MODERN MANAGEMENT AND ITS EVOLUTION


Introduction
An organization established for the benefit of society. It is organized with a neat, well organized,
timed perfectly so that everyone involved can communicate and take action themselves. To
implement the commandment of Allah in this world, Muslims should be organized perfectly. As
mentioned in the quran verse 4 in surah As-saf :





Mean : Indeed, Allah loves those who fight in His cause in a row as though they are a [single]
structure joined firmly.
In effort to make an organization organized firmly and perfectly, the organization must implement
several management system. As an example, beginning 01 January 1997 the Department of
Syariah Judiciary Kedah established and has been isolated from Jabatan Agama Islam Negeri
Kedah (JAIK ) management and this department practices administrative management in which
the Syariah Judiciary Department Kedah headed by a Chief Judge.
The staffs who has been approved by the Malaysian Treasury to the Department during JAIK is
administered jointly by 23 positions. Malaysian Treasury further approved an additional staffis by
29 positions according to the warrant office number 2/96 was in force at 01 October 1995 and
then increased again by 20 positions in the establishment warrant number 18 of 2000 with effect
from 1 May 2000. On 13 June 2003 a total of 49 additional positions were approved by warrant
designation number 7 of 2003 with effect from 1 November 2002.
Shariah Judiciary Department in Kedah responsible for managing, hear and decide the cases at all
the levels of the Shariah Subordinate Court, the Shariah High Court and Shariah Court of Appeal
in the management of Civil Cases, Crime and Faraid. The vision of this department is
Realization of the administrative management and judiciary that is complete and authoritative
according to Islamic Law and the provisions of law governing for Muslims.
According to the general principle of management by Henri Fayol state that, specialization of
labour is necessary for organizational success; so, every staffs at Syariah Judiciary Department in
Kedah has its own specialization. For instance, the chief must have specialization in syariah

judicial and civil judicial so that every cases can be completed correctly and accurately, assistant
administrative have qualification in degree of administration so that all aspect of administrative
will done well and wisely, chief registrar have expertise on shariah matters and also qualification
in jurisprudence of administration so that any kind of problem pertaining to registration of shariah
matters or cases can be solved correctly. All of this specialization relating to this department is
essential to overcome any problems occur. Although each of staff have its own specialization on
their designation, sometimes they give negative effects on work result because they just give
orders to another lower position workers to do their job which is the workers does not have any
expertise on that task given by them.
Moreover, this department practice bureaucratic management. One of the characteristics of
bureaucratic management theory of Max Weber which is formal guidelines for the behaviour of
workers while on the job and cover the rights and duties of the job holder. This means, everything
they do, whether in hall court or in administrative court procedure, everything must been
followed and enshrined in specific law. For instance, while managing the registration counter for
cases, assistant registrar must follow the Standard Of Procedure (SOP) of shariah court namely
Amalan Kehakiman. There is an issue that customer didn't get their draft orders on the date stated
because of the assistant registrar do not follow and obey the SOP. Those workers who are not
obey the SOP shall be punishable.
Despite of that, this department also practices management information system. As stated in the
theory of this management, this system capable of organizing data into usable and accessible
formats. Besides that, this system will ease in searching old data of department and clients. For
example, Department of Shariah Judiciary Kedah implement this system namely E-syariah to
organize their data of client, the status of decision made by chief, the process of pro-siding the
court and the date of judgement. This system is based on the commitment and discipline of
assistant registrar to update the all important data of each cases. Even though this system is
beneficial to the department, if the assistant registrar make easy on this job and not diligent to
update the data, it will bring negative impression onto the department.
Conclusion
In a nutshell, Department of Syariah Judiciary Kedah, practices administrative management,
bureaucratic management and management information system to ease their services and fulfill
customer requirements in a timely manner. However, there is positive and negative effects
practically on these managements perspectives. Generally, this situation made us think that

whatever we do, we must follow and obey the rules given by the organization so that it will bring
success into our life particularly into the organization.
