PageS of b& On January 26, 2010 | was assisting Detective Smith on a burglary investigation that occurred at the SAE fraternity house located at 814 E, 14”. At 1226 hours we contacted Vilantorno in his room [INANE | asked lantorno if he was in the SAE house when the burglary occurred. lantorno stated that at approximately 0005 hours he left his room with jack Porter to get some food in the campus area. lantorno stated that he and Porter retumed to the house at approximately 0035 hours and remained on the first floor. lantorno stated that he was unaware that his room was burglarized until V/ Wolfard told other housemates about his room being burglarized. Detective Smith took photographs of V/lantorno's room and the desk area where his laptop computer was taken. Detective Smith seized a USB ceinputer cord and a telephone cord from the desk and submitted them to the lab,for processing. lantorno provided Detective Smith with a set of his victinylimination prints which were submitted to the lab. Fakhimi stated that he received the message one or two days after the burglary but forgot to mention it when he was interviewed. Fakhimi e-mailed the Facebook message to me and the contents are as follows: “this is fucked up bruh im not trying to get anybody in trouble im just letting yall know so when i get interviewed i gotta tell them everything ok that is know way shape or form a threat im just trying you let you know as frjend same goes for the rest of you that i know” oe x At 1700 hours | contacted Taylor Lilley and Micaela Cocke’ at MacArthur Court, 1601 University. | asked Lilley and Cocks if they were at Reylor's bar on January 23, 2010. Both Lilley and Cocks advised they were at Taylor's bar that night because they played Stanford earlier in the day. | asked Lilley and Gocks if they observed Jeremiah Masoli inside Taylor's bar, Both Lilley and Cocks st@téd that they did not see Masoli in the bar. , | asked Lilley and Cooks if they recalled that time they left Taylor's bar. DD/ Ganser's timeline of events dated January 24, 2010 On February 10, 2010 | contacted William Ganser on the telephone. Ganser had left a voicemail indicating that he had information about the burglary that occurred at the SAE fraternity house on January 24, 2010. | asked Ganser what information he wanted to provide. Ganser stated that on January 24, 2010 he was alone walking northeast on Alder Street near 15" avenue. Ganser Stated that he walked into the adjacent U of O parking lot thatislocated just north of the SAE fraternity house. Ganser stated he noticed a.Eugene pplice car with its lights flashing near 14" Avenue and Kincaid Street. Ganser ted the time to be between 0030 hours and 0100 hours. | asked Ganser if the tie Suid have been closer to 0100 hours and he replied, "Yes." a Ganser stated that he proceeded to walk in the: efSiking lot east towards Kincaid Street and then North towards Taylor's bar. Gangé:stated that has he approached the U of O parking lot's east entrance he observed i jor Lilley and Micaela Cocks (U of O women's basketball players) walking solith towards him. Ganser stated as he continued walking to the north he obsérved Jeremiah Masoli and two other males walking south approximately 20 30 feet behind Lilley and Cocks. Ganser stated one of the males was a Pacific 'siag F and was unsure of the other male. Ganser stated it appeared as if Masoli and se other two males were attempting to catch up to Lilley and Cocks. 3 Ganser stated he protSedea north towards Taylor's bar where he entered the bar and met up with other Law students. Ganser stated that he ordered a drink and within 5 to 10 minutes he observed Masoli back inside Taylor's bar. Ganser stated that he observed Masoli with another football player, Willie Glasper. Ganser stated that he never observed Masoli drink any alcohol, and that Masoli was standing near the shuffle board table the entire time that he (Ganser) was at Taylor's bar. Ganser stated that he ‘stayed at Taylor's bar until closing and believes that Masoli stayed until closing as well. Ganser stated that he wrote a timeline on the moming of January 24, 2010 after hearing about the burglary. Ganser emailed me the timeline which | have attached to this report. MARTY, 297 “Approved By: Investigations, PROEPRTY CRIMES Vor re pre B0F 3 Jan. 24,2010 Between 12:30-1:00 a.m., I was walking Northeast on Alder and 15" Ave when I crossed Alder and walked into the adjacent UO parking lot. As I was walking, I noticed a police officer had stopped on 14” Ave. facing West near Kincaid and had his/her lights flashing, but had tured them off soon after I entered the parking lot. As I continued walking, I also noticed a ‘campus