OVERVIEW
Shaun Francis, a Democrat running for the 43rd New York State Senate District, lodged a formal written
complaint with the New York State Board of Elections Chief Enforcement Counsel, Risa S. Sugarman. In the
complaint, Francis asked Sugarman to use the powers of her office to launch an investigation into the
giving and receiving relationship between current New York State Senator Kathleen Marchione (RHalfmoon) and Mr. Bruce Tanski, a well-known Halfmoon Real Estate Developer and builder. [Copies of the
complaint letter and Ms. Sugarmans response are attached to this summary.]
BACKGROUND
In July, Ms. Sugarman filed a lawsuit against a failed Assembly candidate, arguing that contributions made
to the campaign through the so-called LLC Loophole were illegal because the underlying donor was
using the LLCs simply as subterfuge to mask the true identity of where the money was coming from, and to
give to the campaign well above and beyond normal contribution limits. The case was settled out of
court.1
COMPLAINT SUMMARY
In his complaint letter to Sugarman Francis writes, It is my belief that the Friends of Kathy Marchione
Committeeknowingly accepted contributions in excess of individual campaign finance contribution limits
from Bruce Tanski who made contributions other than under his direct true name in violation of Section 14120 of the New York State Election Law, with the penalty for such violation laid out in Section 14-126(2).
The complaint letter to Sugarman lays out the history of the cash flow from Tanski to Marchione, and points
out that many of the contributions from Tanskis LLCs have come on the exact same day. It also shows
dozens of in-kind contributions from Tanskis businesses to the campaign in addition to the cash
contributions that were made. These in-kind contributions include what appears to be free fuel from

Tanskis Halfmoon Sunoco station for Marchiones vehicle as well as a golf cart given to the campaign from
Tanskis Fairways of Halfmoon Golf Course. Dozens of in-kind contributions from Tanskis LLCs listed cash
amounts, but gave no description of what the in-kind contribution was for.
In total, Francis letter to Sugarman shows a total of $171,476,25 of cash and in-kind contributions from Mr.
Tanski to Marchione since 2012.
Despite the 1996 decision that created the so-called LLC Loophole there still remains Section 14-120 of
the New York State Election Law that requires all contributions be made in the true name of the contributor.
Bruce Tanski was charged with, and he pled guilty to violating this law in the past, when he is alleged to
have given his own personal cash to other individuals in order to make political campaign contributions on
his behalf thereby allowing him to give above normal campaign contribution limits. Tanski was sentenced
to three years probation, 200 hours of community service, and a $1,000 fine.2
SHAUN FRANCIS STATEMENT
Senator Marchiones relationship with Mr. Tanksi deserves a long hard look because this appears to be a
willful, deliberate, and intentional disregard for our election laws here in New York. We must shine as much
light as possible on how Albany politicians and their benefactors are attempting to use this LLC loophole to
circumvent contribution limits. Voters are tired of corrupt politicians in Albany and I will make reforming our
broken campaign finance system one of my top priorities in the Senate. Albany is a mess and it needs to
be cleaned up.

When asked about the multiple contributions by the media, Mr. Tanski said, Nobody tells
Bruce Tanski what to contribute, where to contribute and how to contribute. (Campaign

Given these facts, and in light of your recent lawsuit relating to this issue, I respectfully request that
your office launch an investigation in order to answer the following questions:
1. Did the contributions from Mr. Tanskis LLCs to the Marchione Committee come out of
and remain debits from those LLCs operating budgets?
2. Did Mr. Tanski cover the costs of the contributions from the LLCs with personal
money either before or after the contributions were made?
3. Was Senator Marchione aware, or should she have been aware, that the LLCs
contributions were ultimately coming from the same individual and not in the true
name of the contributor?
4. Did Bruce Tanski sign all or some of the checks from the LLCs personally?
It is clearly not proper if contributions from the LLCs were at any time covered with transfers of
money from a person or entity. There is no way that the general public can find out if this is
happening when dealing with private corporations (LLCs). Therefore, this can only be discovered as
a result of a subpoena and an investigation by your office. Clearly, when you look at Mr. Tanskis
past violations of campaign finance laws, as well as his public statements about campaign finance
laws, and the multiple occasions where contributions were made to the same candidate on the same
date, you see there is enough probable cause to launch an investigation.
Time is of the essence in this case. If the past giving-receiving relationship between Mr. Tanski and
Senator Marchione is not in line with NY State Election Law, it is in the public interest that you do
what can be done right now to correct the situation before that money can be used to influence the
upcoming 2016 elections.
