Mr. Heimlich,
After review of your request, your email dialogue with Mr. Schultz, your website and blog, and
the Heimlich Maneuver in general, I support Mr. Schultz's denial of your request.
Transparency is not the issue. We have no reason to withhold the information you have requested,
besides the cost of labor.
The very nature of medicine (and all science) is experimental, and all that is required for controversy
is a dissenting opinion. While you might take issue with your father and the maneuver bearing his
name, a quick web search returned both the National Library of Medicine, National Institute of Health,
and Minnesota's own Mayo clinic website sharing instructions for performing the Heimlich maneuver.
I applaud you for fighting for what you believe in, as I view that as the right and responsibility of every
good American (yes, even Georgians). I hope you are seeking truth and improvement, and not
simply your own form of fame or personal gain. Regardless of your motives, there is a real cost in the
time you are requesting, and I believe neither the taxpayers of Minnesota nor the children of our
school district should be expected to fund your campaign.

Dear Mr. Schultz,
Thank you for your reply this afternoon to my e-mail of yesterday (copied below my signature).
1) CS: In reviewing the the information you have provided, and the Mn Statute allowing agencies to charge
for time, I feel it is not an appropriate use of tax payer dollars to waive the fee.
Given the controversial* and experimental** first aid training program that was apparently presented to
Trailview Elementary students, it's unclear why you don't think the information I've requested is important
enough to grant my request to waive the fee. Would you please provide the specific reason(s) on which you
based your determination?
2) CS: You may appeal to the Mora School Board. The Chair is Karen Kirschner and the Vice Chair is Ethan
Elvehjem. The Board Secretary is Chris Hoyles. You can contact Ms. Hoyles to direct any correspondence to

I'm not familiar enough with the laws governing the MN FOIA to determine if the Mora School Board is the
appropriate agency to which I should appeal, but thanks for the information and I'm copying Ms. Hoyles on
this so she can share with Ms. Kirschner and Mr. Elvehjem. Earlier this week MN Attorney General
Swanson's office told me that office is available to mediate with you on my behalf, so that also seems like a
sensible course.
3) As it happens, we're in the middle of Sunshine Week, sponsored by the American Society of News Editors:
http://www.sunshineweek.org As an advocate for government transparency, I'd encourage you to share our
correspondence with teachers in your schools as an informative, close-to-home civics lesson to help educate
age-appropriate students about public records, how to access them, and the obstacles they may encounter.

This is also to request a waiver of all fees in that this information is not being sought for commercial purposes and that the

Heimlich Heroes, a Cincinnati-based first aid program developed partly by Henry Heimlich, is teaching students
to perform the Heimlich maneuver on unconscious choking victims. This means that school children are being
taught a medical practice that is not recommended by the American Heart Association or Red Cross, two highly
credible public health organizations.

me to run an investigation of 'any and all records' and 'any correspondence to and/or from Jessica
Olen' and to go through the potential emails, would be difficult to estimate. According to
MN Statute, the responsible authority may require the requesting person to pay the
actual costs of searching for and retrieving government data, including the cost of
employee time, and for making, certifying, and electronically transmitting the copies of
the data. Employee time will be billed at $25/hour. This cost will exceed the $5 ceiling in
your request.
Please advise as to how you would like us proceed.

This is a request for information under the Minnesota Freedom of Information Act.
Via Mora students learn life saving technique by Kirsten Faurie, Kennebac County Times,
March 6, 2015:
Mora fourth graders practiced helping someone who is choking during a special
opportunity to learn the Heimlich Maneuver Feb. 25. The Heimlich Heroes program
sent the school a special training kit after hearing about how Trailview student Jadyn
Lilienthal used the Heimlich Maneuver to help her friend Tahlia Hendricks when she
began choking on a cherry tomato in December. The kit included training videos,
pamphlets, and particularly fun yet realistic dolls designed with a diaphragm, lungs
and windpipe for kids to practice with. The training was presented by FirstLight
medical student Jessica Olen who said, Its really about recognizing when someone
needs help and being there for them when they need it.
Please provide me with copies of any and all related records including but not limited to
training materials and correspondence including any correspondence to and/or from Jessica
Olen.
If available, please provide the records in digital format via e-mail.
I'm requesting these records for an article I'm reporting on my blog therefore this is to
request that I be categorized as a member of the news media.
If the fee for completing my request exceeds $5, please obtain my written approval prior to
completing this request. If your office wishes to correspond with me, please feel free to do so
via e-mail.
If my request is denied in whole or part, I ask that you justify all deletions by reference to
specific exemptions of the act. I also expect you to release all segregable portions of otherwise
exempt material.
