CERTIFICATE WORDING
This certificate wording serves to disclose the terms & conditions of
this Rental Excess Damage Takaful certificate underwritten by Hong
Leong MSIG Takaful Berhad (HLM TAKAFUL), with assistance
services provided by Mondial Assistance.
To understand this certificates significant features, benefits and risks, we
advise that you read the following:

YOUR CERTIFICATE AND CONTRIBUTION


You will be told the contribution payable for the certificate when you apply.
It is based on the length of your journey. The longer the journey, the
higher the contribution.
Your contribution also includes amounts that take into account our
obligation to pay any relevant compulsory government charges, taxes or
levies (e.g: Stamp Duty and Goods and Service Tax) in relation to your
certificate. These amounts are stated in your takaful certificate as part of
the total contribution.

ABOUT THIS CERTIFICATE WORDING

INTRODUCTION

This certificate wording sets out the cover provided and the terms,
conditions and exclusions which apply. You need to read it carefully
to make sure you understand it entirely and that it meets your needs.

ABOUT THE TAKAFUL COVER


Rental Excess Damage Takaful covers the excess or deductible that is
imposed on you following loss or damage to your vehicle due to an
automobile accident, fire or vandalized during the rental period. This
Takaful cover will only be valid on the condition that there is an existing
valid Vehicle hire insurance or takaful applying to the rental vehicle you
have hired.
This takaful does not cover losses relating to:

Any Miscellaneous charges imposed on you, including but not


limited to administrative charges, credit card transactional
charges

Any legal liability arising out of the use of the Motor vehicle

Permanent Resident of Malaysia is defined as a person who is allowed


to reside indefinitely within Malaysia and has been issued an entry permit
and an identification card.

WHO IS YOUR TAKAFUL OPERATOR?


This Rental Excess Damage Takaful certificate is underwritten by HLM
TAKAFUL. The takaful operator may be referred to as we, our and
us in this certificate wording.

BENEFIT LIMIT
Rental Excess Liabiilty

who rents Covered Vehicles from officially appointed Car rental


companies by Car Trawler Overseas. The Covered Person must be 21
years old and not more than 74 years old on the date the certificate was
issued.

This certificate wording, your takaful certificate, and any


endorsements written by us make up your contract with us. Please
retain these documents in a safe place.
Under this certificate wording, the maximum amount we will pay is
stated in the Benefit Limit.

WHO CAN PURCHASE THIS CERTIFICATE?

Mondial Assistance Services (Malaysia) Sdn Bhd is the agent for HLM
TAKAFUL to arrange the certificate and provide general advice and
services on our behalf.

YOUR DUTY OF DISCLOSURE


Before commencing this contract of takaful, you have a duty to disclose to
us the information we need to enable us to decide whether and on what
terms your proposal for takaful is acceptable. You have the duty to:

Disclose every matter that you know, or could reasonably be


expected to know.

Give us honest and complete answers.

Disclose any information that is relevant to our decision whether to


accept the risk of the takaful and if so, on what terms.
The same duties apply for certificate amendment, extension, and any
other endorsement.
This certificate will be void and automatically expire in the event of
misrepresentation, mis-description, non-disclosure or concealment of any
material circumstances, such as but not limited to your health conditions,
your country of residence, and your destination.

Coverage is available to :
(a) a Malaysia citizen or
(b) a Permanent Resident of Malaysia or
(c) a Malaysian Employment Pass Holder and/or Work Permit Holder

This Rental Excess Damage Takaful is underwritten by HLM TAKAFUL, with services provided by Mondial Assistance. .

YOUR PERIOD OF COVER

Your Coverage begins when you collect the rental vehicle


from the rental vehicle company.
Your Coverage ends when you return the rental vehicle to the
rental vehicle company or on the end date specified on your
Certificate of Takaful, or maximum rental period, whichever
comes first.

AREA OF COVER
Worldwide (excluding Afghanistan, Belarus, Cuba, the Democratic
Republic of Congo, Iran, Iraq, Liberia, Sudan or Syria or any other country
sanctioned by United Nations before the date of rental).

