On Tuesday, February 10, 2015, Officers with the Metropolitan Police Department's (MPD) Youth Division, Missing Person’s Unit, called The Donovan Hotel, 1155 14" Street, Northwest, Washington, D.C,, to ascertain if a reported missing person was staying at the hotel. Hotel management confirmed that the missing person, David Messerschmitt, hereinafter referred to as the decedent, was a guest of the hotel staying in Room 400. 2. Hotel management responded to Room 400 to check on the welfare of the decedent, using a master keycard to gain entry. Upon entry, hotel management found the decedent face-down on the floor. He displayed no signs of life. Emergency services were requested. District of Columbia Fire Department units and Officers with MPD’s Third District responded. The decedent appeared to have stab wounds to the back and displayed no signs of life. His body remained on scene. 3. Detectives with MPD’s Homicide Branch responded to the scene and observed what appeared to be stab wounds to the decedent’s back. Blood was seen on the floor and walls of the hotel room, the entry door of the hotel room, and on the body of the decedent. A wallet was on the floor next to the decedent's head with various credit cards strewn about. Additional credit cards and identifying documents were seen throughout the room. Additionally, detectives observed that the decedent had small zip ties, red/orange, neon pink, and yellow in color, that were attached to each other and attached to his fingers. The zip ties appeared to be affixed together into makeshift handcuffs. Detectives on scene observed that the decedent’s cell phone, known through other sources to be a Samsung Galaxy $4, which he was Known to use for email and other online activity, was missing from the room. To date, the decedent’s cell phone has not been found in the course of this investigation. 5, An autopsy was later conducted at the District of Columbia Office of the Chief Medical Examiner. Among other injuries, the decedent suffered the following injuries: [1] stab wound to the left side of his chest, approximately 4 inches deep, that went through his heart; (2] stab wound to his right abdomen, approximately 3 inches deep that hit his liver; [3] stab wound to the right groin, approximately 3 inches deep; [4] stab wound to the right upper arm in the shoulder region, approximately 2 % inches deep; [5] stab wound to the upper left back; [6] stab wound to the mid-back area, almost 5 inches in depth, that hit a bone of the spinal column, fractured that bone, and pierced the pleural cavity; and [7] a stab wound to the right flank, approximately 3 inches in depth. The decedent also suffered numerous incised wounds to his left hand and right pinky finger, consistent with wounds suffered while defending himself. This is not a complete list of the decedent's injuries. The manner of death was determined to be Homicide. 6. Surveillance footage was recovered from The Donovan Hotel. It shows a suspicious individual, later identified through investigation as Jamyra Gallmon, wearing dark clothing enter the hotel and walk up the stairwell to the fourth floor. The time onthe surveillance video when Jamyra Gallmon enters the hotel is approximately 19:44:10 (7:44 p.m.) on February 9, 2015. The individual in the surveillance footage appears to have a light complexion and at times covers its face. The time frame of the suspicious individual seen in the video is consistent with the time frame that the decedent ceased contact with others via his, electronic devices (phone and email). The suspicious individual seen in the video appears to be wearing & dark winter coat, black pants, black shoes, black gloves, and at at least one point, a black mask. It is difficult to determine the sex of the suspicious individual in the video. AFFIAWPSYIGN. While processing the scene, detectives observed what appeared to be blood on the door handle of the door on the fourth floor leading to the stairwell. The apparent blood was collected, and was later subjected to testing for the presence of blood and DNA testing. The swab of the apparent blood from the door handle ‘was tested for the presence of blood. It was presumptively positive for the presence of blood. The results of the DNA testing of the door handle swab revealed a female, single source DNA profile. 8. In the course of the investigation, detectives learned that the decedent had and used the email address of deguy456@gmail.com, Detectives obtained a search warrant for the account associated with dcguy456@gmail.com. A review of the information obtained from the search of deguy456@gmail.com, showed that the decedent used deguy456(@amail.com to post on Craigslist. Detectives observed that the decedent posted an advertisement on Craigslist using deguy456@gmail.com on February 9, 2015, the date of the homicide, soliciting responses from other men. 9. From a review of emails from deguy456@gmail.com, detectives observed that the decedent had ongoing ‘communication with an individual on Craigslist on February 9, 2015, that begins at approximately 1:58 p.m. on February 9, 2015, and continues intermittently throughout the day until approximately 7:30 p.m. ‘The username of the individual with whom the decedent was communicating