security Grand Royal car enter the parking lot that I was traversing. I believe I was quite visible to the campus security officer as we passed. Soon after the campus security officer had passed me and rounded the lot, I got about 50 feet from the Kincaid driveway entrance/exit on the North side of the bus stop when I noticed UO Women’s Basketball Players Taylor Lilley and Micaela Cocks walking towards me from the direction of Taylor’s Bar, Southwest into the UO parking lot, as if to leave and go home. 1 also noticed that Ms. Lilley was walking with a bit of a imp, favoring one foot, and I recognized Ms. Cocks’s New Zealand accent as we passed. Soon after, about 20-30’ behind Ms. Lilley and Ms, Cocks and going in direction, were Jeremiah Masoli, and two other people walking together in a triangle formation. I noticed that one of the people walking with Mr. Masoli was Pacific Islandeffand he looked similar to Mr. Masoli, but I didn't recognize him. From my recollectiongft. Masoli was wearing a dark jacket/sweatshist, with a large white shirt undemeath thgitRung lower than the jacket he was ‘wearing, and the Pacific Islander that was with Mr, Nfasoli was wearing a light grey or white long-sleeve jacket or sweatshirt. I didn’t happep{@'See what the thd individual looked like, other than he was male, I continued on, and [ghOught thatthe group of three men may be attempting to catch up to Ms. Lilley and Mg¥Cocks before the two ‘women departed finally. After passing the group of met rounded to the front of Taylor’s and entered immediately where I met with othePlaw students, Soon after [had entered - only about the time it took to order a drink - I notiged that Masoli was back inside of Taylor’s. 1 would estimate that Thad seen him twice, outside'and then inside Taylors, within 5-10 minutes of each other, around 12:30 1:00 a.m... Therelifer, I pointed out to several people with whom I was socializing of the fact that Mr. Masoli was at Taylor’s. 1 also noticed that Mr, Masoli did not appear to be drinking alcohol, and that he seemed to be accompanied by Willie Glasper. I can’t say that I saw either of the people that Ihad seen previously outside with Mr. Masoli inside of Taylors, however. Ables stated that she wanted to apologize for being rude and ignoring my attempts to contact her. Ables stated that she wanted to meet with me in “private” to discuss her activities on January 23-24, 2010. Ables agreed to meet me at City Hall at 1600 hours and advised she ‘would contact Olivia Westmoreland to see if she was available to come to City Hall at the same time. : At 1600 hours | met Ables on the east steps of City Hall. A few minutes later, Westmoreland arrived. | escorted Ables and Westmoreland inside City Hall and asked Westmoreland to wait in the lobby area while | interviewed Ables. | escorted Ables into the interview where | was joined by Detective Grimes. | asked Ables if she was at the SAE ‘Live Out" party, a. January 23, 2010. Ables stated that she was af the party and.arrived at 2300 hours. Ables stated that she arrived at the same time as Blake Ferras, Alexander Rosenberg and Garrett Embry. Abies stated that she recalled a confrontation at the party that involved Brandon TAD. Ables stated that either Embry or Rosenberg talked with other SAE members and Embry and Ferras were allowed back into the party. Ables stated that at approximately midnight Anthony Nuccio invited her, Westmoreland, and Nicolas Corpora over to his room at the SAE fraternity house located at 812 E. 14", Ables stated that the four of the walked over to the SAE fraternity house and when they arrived she observed Ferras pulling up to the SAE house in his truck. Abies stated that she observed Ferras, Rosenberg and Embry exit Ferras’ truck and walk up to the front door. a | asked Abies if she recalled who entered the door code to, alr everyone into the house. Ables stated that it was either Cory Massei or Sayan Sakhimi. Ables stated that once inside the SAE house they preceded to Nucgio’s room. Ables stated there were approximately 10 people in the room and she rééalled seeing, Nuccio, Embry, Rosenberg, Ferras, Massei, Westmoreland and Gorpora inside the room. Ables stated that the group drank rum listened to music andsiwatched You Tube videos. | asked Ables if she observed Ferras drinking any algohol. Ables stated that Ferras was the designated driver and that he was not drigking. | asked Ables if she ever dated Embry” Ables stated that she dated Embry for 5 months in 2009 and the relationship ended'in August of 2009. Ables stated that she and Embry remained friends and that they.88¥y in contact. | asked Ables if she observed Embry leave Nuccio's room