CERTIFICATE AMENDMENT
If you intend to amend your certificate details, you must let us or
Mondial Assistance know in writing before the collection of Your
Covered vehicle. Such amendment becomes effective after it has been
confirmed and recorded by us with issuance of a certificate
endorsement and corresponding contribution changes, if applicable.

CERTIFICATE CANCELLATION
If you decide that you do not want this certificate, you may cancel this
certificate, however any contributions that have been paid are completely
non refundable.

ASSISTANCE
Mondial Assistance is a worldwide travel assistance service company
whose subsidiary company is Mondial Assistance Services (Malaysia)
Sdn Bhd of Office Suite 19-17-1, Level 17 UOA Center, No 19 Jalan
Pinang, 50450 Kuala Lumpur and has been appointed to administer
all emergency assistance services of this takaful. You may contact
them in an emergency 24 hours a day, 7 days a week.

JURISDICTION AND CHOICE OF LAW


This takaful certificate document is subject to and interpreted in
accordance to the laws of Malaysia.

CERTIFICATE DEFINITIONS

for which services are delivered. A medical practitioner cannot be related


to you.
Miscellaneous charges means Credit card processing charge(s), fuel
charge(s), loss of rental utilization charge(s), handling fee(s), claims
processing fee(s) and all relevant and applicable taxes,
"Overseas" means any country outside of your country of residence.

Some words used in this Certificate Wording have special meaning. When
these words are used, they have the meaning defined below:
Accident/Accidental/Accidentally means a sudden, unexpected,
unintended and external event
Country of residence means the country in which you are granted
rights of citizenship or permanent residence by the government
authorities, or is a country where you resided more than 90 days in the
past year.
Damage means damage to the covered motor vehicle caused by fire,
vandalism, accident or theft occurring during your rental period.
Excess/Deposit means the amount stated in your rental agreement
that you are responsible for in the event of damage to the covered motor
vehicle. Less any applicable charges, including but not limited to
administrative charges, Miscellaneous charges
"Home" means the place where you normally reside in your country of
residence.
Covered vehicle means the vehicle owned by a licensed rental
company or agency, which you have agreed to hire from them according
to the terms of your rental agreement. The vehicle must:

Be no more than 10 years old;

Have no more than 9 seats

Not be driven off a public highway;

Not be a motor home, campervan, commercial vehicle,


minibus, motorcycle or moped.
"Medical practitioner" means a qualified doctor of medicine or dentist
registered in the place where you received the services/ treatment or who
is licensed and legally entitled to practice medicine in the applicable field

"Certificate holder" means the individual whom the certificate has been
issued to, as stated in the certificate of takaful.
Public highway means a main road or thoroughfare, such as a street,
boulevard or parkway available to the public for use for travel or
transportation.
Resident(s) of Malaysia means Malaysian citizens and permanent
residents (holders of re-entry permits) as well as holders of employment
passes, work permits, students' passes or dependants passes.
Rental period means the dates you have arranged to hire the covered
motor vehicle, as confirmed in your rental agreement.

You will only be covered if you are aged between 21 and 74


(inclusive) at the date your certificate was issued.

Any other trip which begins after you get back is not covered.

A trip which is booked to last longer than 31 days is not


covered.
"MYR" means Malaysian Ringgit, which is the currency in which claims
settlements are calculated.
Vehicle hire takaful/insurance means a valid motor takaful or
insurance applied to the rental vehicle you have hired. The motor takaful
or insurance must have a similar or larger validity period than this Rental
Excess Liability takaful.
"We", "Our" and "Us" means the takaful operator of your certificate,
Hong Leong MSIG Takaful Berhad, or its agent Mondial Assistance (Asia)
Pte Ltd.
"You" and "Your" means all covered persons under the certificate. You
must have a valid driving license to drive the vehicle in the travelling
country.

This Rental Excess Damage Takaful is underwritten by HLM TAKAFUL, with services provided by Mondial Assistance. .