by Craigslist on February 9, 2015, appeared as “chrissanchez0906.” It appeared that Craigslist user “chrissanchez0906" responded to the decedent's Craigslist post from February 9, 2015. The communication between deguy456@gmail.com and ‘‘chrissanchez0906” on February 9, 2015, included the decedent telling this individual his location (The Donovan Hotel), room number (room 400), and a specific time (7:00 PM and 7:30 PM) to meet. A subpoena was sent to “Craigslist” for account information associated with user “chrissanchez0906.” It was Jeamed that the email account linked to user “‘chrissanchez0906” was: chrissanchez0906@vahoo.com. Detectives obtained a District of Columbia Superior Court search warrant for the email account chrissanchez0906@vahoo,com. Detectives reviewed the contents of the email account. Detectives found that the following phone number was used as an alternate contact within the email account: 240-601-2892. Detectives researched the phone number in law enforcement databases and found that it is associated with a Sprint account registered to a female named Jamyra Gallmon. Detectives continued to search the email account chrissanchez0906@yahoo.com and observed an email from Paypal to “Jamyra Gallon.” 11. Detectives researched Jamyra Gallmon, who appeared to be an African- American female with a light complexion, and found that she resides at 2439 Good Hope Road, Southeast, Apartment 1122, Washington, DC, 20020. On March 31, 2015, A D.C. Superior Court search warrant was issued for 2439 Good Hope Road, Apartment 1122, Southeast, Washington, DC, 20020, a one-bedroom apartment. MPD began execution of the search warrant on April 1, 2015. Jamyra Gallmon was the only person present inside of the apartment at the time the search warrant was executed. Detectives recovered numerous pieces of evidence related to the homicide. Detectives located a Samsung cell phone plugged into an electrical outlet inside of the bedroom of the location. Gallmon stated that the Samsung cell phone belonged to her. Detectives called the phone number 240-601-2892, and observed and heard that the cell phone rang. Also recovered during execution of the search warrant, were a folding pocket knife with a silver blade and black handle, black boots and black gloves. Detectives also located a pack of small, multi-colored zip ties similar to the ones found on the fingers of the decedent. 12, On March 31, 2015, a D.C. Superior Court search warrant was issued for data related to the Sprint account 240-601-2892. On April 1, 2015, detectives received the records associated with 240-601-2892. Detectives ‘were able to plot cell tower locations as they relate to the call logs, At 18:30:07 (6:30:07 p.m.) a phone call was made from the account that ended at 18:30:10 (6:30:10 p.m.). ‘The phone call registered to a cell tower located at approximately 2500 25" Street, Southeast. This cell tower is in the area of Gallmon’s home at 2439 Good Hope Road, Southeast. At 19:47:34 (7:47:34 p.m.) a phone call was made from the account ending at 19:48:20 (7:48:20 p.m.). The phone call registered to a cell tower located at approximately 1120 Vermont Avenue, Northwest. 1120 Vermont Avenue, Northwest, is within one block of the scene of the homicide, At 22:40:13 (10:40:13 p.m.) a phone call was made from the account ending at 22:49:22 (10:49:22 p.m.), ‘The phone call registered to a cell tower located at approximately 2500 25" Street, Southeast. This evidence places the cellular telephone belonging to Gallmon in the arca of the homicide in the time frame that it occurred. On April 1, 2015, a District of Columbia search warrant was issued for the Samsung cellular telephone belonging to Gallmon that was recovered during a search of her apartment and has the telephone number of 240-601-2892. Detectives were able to look into the cell phone where they observed the email account chrissanchez0906@gmail.com saved. 14. On April 1, 2015, Jamyra Gallmon responded to the Homicide Branch for an interview regarding this investigation, Gallmon was read her Miranda rights and waived. Initially Gallmon denied her involvement in this homicide. Subsequent to this interview, Gallmon was placed under arrest and charged by MPD with Felony Murder while Armed. After arrest, Gallmon was read her Miranda rights. She invoked. Moments later, Gallmon reinitiated contact with detectives by knocking on the door to the room in which she was held. Gallmon was re-tead her Miranda rights. This time she waived her rights and agreed to speak to police. During the interview, Gallmon admitted going to the hotel on the 4th floor with the intentions of robbing the decedent. Gallmon admitted to stabbing the decedent after he grabbed her arm. Gallmon stated that she stole the decedent’s SmartTrip Metro card. Gallmon admitted to bringing colorful zip ties to the hotel room, but denied using them. 15, Gallmon is an African American female with a light complexion. She is approximately 5°10”, and appears to weigh approximately 170 pounds. She has short hair. Gallmon is similar in appearance to the individual that appears in The Donovan Hotel surveillance video as set forth in paragraph 6 above. 