any time, therefore, I did not mention the same in my complaint and
affidavit.IhavenotanymoneylendinglicenceandIhadgivenfriendly

Initially,IhadtakenacommercialloanfromICICIBankandgot
financed17commercialvehicles.Iwasregularlymakingpaymenttothe
ICICIBanktowardsmyloan.TataCapitalapproachedmeandofferedme
to grant a loan due to my good track record in ICICI Bank. Copy of
excellenttrackrecordandacopyofappreciationletterisEx.DW1/Aand
Ex.DW1/B.OfficerofTataCapitalgrantmeatotalsumofRs.2crore
aftervaluationofmy17trucks(almostRs.12lacseachtruck). Copyof
agreement is Ex. DW1/C (colly). I was regularly making payment of
installments through ECS and almost 4 or 5 installments I have paid
regularly.InJanuary,2013,duetosomeconflictwithARC,Iwasunable
tomakepaymentofinstallments.TataCapitalteamregularlyvisitedinmy
office as well as at my home to collect the EMIs. I shown them my
inabilityinmakingpaymentofEMIsandrequestthemtogivesometime
ortakehisallvehiclesback.Ifurtherrequestthemtotakeallvehiclesand
notdisturbmytrackrecordwiththebank.
The officer of Tata Capital Bank assured me that they will not
initiate any legal proceedings against me. I received an sms on 15th
February,2013,aboutbouncingofoneofmychequetakenbytheTata
Capitalatthetimeofgrantingofloan. Iimmediatelyapproachedtothe
officerofTataCapitalastheyhadassuredmethattheywillnotinitiateany
legal proceedings against me. Officer of the Tata Capital Ltd. From
PunjabiBaghapproachedmeandsuggestedmetogetthefinancefrom
Shri Ram Finance Co. Ltd. I along with officer of Tata Capital Ltd
approachedtoShriRamFinanceCo.andShriRamFinancewasreadyto
financemeasumofRs.2.29croreagainstmy17vehiclesafterrevaluation
ofmyabovesaidvehiclesinthemonthofAprilMay,2013.Butthedeal
wasnotcompletedduetoimmediatedemandfromTataCapitalLtd.Shri
Ram Co. was ready to finance me in installments but Tata Capital
demandedentireamountalmostRs.1.95croreinonego.Irequestthemto
takeinstallmentsaspermyconveniencebuttheydidnotpaidanyheedto
it.
Again,anofficerofTataCapitalnamelyVikaswithhisteamcame
fromMumbaiwithanewproposalthattheyhimselfrescheduletheloanif
Ishowsomeloadingsonmytruckfromanycompany.Then,Ialongwith
mysonapproachedtoBajajAutoLtd.Pune,Maharashtratogiveuschance
andutilizemyfleet.Onmyassurance,BajajAutoLtd,Punewasreadyto
giveusthecontractandtheysentusintimationbymaildated16.08.2013.
ThecopyofmailismarkD.IinformedaboutthistransactiontoVikasand
histeamandforwardedthesamemailtohim. Thedateofloadingand
openingwasdecided22.08.2013.
AssoonastheofficerofTataCapitalreceivedthemailheinsteadof
helping me started threating me and asked me to surrender the entire
vehiclesotherwiseIwillfacetheconsequenceofit. On22.08.2013,my
sonwaswaitingformeandwifeforopeninginPantNagarandherein
DelhitheteamofTataCapitalLtdweresetatmyhomeandsurroundedin
myofficetotakepossessionofmyalltrucksandcreatecriticalposition
andduetothismywifewassomuchdepressedanddisheartedandhadto
beadmittedinSarojHospitalnextdaymorningforherheartsurgery.Copy
ofmedicalcertificateismarkE.MysonreturnedbackfromPantNagar
afterloading45truckstolookafterhismother.TheofficerofTataCapital
followedmeinthehospitalalsoandbuildthepressuretosurrenderallthe
vehicles. I accordingly, surrendered almost all the vehicles during the
periodwhenmywifewasadmittedinthehospitalandundergoneaheart
surgery.

loanamount.AccusedDayaRamwasunabletopaythesame,therefore,
hetookblankchequefromtheaccusedDayaRam.AccusedDayaRamhas
made the payment and the said cheque has been misused by filing the
presentcomplaintaswellasanothercomplaintbyhissoninlaw.
