providers of websites publishing the Diebold email archive I understandthat my lawyers

2 submittedwith the injunction requestan attachedset of emailsthat they referredto as the "e-mail

3 archive" and representedthat thosedocumentswere the Diebold emails publishedon the SCDC

4 website.

s 3 The documentssubmittedto this court were a subsetof the entirearchiveof Diebold

6 emails publishedon the SCDC website. The entire e-mail archive, if printed out, would fill an
1 enrirebanker's box with paper. However.the entire archive is not materially different from the

8 subset presented to the Court. It is just mol"e e-mails among Diebold employees during the same

Q timeframe.
10 4. On the SCDC website, the entire Diebold email archive was available in a

1 downloadablecomputerarchiveformat known asa .tar file, andalsoin a searchableHlML format

12 on the web page. HTML is the computerlanguagein which manyweb pagesarewritten.

13 5. In responseto Diebold's cease-and-desist

letter to Swarthmore,the collegeblocked

14 accessto the SCDC-hostcdemail archivein both the downloadable.tar format and the searchable

IS HTML format.

16 6. Thus,sinceI am currentlypreventedfrom publishingthe entire archive,not just the

17 subset,I hopeto republishthe entire e-mail archive. Accordingly,I askthis court to grantrelief as

18 to -the entire archive.

19 I declareunder penalty of peljury under the laws of the Stateof Pennsylvaniathat the
