residence of all such members, including the officers and those who, pursuant to the Charter of the
Democratic Party of the United States, are members by virtue of their status as Party leaders in the U.S. Congress or by virtue of their status as representatives or designees of such Party
leaders or of other associations and organizations specified in the Charter. Because such members are subject to change, delegate distribution at the Convention may differ from that set
forth above. In addition, the DNC member allocation set forth above reflects the number of votes (not the number of delegates) added to the delegation from each state or territory to take
into account such members. Because of fractional votes, the number of such delegates in some states and territories may differ from the number of delegate votes allocated to such states
or territories.
(b) Members of Congress include all Democratic members of the U.S. Senate and the U.S. House of Representatives, except those Democratic members who are reflected as delegates in
other categories pursuant to the rules. Democratic Members of Congress are allocated to the states based upon the residence of those members. The exact number of those delegates is
subject to change due to possible deaths, resignations, elections or special elections between now and the time of the 2016 Democratic National Convention, and possible changes in the
membership of the Democratic National Committee.
(c) The allocation for Democratic Governors does not include those Democratic Governors who are members of the Democratic National Committee and serve as delegates in that capacity.
This allocation for Democratic Governors is subject to change due to possible deaths, resignations, elections or special elections between now and the time of the 2016 Democratic
National Convention, and possible changes in the membership of the Democratic National Committee. Except as otherwise provided herein, Democratic Governors are those individuals as
recognized by the Democratic Governors Association.
(d) Pursuant to Article I.G. of the Call for the 2016 Democratic National Convention, this category includes the Democratic U.S. President and Vice President, former Democratic U.S.
Presidents and Vice Presidents, former Democratic Leaders of the U.S. Senate, former Democratic Speakers of the U.S. House of Representatives and Democratic Minority Leaders, as
applicable, and former Chairs of the Democratic National Committee. This allocation for Distinguished Party Leaders is subject to change due to possible deaths, resignations, elections or
special elections between now and the time of the 2016 Democratic National Convention.
+

Bonus delegates are awarded pursuant to Article I.C. of the Call for the 2016 Democratic National Convention and will be indicated next to (and in additon to) a state's allocation for District
Level and At-Large delegates and included in the Total Pledged Delegates Votes for the state and the Grand Total. Bonus alternates will be indicated and included in the Delegation Size
for the state and Grand Total.

Prepared by the DNC's Office of Party Affairs and Delegate Selection. For more information call 202-863-8046.
