AFFIDAVIT FILED UNDER SECTION 139 C.P.C.

I, Vennapusa Nagamma W/o Nagaiah, aged about 53 years, Srinagar
Colony 3rd Lane, Ongole, Prakasam District, do hereby solemnly affirm and
sincerely state as follows:I am the deponent herein and 2nd petitioner in the main O.P. The O.P. is
filed for compensation for the death of my Son, who died in a motor accident.
Later the matter was settled before the Lok-Adalat for an amount of
Rs.3,10,000/- towards full and final settlement on 23-03-2010. The 3 rd
respondent deposited an amount of Rs.3,10,000/- in to the Honble Court. The
Honble Court awarded an amount of Rs.1,55,000/- towards my share of
compensation as per Decree direction by this Honble Court. This Honble
Court permitted me to withdraw an amount of Rs.50,000/- only as per decree
direction and I withdrew the same and the remaining balance amount of
Rs.1,05,000/- and interest was kept in fixed deposit for a period of 3 years.
Again I filed a petition to withdraw my entire share of compensation balance
amount and this Honble Court permitted me to withdraw the same in
I.A.No.282/13, dt.04-03-13. The above said amount of Rs.1,21,888/- was lying
in C.C.D., and I am entitled to withdraw the same and there are no attachments
or stay on the said amount. I, under take that if the Honble Court directs me to
re-deposit the amount, I will deposit the same. I am herewith filing my Bank
Pass-Book.
Hence I pray that this Honble Court may be pleased to issue a cheque for
Rs.1,21,888/- (Rupees One lakh twenty one thousand eight hundred and eighty
eight Only) in favour of the Branch Manager, Andhra Bank,
N.K.R.M.Jr.College, Branch, Kurnool Road, Ongole, Prakasam District, and he
may be directed her to credit the same to the S.B.A/c No.118210100017061 of
the petitioner in the interests of justice.

DEPONENT
Solemnly affirmed and affixed her L.T.I. before me the contents of the affidavit
is read over and explained in Telugu to the deponent and admitted her to be
correct on this the day of April, 2013.