alone. Ables stated that a little before 0100 hours.Embry left the room by himself and indicated he was going to a party near 17” and Patterson. | asked Ables if it was possible that Embry left Nuccio’s foom earlier then the time she indicated. Ables stated that she was certain that Embry. left the room near 0100 hours. Ables stated that she and Westmoreland were getting ready to leave Nuccio’s room when an SAE member opened the door and informed everyone of the burglary. Ables recalled everyone exiting Nuccio’s room and over hearing other SAE members saying that Embry and Jeremiah Masoli as being involved in the burglary. l asked Ables if she observed Masoli at either the SAE “Live Out” party or at the SAE fraternity house. Ables replied, "No. I never saw him.” | asked Abies if she has spoken with Embry since January 24, 2010. Ables stated that she called Embry about 20 minutes after being told about the burglary. Westmoreland stated that Corpora was her roommate and provided me with his celyphone number. | asked Westmoreland i she recalled seeing Embry in NifSo's room. Westmoreland stated that she did see Embry and that there were "1)‘pllis people” in the room. | asked Westmoreland if she recalled seeing Embry leave Nicio's room alone. Westmoreland ‘stated that she recalled seeing Embry leave along approximately 30 minute prior to her and Ables leaving. oS & ‘Westmoreland indicated that she was vegrintoxicated that night and could not recall too many details. Corpora stated that at midnight he walked over to the SAE fratemity house, 812 €. 14", with Nuccio, Ables and Westmoreland. Corpora stated that the 4 of them went into Nuccio's room and they listened to music, drank alcohol and watched You Tube videos. | asked Corpora if he recalled seeing Embry, Ferras and Rosenberg in Nuccio’s room. Corpora stated that there were a bunch of people in the room, but recalled seeing Embry, Ferras and Rosenberg inside Nuccio's room. | asked Corpora if he recalled seeing Embry leave Nuccio’s room by himself. Corpora stated that he left Nuccio’s room to use the restroom and when he returned either Embry, Ferras or Rosenberg was gone. Rosenberg replied, “I've been busy.” informed Rosenberg that we were following up.on a burglary at the SAE house that occurred on January 24, 2010. | asked Rosenberg if he was at the SAE house on the night of the burglary. Rosenberg stated that he, Garrett Embry and Blake Ferras drove over to the "Live Out’ party, Ferras' truck. Rosenberg stated that they were invited to the party by Anthony Nuccio and arrived around 11 PM. Rosenberg stated that when they arrived at the front door, the three of them were allowed into the house by either Cory Massei or Shayan Sakhimi. Rosenberg stated he was Unsure who actually entered the door code to unlock the front door. Rosenberg stated the three of them went into Nuccio's room where they listened to music and talked. Rosenberg stated there were a bunch of people in the room and he recalled people drinking hard alcohol, Rosenberg stated that at some point Embry left Nuccio's room and said he was going to another party. Rosenberg stated at approximately 0030 hourghe received a telephone call from Embry asking him and Ferras to pick him up nearg2" and Patterson, Rosenberg stated that he and Ferras drove over in Ferrag truck and picked him up. Rosenberg stated that when they picked him up Embgiention that another football player had been assaulted and they drove over to end Hospital. af | asked Rosenberg if Madison Ables or Blake Féiras was at the residence. Ables further stated that her grandfather was a “JudgéVand he instructed her to do the same. | informed Ables that she could tell the Granja’ Jury about her involvement at the SAE house and served her with a Grand cur aupoena. | informed Ables that | noticed Ferras’ truck parked in the driveway and askéd her to have him come to the door, At 1623 hours Blake Ferras came to the door. | explained to Ferras as to why we were there and asked if he had a few minutes to talk with us. Ferras agreed. | asked Ferras ifhe was at the SAE “Live Out” party on January 23, 2010. Ferras stated that he was the "DD" (designated driver) and that he drove Rosenberg and Embry to the party sometime after 10PM. | asked Ferras if there was some kind of altercation while at the Party. Ferras stated he was asked to leave the party by Brandon Bucich, Ferras stated he was unsure as to why he was asked to leave and recalled Bucich pushing Embry. Ferras stated that Embry talked with some of the SAE members and the three of them were allowed back into the party. | asked Ferras if he drove Rosenberg and Embry over to the SAE fraternity house, 812 E. 14".
