I, Luis M. Villaronga, Executive Secretary of the Board of Trustees of the

University of Puerto Rico, in the absence of the Secretary Rosa Amelia Franqui Rivera,

DO HEREBY CERTIFY THAT:

The Board of Trustees of the University of Puerto Rico, at its regular meeting of
20 February 2010, having considered the recommendation of the President of the
University of Puerto Rico, approved the following:

WHEREAS: The University of Puerto Rico (“the University”) holds in


usufruct the former Ramey Ammunition Storage depot, also
known as The Montaña Farm, that was ceded by the United
States Department of Education (“the Department”),
pursuant to Quitclaim Deed number SA-II PR-502 of
October 18, 1981 (“the 1981 Deed”), which imposed certain
restrictions of use on the land that are currently in force
(“the federal deed restrictions”).

WHEREAS: Included with the boundaries of The Montaña Farm is a


100-acre parcel of land, for which the University is
interested in securing the abrogation of the federal deed
restrictions and intends to request for their abrogation.

WHEREAS: The federal deed restrictions on the 100-acre parcel may be


abrogated by the Department upon request and payment by
the University of an abrogation fee of $41,801.76, that is
equal to 14 percent of the current appraised value of the
property.

THEREFORE: Be it resolved as follows:

1. The University of Puerto Rico hereby requests the


Department for the abrogation of all federal deed
restrictions over the 100-acre parcel of land located
within the boundaries of The Montaña Farm.

2. The University of Puerto Rico agrees to pay the


abrogation fee calculated in accordance with the
abrogation provision in the 1981 Deed that amounts to

$41,801.76, which is equal to 14 percent of the current


appraised value of the property.

3. The Interim Chancellor of the Mayagüez Campus of the


University of Puerto Rico is authorized and empowered
to act on behalf of the University of Puerto Rico to do
any and all things necessary to carry out the intent of
this resolution, including the authority to request for
abrogation of the federal deed restrictions over the 100-
acre parcel of land located within the boundaries of The
Montaña Farm; make any and all payments necessary to
secure abrogation, in the amount an abrogation fee of
$41,801.76, that is equal to 14 percent of the current
appraised value of the property; and sign and execute all
deeds, documents and instruments required to complete
this transaction.
