Dear Minister Naqvi,
As you are aware prominent Liberal Party organizer Mr. Gerry Lougheed Jr. is currently under
investigation by the OPP and Elections Ontario for attempting to bribe Mr. Andrew Olivier with a
appointment or job in exchange for his withdrawal from the Liberal nomination race in the
Sudbury by-election.
Given the seriousness of these investigations, I am calling on you to remove Mr. Lougheed as
Board Chair of the Greater Sudbury Police Services (GSPS) pending the outcome of these
investigations.
As Minister responsible for oversight of the police services board, its imperative that you
maintain the integrity of all police services boards, including that of the GSPS.
The Police Services Act, Ontario Regulation 421/97 states:
Members of Police Services Boards Code of Conduct
8. Board members shall uphold the letter and spirit of the Code of Conduct set out in this
Regulation and shall discharge their duties in a manner that will inspire public confidence
in the abilities and integrity of the board. O. Reg. 421/97, s. 8.
I understand that the GSPS voted yesterday to keep Mr. Lougheed as Board Chair. However as
Minister you have a responsibility to maintain the integrity and confidence all police services
boards. There is ample precedent when someone is under criminal investigation to step aside
from their duties until the investigation is complete. Its unprecedented that the Chair of a
police services board, who is on the public payroll, under criminal investigation, remains as the
head of the police services board. This type of arrogance profoundly undermines the GSPS and
the publics confidence in our police services.

As you are aware, on January 15th 2015, Mr. Olivier released an audio recording where Mr.
Lougheed said:
So I come to you, on behalf of the premier, and on behalf of, yes, Thibeault, more
indirectly, to ask you if you would consider stepping down, even more than that Andrew,
nominating himIn the course of that deliberation, the premier wants to talk to you.
They would like to present to you options in terms of appointments, jobs, whatever, that
you and her and (Liberal campaign director) Pat Sorbara could talk about it.

then you need to say So, why would Andrew Olivier be motivated to do this?
Whats in it for me? Politically, whats in it for me? In my long term, short term, is
there an appointment, are you gonna let me head up a commission what are you
giving me, for me to step down, that is worthwhile?
Under Ontario and Canadian law, it is a crime to directly or indirectly offer someone a public
appoint or government job.
The Criminal Code of Canada, Section 125(b) states:
Influencing or negotiating appointments or dealing in offices
125. Every one who
(a) receives, agrees to receive, gives or procures to be given, directly or indirectly, a
reward, advantage or benefit of any kind as consideration for cooperation, assistance or
exercise of influence to secure the appointment of any person to an office,
(b) solicits, recommends or negotiates in any manner with respect to an appointment to
or resignation from an office, in expectation of a direct or indirect reward, advantage or
benefit, or
(c) keeps without lawful authority, the proof of which lies on him, a place for transacting
or negotiating any business relating to
o (i) the filling of vacancies in offices,
o (ii) the sale or purchase of offices, or
o (iii) appointments to or resignations from offices,
is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years.
R.S., c. C-34, s. 114.

Section 96.1 of the Ontario Election Act reads:


Bribery

96.1 No person shall, directly or indirectly,


(e) give, procure or promise or agree to procure an office or employment to
induce a person to become a candidate, refrain from becoming a candidate or
withdraw his or her candidacy. 1998, c. 9, s. 44.

In a presentation about the role of the police services to the GSPS on January 14th 2015, lawyer
Mr. Glenn P. Christies said:
"This is a significant and unqualified commitment imposing on Board members a
responsibility to conduct themselves with the utmost circumspection and prudence and
with the highest levels of honest and integrity." http://bit.ly/16RSgY4
New Democrats agree.
Minister, it was your predecessor Madeleine Meilleur who signed the Order in Council on
February 9th 2011 appointing Mr. Lougheed Jr. as a member of the Greater Sudbury
Police Services Board. Given that the OPP believe that Mr. Lougheed committed a crime, the
onus is on you and your government to do the right thing to restore confidence and integrity
into the police services board and remove Mr. Lougheed as Board Chair.

We ask that you act promptly on this matter.
