Have you given registration and permission under your Company
Act to Brand Academy for distributing Awards?Does any
company which is registered under company act is
entitled to organise any award and earn money by selling
the awards?
As per my knowledge, no company collects money by way of
selling awards and it should not be its direct income. Have you
ever seen anywhere that a political party is registered under
company acts? No, because to register a party separate forum is
available at government. So, how a company act based registered
organisation can conduct award ceremony regularly? This
company organises /issues brand for other organisations where as
this company has no Registered Brand. What is the necessity to
open several websites in different award name? Because the man
behind this Mr.Sanjay Kumar Sahu,(Ghaziabad) company
trying to collect money from different organisations by different
name.

Every one respects you for your honesty, sincerity and blindly any
one can say that you are honest. But in a particular case we are
unable to understand you, whether you are honest or something
different. few days back you received a award at Dubai from a

and we admit that really you are entitled for this award & its ok!

totally fraud company and has been involved in several cheating

It is very peculiar that on dated 10th January 2015 a fake award

namely Global quality Award was organised by Brand

academy(globalqualityawards.com) several organisations have

received this award but after few days this site was blocked where
as fake photo graphs were uploaded on the face book. The
Revenue collected at Global Quality Award (Fake Award) is 6
Crore but due to percentage reason fight started between entire
team and ended at high court of Delhi. After case again they
formed another company namely: Brands Impact Private Limited.

Looking at it, even a kid can say that it can't be a website of
an international organization who is reviewing world brands. No
address, No location details. Now, WBRC claims that they are a
ten year old organization. And you know what, this domain name
was registered in January 2014. So, a branding review
consultancy was working without a website for nine years? The
address listed above is a Delhi address ( just a guess, because
purposely the complete address is not given) however, the
website is registered with another incomplete address of Bandra
Kurla Complex in Mumbai.why there is nothing clear at all about
it. No information, no proper contact details, no address, no
update about office locations

interview who can afford 1.75 lakhs as this company is a
sister concern of your channel .in more critical situation you may
deny that you have not given any permission like such. But it is
very simple anyone can believe this Propaganda as several
programme has been telecasted on your channel and you grant
Media partner permission several times. Several times all of us
have seen several advertisement promotional programme
like..Astrology etc..Programme on news channel and before
starting of those programme, you are declaring that your channel
given consent to exhibit such programme on advertisement basis
and your channel is not responsible for any damage/loss at any
manner & You are doing so, to keep your clean image &
reputation.
But when Brand Academy declaring that you are given your
consent for media partner, then there is no drought for any one,
to consider this programme as a very fair programme. Media
partner means is one kind of authentication/approval. It clearly
indicates that after verifying all the things/after good faiths you
have given your consent for Media Partner. for revenue reason
you may telecast such award programme by advertisement

basis on you channel but what is the necessity to

grant consent/approval for media partner to such Fraud
organisation whose are collecting illegal money by using
your brand.
You might have seen that, in our country several fraud companies in the
name of chit funds have collected crores of rupees from innocent peoples.
By using high publicity through leaders/media publicity etc to attract
innocent or ignorant victims, who blindly fall for them.

Mr. Bijender Singh, the learned counsel for the plaintiff, submits upon instructions
that he is not pressing upon all the reliefs prayed for in the suit at this stage, in view
of the arrangement made and the same are left open to be agitated at a
subsequent stage, if the need for the same arises.
Mr. Yashpal Singh, the learned counsel for all the defendants also states upon
instructions from defendant Nos.1 and 2, Mr. Rishu Monga and Mr.Amol Monga
respectively, that the matter can be compromised in terms of the following:
i. That the event, Global Awards scheduled to be held tomorrow i.e. 10thJanuary,
2014 shall be held by Brands Academy Private Limited (theplaintiff) and that
defendant Nos. 2, 3 and 4, i.e. Mr. Amol Monga, M/s.Brands Impact and M/s. Brands
Impact Private Limited respectively, shall not be associated with the event in any
manner whatsoever; that thereshall be no communication with any participant or

