Under Trade Marks Act
12.5.7 A trade mark is any sign capable of being graphically represented that is
used, or proposed to be used, by a trader to distinguish his goods or services from
those of other traders. Classic examples include brand names, devices or logos
and colours. Where the sign consists of shapes, they must not consist exclusively
of:
(a) the shape which results from the nature of the goods themselves;
(b) the shape of goods which is necessary to obtain a technical result; or
(c) the shape which gives substantial value to the goods.
Dalam bahasa Indonesia diartikan sebagai berikut:
12.5.7 Suatu merek dagang adalah suatu tanda grafis yang dihadirkan untuk
dibuat atapun yang akan diajukan oleh seorang pengaju merek untuk membedakan
barang-barangnya ataupun pelayanan-pelayanan dari pengaju merek yang lain.
Contoh klasik meliputi nama merek, perlengkapan ataupun logo dan warna.
Dimana tanda yang terdiri dari bentuknya secara eksklusif tidak harus terdiri dari:
(a) Bentuk yang dihasilkan dari barang-barang alam;
(b) Bentuk barang-barang yang diperlukan untuk memperoleh hasil sebuah
teknik;
(c) Bentuk yang memberikan nilai substantif terhadap barang-barang tersebut.

General Provisions
Article (1)
In implementing the provisions of this law, trademarks shall be names of distinct
shapes, signatures, words, letters, numbers, drawings, symbols, stamps, and
prominent inscriptions or any other sign or combination thereof that are suitable to
distinguish industrial, commercial, vocational or agricultural products, or projects
to exploit forests or natural resources or to indicate that the item on which the
mark is carried belongs to the owner of the mark on the grounds of manufacture,
selection and invention thereof or trading therewith or to indicate the rendering of
a certain service.

Article 2 (Definitions)
(1) The terms used in this Act shall be defined as follows: <Amended

2, 2011>

The term "trademark" means any of the following items
(hereinafter referred to as "mark") that is used by a person who
produces, processes or sells goods as a business, in order to
distinguish the goods related to his/her business from those of
another person:
a. Any sign, letter, figure, three-dimensional shape or the
combination thereof or the combination of them and colors;
b. Any color that is not combined with others, the combination
of colors, any hologram, movement or other item that can
be visually recognized;
c. Any sound, odor or others that expressed realistically with a
sign, letter, figure, or by any other visual meansamong
sounds, odors and others that cannot be recognized visually;

diakui secara visual;

(zb) trade mark means a mark capable of being represented graphically and
which is capable of distinguishing the goods or services of one person from those
of others and may include shape of goods, their packaging and combination of
colours;

Menurut Pasal 2 (zb) Perdagangan Marks Act, 1999, "merek dagang berarti tanda
yang mampu mewakili grafis dan yang mampu membedakan barang atau jasa dari
satu orang dari orang lain dan mungkin termasuk bentuk barang, kemasan dan
kombinasi warna. "Tanda dapat mencakup perangkat, merek, menuju, label, tiket,
nama, tanda tangan, kata, huruf, angka, bentuk barang, kemasan atau kombinasi
warna atau kombinasi tersebut

6.-(1) In this Act a "trade mark" means any sign capable of being represented
graphically which is capable of distinguishing goods or services of one
undertaking from those of other undertakings.
(2) Without prejudice to subsection (1), a trade mark may, in particular, consist of
words (including personal names), designs, letters, numerals or the shape of goods
or of their packaging.
6) Trademark Act Japan (Act No. 127 of April 13, 1959)
Article2
(1) "Trademark" in this Act means any character(s), figure(s), sign(s) or threedimensional shape(s), or any combination thereof, or any combination thereof
with colors (hereinafter referred to as a "mark") which is:
(i) used in connection with the goods of a person who produces, certifies or
assigns the goods as a business; or
(ii) used in connection with the services of a person who provides or certifies the
services as a business (except those provided for in the preceding item).
7) Trademark Act Canada Trade-marks Act (R.S., 1985, c. T-13) Act
current to January 25th, 2011
trade-mark means
a)

a mark that is used by a person for the purpose of distinguishing or so as to


distinguish wares or services manufactured, sold, leased, hired or performed
by him from those manufactured, sold, leased, hired or performed by others,

b) a certification mark,
c)

a distinguishing guise, or

d) a proposed trade-mark;

REGISTERED TRADEMARKS
Introductory
1.( 1) In this Act a trademark means any sign capable of being represented
graphically which is capable of distinguishing goods or services of one
undertaking from those of other undertakings. A trade mark may, in
particular, consist of words (including personal names), designs,
letters,numerals or the shape of goods or their packaging.

yang mampu menunjukkan suatu grafis yang mampu untuk membedakan
antara barang atau jasa suatu usaha dengan usaha yang lainnya. Suatu
merek dagang khususnya terdiri dari kata-kata (termasuk nama pribadi),
desain, huruf, angka/bentuk barang atau kemasan.

4. (1) in this Act, Trade Mark means any visually perceptible sign capable of
being represented graphically which is capable of distinguishing goods or services
of one undertaking from those of other undertakings. A trade mark may, in
particular, consist of words (including personal names), design, letters, numerals
or the shape of goods or their packaging.
Dalam rangka peraturan ini, trade mark artinya setiap tanda yang secara
visual dapat dilihat jelas secara grafical dapt mempresentasikan dimana yang
dibedakan antara barang dan jasa yang satu dengan yang lainnya dalam bentuk
usaha. Trade mark khususnya dapat berupa kata (termasuk nama orang), desain,
kertas, angka atau bentuk ataupun paket dari barang (kemasan).

10) Trademark Act Egypt LAW NO. 82 OF 2002 ON THE PROTECTION


OF INTELLECTUAL PROPERTY RIGHTS
Article 63
A trademark is any sign distinguishing goods, whether products or services, and
include inparticular names represented in a distinctive manner, signatures, words,
letters, numerals, designs, symbols, signposts, stamps, seals, drawings,

engravings, a combination of distinctly formed colours and any other combination


of these elements if used, or meant to be used, to distinguish the products of a
particular industry, agricultural, forest or mining venture or any goods, or to
indicate the origin of products or goods, or their quality, category, guarantee,
preparation process, or to indicate the provision of any service.
Pasal 63
Sebuah merek dagang adalah tanda-tanda membedakan barang , baik produk atau
jasa , dan termasuk di nama tertentu diwakili dengan cara yang khas , tanda
tangan , kata-kata , huruf , angka , desain , simbol , rambu-rambu , stempel ,
segel , gambar , ukiran , kombinasi warna jelas terbentuk dan kombinasi lainnya
dari unsur-unsur ini jika digunakan , atau dimaksudkan untuk digunakan , untuk
membedakan produk dari industri tertentu , pertanian , usaha hutan atau
pertambangan atau barang apapun, atau untuk menunjukkan asal produk atau
barang , atau kualitas mereka , kategori , jaminan , proses persiapan , atau untuk
menunjukkan penyediaan layanan.