"Wakalah" shall mean an arrangement appointing Us to manage the


overall services provided under the Certificate. We will take a portion of
the contribution as Wakalah Fee in return of the services rendered.
"Wakalah Fee" shall mean an upfront fee payable to the Operator in
return of the services rendered.
"Risk Fund" shall mean a pool of funds for the purposes of mutual
assistance, solidarity, brotherhood and for the mutual benefits of all
Participants. 100% of gross contribution paid by You, net of Wakalah Fee
shall be allocated to the relevant Risk Fund under Iltizam Bi Al Tabarru
concept. Within the Risk Fund, your tabarru shall be deemed to have
occurred upon any claim payment made in respect of fellow participants
and incurrence of reserves, Retakaful cost as well as other costs as
approved by our Shariah Committee with the remaining balance to be
managed according to the terms and conditions of this Certificate. The
Risk Fund shall be invested in Shariah-compliant instruments and the
Yearly Investment Profit earned on the Risk Fund shall remain in the Risk
Fund. Surplus arising from the Risk Fund, if any, is calculated annually at
the end of each of the takaful operators financial year. The said surplus
shall be inclusive of the investment profit from the Risk Fund.
"Iltizam Bi Al Tabarru" shall mean the commitment to make Tabarru.
"Tabarru" shall mean a certain proportion of the contributon that you
agree to donate upon the happening of activities or events endorsed by
the management and approved by our Shariah Committee, thus, enabling
you to fulfill your obligation of mutual help and joint guarantee should any
of your fellow participants suffer a defined loss. The Tabarru charge
determined as 100% of gross contribution, net of Wakalah Fee shall be
allocated to the relevant Risk Fund, by which Takaful events shall be
covered.
Contingency Reserve shall mean the reserves to be used in case of
adverse experience in Risk Fund. The percentage of which may be differ
for each Risk Fund;
"Jualah" shall mean a contract in which you agrees to reward us for our
achievement or good performance in managing the Risk Fund. After
taking into account the amount set aside for Contingency Reserve, 50%
of the balance surplus amount, if any, shall be given to us as performance
fee based on the Jualah contract. The remaining 50% of the balance

surplus shall be payable to the eligible Participant upon expiry or maturity


of their certificate following the Operators financial year end closing.
However, if the amount payable is RM10 or less, such amount shall be
donated to the Risk Fund instead. In the event of any claim made by you
during the coverage period, the remaining surplus amoint in respect of
you, if any, shall be donated to the Risk Fund.
Qardh shall mean an interest free loan. Our shareholders shall arrange,
if necessary, Qardh, in the event that any of the Risk Fund get into a
deficit situation towards solvency of the Risk Fund after using the
Contingency Reserves. The loan amount shall be repaid only on the
original amount disbursed from the future surplus arising from the Risk
Fund, in a lump sum or an installment basis depending on the emerging
future surplus and the amount of loan disbursed.

CERTIFICATE BENEFIT

We will reimburse you for any excess / deductible / deposit applied to your
Vehicle hire takaful for which you become legally liable to pay, up to the
Benefit Limit, if the covered vehicle is accidentally damaged, involved in
an accident or stolen, damaged by fire or vandalized during the rental
period.
The Rental car companys Vehicle Hire Takaful company must provide in
writing, formal acceptance of the claim from the Rental Car company for
said damage to the covered vehicle, before We become legally liable for
any claims submitted by you to Us.

Misfuelling
General wear and tear, gradual deterioration, damage from insects
or vermin, inherent vice or damage
9) If you are aged 20 and below, or 75 and above on the date your
certificate was issued.
10) Where your claim is not a valid Vehicle hire takaful claim, regardless
of the amount.
11) Relating to losses resulting from damage to: Windscreens, tyres and
undercarriage, unless admitted and payable as a valid claim under
the Rental Vehicles Motor Takaful or Insurance certificate.

You must check General Exclusions for other reasons why


we will not pay.

EXCLUSIONS AND LIMITATIONS


We will not pay under any circumstances if:

We will not pay for losses:


1) Where you have not followed the terms of your rental agreement
2) Arising from the operation of the Rental Vehicle in violation of the
terms of the rental or takaful agreement
3) Where the claim with your car hire firm has been declined
4) Where you dont have a valid driving license to drive the vehicle in
the travelling country.

Any events prohibited by Shariah principles.