party associated with tomorrow? s event, giving an impression that defendant

Nos.2, 3 and 4 are linked with the event.
ii. The learned counsel for the defendants states that from September 2014 till
date, they have not accepted any cash nor issued any cash receipt in the name of
the plaintiff and if any such cash receipt is presented by any party, the
consequences arising out of the same shall be borne exclusively by the defendants.
Mr. Bijender Singh, the learned counsel for the plaintiff states, upon instructions,
that no cash receipt has been issued by the plaintiff so far.
iii. To facilitate the smooth functioning of the business, the parties agree that cash
receipts, if any, issued in future in the name of the plaintiff shall bear the signatures
of both, Mr. Sanjay Kumar and Mr. Rishu Monga, the Directors of the plaintiff.
iv. Current Account No.113605000357, maintained with the ICICI Bank, C-32,
Malviya Nagar, Delhi-110017, in the name of the plaintiff, M/s. Brands Academy
Private Limited, which has been frozen by Mr. Sanjay Kumar shall be de-frozen today
itself. All cheques, etc. that may have been received shall be deposited in the said
account. Expenses for tomorrow ?s event and other legitimate expenses on behalf
of the plaintiff shall be made with the joint signatures of Mr. Sanjay Kumar and Mr.
Rishu Monga.
v. The defendants agree and undertake that they would neither use the database
of the plaintiff nor would use the office premises of the plaintiff in furtherance of any
business which would be in conflict with the interests of the plaintiff. Likewise Mr.
Sanjay Kumar, Director of the plaintiff too shall not engage in any business
competing with the interests of the plaintiff.
vi. The learned counsel for the parties state, upon instructions, that all the domain
names, using the term? Brands Academy? and/or? GlobalQuality Awards? Shall be
shared with each other by 6:00 pm today.
vii. The learned counsel for the defendants submits that for the event to be held
tomorrow, certain expenses have to be defrayed, therefore, consent of the plaintiff
through Mr. Sanjay Kumar is necessary. Mr.Bijender Singh, the learned counsel for
the plaintiff has perused the list of the same and states, upon instructions, that he
has no objection if the same are defrayed and that Mr. Sanjay Kumar will readily
sign all documents for effecting the said payments by tomorrow.
viii. The learned counsel for the defendants, upon instructions, states that the
defendants agree that accounts of defendant Nos.3 and 4 pertaining to the present
financial year shall be rendered to Mr. Sanjay Kumar by them within the next two (2)
days.
ix. A list of expenses given by Mr. Yashpal Singh, the learned counsel for the
defendants, amounting to Rs.3,86,000/-, to Mr. Bijender Singh, the learned counsel
for the plaintiff, who states that the same has been approved by Mr. Sanjay Kumar.
x. The defendants assure that receipts will be, at least, four (4) times in excess of
the expenses that would be made for any event of this nature. The parties agree

that an event of this nature is expected to generate at least a profit of 20-25 per
cent. Hence similar margin of profit would be endeavoured to be credited to the
account of the plaintiff company. In the circumstances, the list of expenses given by
defendant No.1 shall be duly approved between the parties.
xi. The learned counsel for the defendants states that defendant No.1 shall share
the list of awardees with Mr. Sanjay Kumar, Director by 7:00 p.m. today itself.
xii. The parties agree that defendant No.2 shall not come on the stage during
tomorrow?s function, nonetheless since he has already been involved in organising
the event, his assistance shall be taken so that the event is held successfully.
The suit and the applications stand disposed off in terms of the aforesaid
compromise.
The court fee shall be refunded to the plaintiff as per rules.
Mr. Yashpal Singh, the learned counsel for the defendants has not filed his
vakalatnama. He submits that the same shall be filed during the course of the day.
Let a copy of this order be given dasti to the learned counsel for
the parties under the signature of the Court Master.
