Woodard Clerk tothe Common Council Office ofthe City Clerk City Hall, Room 202 24 Eagle Street ‘Albany, NY 12207 Re: Veto of Ordinance Number 6.11.15 Dear Mr. Woodard Please be advised that pursuant fo the authority set forth in Section 302 of the City of Albany Charter, I hereby VETO Ordinance Number 6.11.1, “An Ordinance Amending Section 42-151 (Living Wage Stendards) of Part 10 (Board of Contract and Supply) of the Code of the City of Albany in Relation to the Living Wage Compliance Committe,” approved by the Albany Common Council on April 6, 2015 (with amendments) and certified and served on me by the Clerk to the Common Council on April 15,2015, | feel compelled to veto Ordinance Number 6.11.15 hecause this Ordinance violates the City of Albany Charter and New York State law. My specific objections are set forth below. Section 301(e) of the City Charter states in relevant pat that: “The Mayor shall appoint the members of all boards, authorities and commissions, except as otherwise required by State or local law.” Municipal Home Rule Law Section 23(2)( provides that a local law shall be subject to mandatory voter referendum if it: “Abolishes, transfers or curtails any power of an elective officer” Ordinance Number 6.11.15 seeks to abolish, transfer or curtail the appointment power of the Mayor as designated by the Charter regarding the appointment of members to the Living ‘Wage Compliance Committee. Accordingly, as this legislation was not adopted in the form of a local lav, and because the law reduces the Mayor's power of appointment, it violates the requirements of the City of Albany Charter and the Municipal Home Rule Law. However, I ‘Would support this proposal as a local law that includes provision for voter referendum,Thank you for your time and attention to this mater.