You do not act in a responsible way to protect yourself and
your property and to avoid making a claim.
You do not do everything you can to reduce your loss as much
as possible.
Your claim is for consequential loss of any kind, including loss
of enjoyment.
At the time of purchasing the certificate, you were aware of
something that would give rise to you making a claim under
this certificate.
Your claim arises because you act illegally or break any
government prohibition or regulation including visa
requirements.
Your claim arises from a government authority confiscating,
detaining or destroying anything.
Your claim arises from any act of war, whether war is declared
or not or from any rebellion, revolution, insurrection or taking of
power by the military
Your claim arises from a nuclear reaction or contamination
from nuclear weapons or radioactivity.

10. Your claim arises from biological and/or chemical material,


substance, compound or the like used directly or indirectly for
the purpose to harm or to destroy human life and/or create
public fear.
11. Your claim arises directly or indirectly from an act of terrorism.
12. Your claim arises from, or is in anyway related to depression,
anxiety, stress, mental or nervous conditions.
13. Your claim arises from suicide or attempted suicide.
14. You were under the influence of any intoxicating liquor or drugs
at the time the loss occurred, except a drug prescribed to you
by a Medical Practitioner, and taken in accordance with their
instructions.
15. Your claim arises from motor sports of any kind.
16. Your claim arises from any Epidemic or Pandemic
17. Your claim arises from an automobile accident that occurred in
Malaysia.
18. You do not follow any suggestions or recommendations made
by any government or other official authority including the
Ministry of Foreign affairs during the period of takaful.
19. Your claim arises from any currency exchange rate changes.
20. Your claim arises from the failure of fear or inability of any
equipment or any computer program, whether or not you own
it, to recognise or to correctly interpret or process any date as
the true or correct date, or to continue to function correctly
beyond that date.
21. Your age is 20 and below, or 75 and above at the date your
certificate was issued.
22. You do not have a valid driving license in the travelling country
where you rent the vehicle.
23. You do not contact us as soon as possible with full details of
anything that may result in a claim and give us all the
information we ask for.
24. Your claim is not a valid Vehicle hire takaful claim.
25. You can recover your losses or additional expenses from any
other party.
26. Claim arises from third party for bodily injury and property
damage.

CLAIMS
Mondial Assistance is authorized by HLM TAKAFUL to also provide
claims handling services as our agent, not as your agent. Mondial
Assistance acts under an agreement with the takaful operator which
means that Mondial Assistance can handle the claims and refer to the
Takaful Operator for decision on validity/payment of claims and is
jointly referred to as we, our and us in this certificate wording for
this purpose only.

REASONABLE PRECAUTIONS
You must do everything reasonably possible to prevent a loss from
occurring, or when a loss has occurred, ensure that the loss is minimised.
If you do not, we can reduce your claim by the amount of prejudice we
have suffered, or reject your entire claim.

You should fill in the form and send it to us as soon as possible with all
the information and documents we ask for. It is essential that you provide
us with as much detail as possible to enable us to handle your claim
quickly. Please keep photocopies of all information you send us.
You will need to obtain some information of your claim while you are
away. Below is a list of the documents we will need in order to deal with
your claim.
For all claims

Your original certificate schedule, rental agreement and travel


documents showing the dates and times of travel.

Original receipts and accounts for any Excess You have to pay
together with all correspondences with the car rental company
in this regard

Details of any other insurance or takaful You may have that


may cover the same loss.
The official claim form submitted by your Rental Car company,
claiming against damages to the Covered Vehicle
The official notice/memo of acceptance of the claim from the
Rental Cars Takaful Company, stating the amount the Takaful
Company has agreed to indemnify the Rental Car Company
for.
As much evidence as possible to support Your claim (including
photographs and video evidence if this applies).
A copy of the driving license of the person driving the Covered
vehicle at the time of the accident.

Accidental damage Excess/Deposit Reimbursement

Detailed account of the circumstances surrounding the event


including photographs and video evidence (if this applies).

Full details of any witnesses, providing written statements


where available.

Detailed account of the circumstances that led to the


accident/damage to the Covered vehicle, including where
appropriate a written police report.

EXCLUSIONS
When we wont pay a claim as set out in the We will not pay under each
section and in General exclusions applicable to all sections these
restrict coverage and benefits.

CLAIMS PROCESSING
We endeavour to process your claim within 10 working days of us
receiving a completed claim form and all necessary documentation. If we
need additional information, a written request will be sent to you within 10
working days.