16, As part of the investigation into the murder of David Messerschmitt, members of MPD leamed that up to the time of her arrest on April 3, 2015, Jamyra Gallmon lived with Dominique Johnson, at 2439 Good Hope Road, Southeast, Apartment #1122. On December 9, 2014, Jamyra Gallmon was a complainant in a family disturbance report involving Domingue Johnson (DOB: 9/29/1995) that occurred at 2439 Good Hope Road Southeast, Apartment 1122. 17. On Wednesday, April 1, 2015, Dominique Johnson, hereinafter referred to as defendant Johnson, spoke with Detective Christian Bastian during a brief noncustodial interview at the Homicide Branch. Defendant Johnson was advised that she was not under arrest and was free to leave at any time. During this second interview, defendant Johnson initially stated again that she had no knowledge of the homicide that occurred at The Donovan Hotel on February 9, 2015. Defendant Johnson was told by detectives that the police had obtained additional information since her initial interview and that it was their belief that she was ‘being untruthful. Defendant Johnson then stated that she was aware that Jamyra Gallmon was going to ‘commit a robbery and that they had discussed the commission of such robbery at the end of January. Defendant Johnson said that it was Gallmon’s idea, and that she (Johnson) told Galimon that it was crazy and that she should not do it. Defendant Johnson then said that she did not know that Gallmon was going to commit a robbery on February 9, 2015, and that she did not accompany Gallmon on that day. When confronted with the fact that police had collected video from places in the area, and asked whether police would see her on the CVS video, defendant Johnson said “yes,” that she would appear in the CVS video. Defendant Johnson then said that they purchased zip ties of different colors at the CVS to scare the robbery victim. Defendant Johnson stated that she and Gallmon saw the zip ties together, walked to the checkout counter together with the zip ties, and that Gallmon paid cash for the zip ties. Defendant Johnson stated that they then walked out of the CVS where she waited outside while Gallmon went inside The Donovan Hotel. ). Defendant Johnson further stated that she took a bus on the day of the robbery from work and met Gallmon in the Farragut North area, Defendant Johnson stated that she and Gallmon walked from the Farragut North area to the CVS store across the street from The Donovan Hote! where the zip ties were purchased. Defendant Johnson said that when Gallmon returned from ‘The Donovan Hotel they walked south on 14" Street, ultimately taking a bus home. Defendant Johnson stated that both she and Gallmon wore gloves and that they walked south on 14” Street while holding hands. Defendant Johnson stated that as they walked Gallmon would not speak, even though she (Johnson) asked what happened. Defendant Johnson stated that while on the bus, Gallmon told her that “it went bad,” or words to that effect. Defendant Johnson stated that Gallmon stole $40 and a metro card from the decedent during the robbery. Defendant Johnson said that she (Johnson) used the metro card, which she knew was stolen during the robbery, to get to and from work and that the card already had money on it when she got and used it. Defendant Johnson admitted to having and still using the decedent's metro card to get to and from work. Two SmartTrip Metro cards were seized from Defendant Johnson on that day. 22. Members of MPD confirmed through Metro Transit Police that one of the SmartTrip Metro cards seized from defendant Johnson on April 2, 2015, belonged to the decedent, David Messerschmitt, and was used as recently as April 1, 2015. 23. Members of MPD obtained surveillance footage from the CVS across the street from The Donovan Hotel, from February 9, 2015. The address of this CVS is 1199 Vermont Avenue, Northwest. From the footage, at approximately 7:25 p.m., two individuals can be seen entering the CVS store, one immediately in front of the other. The first of the two individuals to enter the CVS, is the same in dress and physical appearance as the suspicious individual that enters The Donovan Hotel, as described above in paragraphs 6 and 15, who has been identified through investigation as Jamyra Gallmon. The second of the two individuals appears to bbe an African American female with a medium to dark complexion, wearing dark-colored rectangular lasses, dark pants, and a dark green or black, hooded winter coat and some small areas of light coloring (apparent white or gray), with the hood up. The footage shows these same two individuals approach a self- check-out kiosk and purchase an item. Both individuals are at the kiosk, but the individual known to be Jamyra Gallmon appears to pay for the item. Both individuals can then be seen on the surveillance footage leaving the CVS from the entrance/exit that enters/exits on 14” Street, Northwest, at approximately 7:30 pam. The glasses the individual in the green or black coat is wearing in the CVS surveillance video are similar to those that defendant Johnson wore on April 3, 2015. Based on the facts set forth in this affidavit, your affiant believes probable cause exists to charge the defendant, Dominique Johnson, date of birth September 29, 1995, with Conspiracy to Commit Robbery.
