MUNICIPAL ORDINANCE NO. 013-2014


CREATING THE GUINOBATAN TRAFFIC MANAGEMENT OFFICE (GTMO) AS AN
IMPLEMENTING OR ENFORCEMENT ARM OF THE MUNICIPAL GOVERNMENT IN
TRAFFIC MANAGEMENT.

WHEREAS, to facilitate proper traffic management within the municipality, the


Guinobatan Traffic Management Office (GTMO) must be created. It will act as an
implementing or enforcement arm of the Municipal Mayor in the traffic management. It
will be the apprehending agency of the municipality of traffic violators to ensure proper
traffic violators to ensure proper traffic flow and public safety.
WHEREFORE, in view of the foregoing,

SECTION 1. CREATION. It is hereby created the Guinobatan Traffic


Management Office (GTMO) under the Office of the Municipal Mayor.
SECTION 2. COMPOSTION. The GTMO shall composed of the following:

Assistant Head
Members

- An LGU personnel to be designated by the Mayor


- Traffic Division Chief of the PNP
- All Personnel of Public Safety Office
- All Traffic Law Enforces

SECTION 3. FUNCTIONS. The GMTO is primarily designed to enforce or


implement Traffic Rules and Regulations passed by the Sangguniang Bayan or by the
Land Transportation Office or any other laws to ensure a sound and organized traffic
flow in the Municipality of Guinobatan.
To strengthen its mandate, the Municipal Mayor is tasked to coordinate the Land
Transportation Office as to the accreditation, deputization and training of the personnel
of GMTO for the proper apprehension and implementation of traffic rules and
regulations.

In general, the scope of the power granted to the GMTO is not confined to the
apprehension of violators like the tricycle drivers and operators, but also to the
apprehension of violators of any moving vehicle that may endanger life and property
cause by reckless or negligent drivers. In a limited sense, its function is more on
apprehension of Tricycle Drivers violating the Guinobatan Tricycle Code of 1999, but
since the safety of the public is not only exposed to the negligence of tricycle drivers
and operators alone, but also the negligence of drivers of PUJs and private vehicles, the
GMTO under the police power of the state or under the General Welfare Cause of the
Local Government Code of 1991 is hereby mandated to enforce the laws relative to
traffic rules and regulations that guarantees the safety of each and every Guinobatan
from traffic related incidents.
SECTION 4. OPERATION. On the operational aspect, the GTFRC shall act or
recommend measures to the Sangguniang Bayan that will serve as basis of the latter to
come up with policies to regulate the award, renewal and cancellation of tricycle
franchise of erring operators. However, the GTFRC may also recommend in
coordination with the GMTO plans and programs to improve the traffic flow in the
Municipality of Guinobatan. Finally, the Office of the Mayor through the GMTO shall
implement the measures recommended by the GTFRC as approved by the
Sangguniang Bayan.
SECTION 5. FUNDING. The funding requirement of the GMTO is to be
earmarked from the budget of the Mayors Office because the GMTO plays a vital role
as the implementing arm of the Mayors Office in overseeing the safety of the public.
SECTION 6. SEPARABILTY CLAUSE. If, for any reason/s, any part/s of this
Ordinance shall be held to be unconstitutional or invalid, other parts or provisions hereof
which are not affected thereby shall continue to be in full force and effect.
SECTION 7. REPEALING CLAUSE. Any ordinance or part/s thereof which are
inconsistent with any of the provisions of this Ordinance are hereby repealed, amended
or modified accordingly.
SECTION 8. EFFECTIVITY. This ordinance shall take effect upon its approval.