YOU MUST NOT ADMIT FAULT OR LIABILITY


In relation to any claim under this certificate you must not admit that you
are at fault, and you must not offer or promise to pay any money, or
become involved in litigation, without our approval.

CLAIMS ARE PAYABLE IN MALAYSIA RINGGIT TO YOU


We will pay all claims in Malaysian Ringgit. The currency exchange rate
that applies is determined by the date that you incurred the cost, or the
noted billing date on the documentation.

FRAUD
If you or anyone acting on your behalf uses dishonest means to obtain a
claim payment under the certificate for which you do not qualify, we will
not pay the benefit and we will cancel the certificate. Any benefit claimed
fraudulently and received must be paid back to us. We will report any acts
of fraud to the local police authority.

RECOVERIES
If we have a claim against someone in relation to the money we have to
pay under this certificate, you must do everything you can to help us do
that in legal proceedings. If you are aware of any third party that you or
we may recover money from, you must inform us of such third party.
If you intend to commence legal proceedings to recover your costs or
seek compensation against a third party, you must inform us as soon as
possible.
We will apply any money we recover from someone else under a right of
subrogation in the following order:
1. To us, our administration and legal costs arising from the recovery.
2. To us, an amount equal to the amount that we paid to you under the
certificate.
3. To you, your uncovered loss (less your excess).
4. To you, your excess.

We may seek reimbursement from you if you receive a payment from any
other source for any amount of the claim we paid you.

SUBROGATION
At our discretion, we may start, control and settle legal proceedings for
our own benefit in your name to recover compensation or secure
indemnity from any party in respect of anything covered by this certificate.
We may do so in your name and on your behalf. You also consent to us
seeking to recover any money we have paid to you from a third party.
You must help us to do this, even if we have not yet paid your claim, and
even if the amount we pay is less than full compensation for your loss.

OTHER TAKAFUL
No person shall be covered under more than one takaful certificate issued
by us. In the event the Covered Person is covered under more than one
such certificate, we shall consider that person to be covered under the
certificate, which provides the greatest amount of benefit. If at the time of
any loss, damage, or liability arising under the certificate there is any
other takaful provided by another company covering the same loss,
damage or liability, we will only pay our proportion.

PHONE CHARGES
For local calls made to our General Enquiries hotline or our Claims
hotline, we may or may not provide you with a toll-free number. In any
case we will not be responsible for any charges incurred by you, when
you are contacting us.

INTERPRETATION
Once we pay your total loss we will keep all money left over.
If we have paid your claim and you receive a payment from someone else
for that loss or damage, you must pay us the amount of that payment up
to the amount of the claim we paid you.
If we pay you for permanently lost, stolen or damaged property and you
later recover the property or it is replaced by a third party, you must pay
us the amount of the claim we paid you.
If we pay your claim and you receive a payment from someone else for
the same costs, fees or expenses, you must pay us the amount of that
payment up to the amount of the claim we paid you.

This certificate, certificate and the schedule shall be read together and
any word or expression to which a specific meaning has been attached in
any part of this certificate, certificate or schedule shall bear such meaning
wherever it may appear.

CUSTOMER SATISFACTION
Should you have a complaint arising out of this takaful or our employees,
authorised representatives or service providers, please contact us. We
will respond to your complaint within 5 business days, provided we
receive all necessary information and we have completed any
investigation required. If we need more time, we will agree on a
reasonable alternative time frame.

ARBITRATION
If we admit liability for a claim but there is a dispute as to the amount to be
paid, the dispute will be referred to an arbitrator. The arbitrator will be
appointed jointly by you and us in accordance with the law at the time.
You may not take legal action against us over the dispute before the
arbitrator has reached a decision.

PROCEDURE FOR COMPLAINT TO CSB


You may write to the Mediator, Takaful Division of FMB, giving details of
the dispute, the name of the Takaful Company and the certificate number
or claim number. Copies of the correspondence between you and the
Takaful Company may be sent to facilitate tracing the case file kept by the

CLERICAL ERROR
A clerical error by Mondial Assistance shall not invalidate a takaful which
is otherwise validly in force, nor would it continue takaful otherwise not
validly in force.
