Re: Grant of Agencies to relatives of existing Agents / Medical Examiners
At present provisions for Recruitment, attachment and Detachment of agents and granting agencies to relatives of Agents/ Medical
Examiners are covered by the following Circulars:
1) Ref.: DD/13/63 dated 16th August, 1963.
2) Ref.: DD/ZD/16/68 dated 9th July, 1968.
3) Ref.: Dev/2/80-Dev/A/20 dated 24.4.1980
The various provisions as envisaged in the above mentioned Circulars has since been reviewed and the following revised instructions are
issued. For the purpose of easy understanding of the existing provisions as contained in the above Circulars and the corresponding
revised provisions in this regard are being enumerated below in a Tabular form:
Existing Provisions
1 Definition of Relations
A1 For the purpose of granting of agencies relationship to be
taken are Mother, Father, Husband, Wife, Brother, Sister,
Son, Daughter, Nephew, Niece, Immediate In-laws and First
Cousins (as per Circular Ref: DD/13/63 dated16.8.1963
and Ref. DD/ZD/16/68 dated 9.7.1968)
2(a) When a near relative of an agent working under a
Development Officer is recruited as an agent, then the new
agent should also be placed under the same Development
Officer. The new agent should not be placed under any
other Development Officer nor should he/ she be placed
direct.
However, this will not apply in case the agent is operating
from a place other than the HeadQuarters of the
Development Officer; but if it is felt that the new
appointment in a different place is with a likely motive of
diverting business then the Divisional Manager
may refuse to consider the appointment of the new place
2(b) If a near relative of a Direct Agent is recruited as an agent,
then that agent should not be placed under the organization
of any Development Officer but the agnency should be
treated as Direct only
3 Relatives and Employees of Medical Examiners should not
be appointed as agents in the same town where the Medical
Examiner is practicing. Any relaxation can be made only
after taking special sanction from the Zonal Manager to
whom Agency application and all related papers should be
submitted for decision. He may make such enquiries and
impose such conditions as he thinks necessary to ensure
that the agency will not be used as a personal agency of the
Medical Examiner. In any case, it should be made clear to
such agents that proposals introduced by them should not
be examined by the Medical Examiners to whome the agent
is related or under he is working.
4a If an agent attached to a Development Officer resigns and if
any near relative of the agent is recruited as an agent within
3 calendar years from the date of resignation of the old
agent then such agent should also be placed under the
organization of the Development Officer to whom the
original agent was attached
4(b) If a Direct agent resigns and if his near relative is to be
appointed as an agent within a period of 3 calendar yrs.
from the date of resignation of the Direct Agent then such
agent is to be treated as a Direct only and should not be
placed under any Development Officer.
Revised Provisions
Revised Definition of Relations
(i) Spouse;
(ii) Children or step children staying with
the existing agent or Medical Examiner;
(iii) Employees of existing Medical
Examiners staying with the Medical
Examiner;
(iv) Any other person related whether by
blood or by marriage staying with the
existing agent or Medical Examiner
2 (i) The agency will be granted under
the organization of the same
Development Officer if such relative
is staying with the existing agent.
(ii) The agency may be granted under the
organization of a different Development
Officer provided such relative is not
staying with the existing agent
(iii) Agency to spouse of existing agent
will necessarily be direct or under the
same Development Officer (as the
existing agent) whether the spouse is
staying with the existing agent or not.
(i) The agency will be granted as 'Direct
Agency' if such relative is staying with the
existing direct agent.
(ii) The agency may be granted under the
organization of a Development Officer
provided such relative is not staying with
the existing direct agent.
Agency to relatives and employees of
medical examiners may be granted under
the organisation of Development or direct,
as the case may be. However, the
competent Authority may make such
enquiries and impose such conditions as
he thinks necessary to ensure that the
agency will not be used as a personal
agency of the medical examiner. In any
case, it should be made clear to such
agents that proposals introduced by them
should not be examined by the Medical
Examiners to whom the agent is related or
under whom he is working.
In case an agent attached to
Development officer resigns /is
terminated, the spouse of relations of
agent staying with the agent will be
given agency under the same
Development Officer within a period of
3 calendar yrs. from the date of
resignation / termination of the agent.
If a direct agent resigns / is terminated the
spouse or relations of direct agent staying
with the direct agent will be given agency
as direct only within a period of three
calendar years from the date of
resignation/ termination of the direct
Agent.
The other conditions to be enforced are as follows:

1) The Designated Persons shall grant agencies to relatives of all exisiting agents and Medical Examiners only after approval by the Sr.
/Divisional Manager In-Charge of the Division.

2) Sr./ Divisional Manger In-Charge has to give permission in such cases after satisfying himself/herself that the agency is genuine and
not in substitution of the existing agency giving specific reasons and after obtaining the following documents:-
a) Certificate of residence from the prospective agent, existing agent and concerned Development Officer, if any.
b) Option letter from the applicant as to whether he/she want agency as 'Direct' or under a Development Officer in which case a letter
from the concerned Development Officer is also to be obtained.

3) Designated persons to ensure proper and safe custody of the above mentioned documents.

4) If at any point of time after grant of agency if the existing agent and his/her relative who has been granted agency start staying
together, the same should be brought to the notice of the Designated Person by both the agents. The Designated Person shall take
appropriate action of either making the agency direct or attach the agent under a Development Officer as the case may be from the date
of sharing of residence.

5) If at any time it is established that the change of residence of the existing agent or Medical Examiner or the applicant relative was done
for the purpose of obtaining agency, the said agency would be made direct or attached to a Development Officer as the case may be, ab
initio.

6) These rules will apply to all agencies given on or after the date of this Circular. Past cases / Complaints under investigation will be
dealt with as per old rules. No reference or representations will be entertained for past cases for allotment /re-attachement/ attachement
etc. under any circumstances.

This circular supercedes all the earlier instructions issued on the subject.
