RULES, 1974.

PART-1 GENERAL
Short title, application and commencement
1-

(1) These rules may be called the Punjab Civil


Ser vants
(Appointment
and
Conditions
of
Ser vice) Rules, 1974.
(2)

They shall come into force at once.

(3)

They shall apply to all civil ser vants.

Defi nitions:

Appointing authority in relation to a post


means the person authorized under rule 6 to
make appointment to the post;
Autonomous
or
semi-autonomou s
organization set up under a law by the
Government as a unit separate from the
formal departmental organization:
Board means a Selection Board and
includes a Provincial Selection Board;
Commission means the Punjab Public
Ser vice commission;
Committee
means
Promotion Committee
Committee;

Functional Unit means a group of posts


or a part of such group sanctioned as a
separate unit in or under a Department;

Surplus Pool

Where due to reorganization of a department,


offi ce or autonomous body. certain posts are
abolished, and certain persons are rendered
surplus, such persons shall be placed in
surplus pool of S&GAD.

Absorption
The persons in surplus pool shall be absorbed
against suitable posts as initial recruitment
on the recommendations of commission or DSC
such absorption may be against equivalent post
or lower post.
however the pay last drawn by such employee
shall be protected.
4- (1) The Government may constitute Selection
Committees for initial recruitment
and Departmental
promotion.

constituted by Government.
(3) The Provincial Selection Board shall make
selection for appointment:-

By promotion and transfer to posts in BS-19


and above
and for posts in BS-18 included in the
schedule IV of the Punjab Government
Rules of Business, 1974;
By initial recruitment to such posts in BS16 and above as may be specifi ed to be
fi lled without reference to the Commission;
4- Where an appointing authority other than
the Chief Minister

does not accept the recommendation of a


committee or a board,

it shall record reasons thereof

and obtain orders of next higher authority


and act accordingly.
5- The
authorities
competent
to
make
appointment to various posts shall be as follows:

Probation
i-

By initial recruitment
period of probation shall be initially for two years
extendable for a further period of two years.

ii-

By promotion or transfer
period of probation shall be for one year and
extendable for further period of two years.
Officiating service and service on deputation shall
count towards period of probation.
Extra ordinary leave (leave without pay) during
period of probation and seniority
Due to extra ordinary leave during period of
probation of two
years, the name of probationer
shall be removed from seniority list and placed on a

static list with no claim to promotion, seniority and


confirmation for the period he remained on E.O.L.
(Leave without pay).
A civil servant shall be deemed to have been
confirmed from the date on which period of
probation was last extended subject to availability
of permanent post.

Seniority
a-

Seniority of direct recruits.


Shall be determined as under:
Selelectees of earlier bath shall be senior to
selectees of later batch.
Seniority of selectees in one batch shall be
determined in the order of merit assigned by
selection authority.

b-

Seniority of promotees
Shall be determined as under:
The seniority as in lower post shall be maintained
on promotion
provided the senior is not superseded and no
junior to him is promoted in preference to him.

c-

Seniority of direct recruits and promotees


Shall be determined as under:
From
the
date
of
continuous
appointment/ promotion to the post.

In case a batch of persons is selected by initial


recruitment at one time the earliest date of
assumption of charge by any member of the
group
shall be taken to be date of appointment of
whole group. Similarly in case of promotion the
earliest date of assumption of charge by any

member of such group shall be taken to be date


of promotion of the whole batch of promotee.
seniority shall be determined from the date of
continuous regular appointment/promotion as a
batch.
Extraordinary leave (leave without pay beyond
five years and seniority.
If extra ordinary leave is granted to a civil
servant beyond five years;
or deputation period exceeds;
or contract appointment of a civil servant
exceeds five years;
The name of such civil servant shall be placed
on a static seniority list with no claim to
promotion or seniority over any junior who may
be promoted during such period.
The name of such civil servant shall be brought
back on active seniority list only if he assumes
duty on return from such EOL or deputation or
contract appointment.
His seniority shall be determined after
deducting such period exceeding five years. If
he is promoted he would not regain his seniority.
Part-II appointment by promotion, transfer or
deputation
9.
Appointments by promotions or transfer to posts in
various grades shall be made on the recommendations
of the appropriate committee or board.
10. Only such persons as possess the qualifications
and meet the conditions laid down for the purpose of
promotion or transfer to a post shall be considered by
the Selection Authority.
10-A. Appointment on acting charge basis..
Shall be made as under:

i-

Post reserved for promotion


The appointing authority may fill a post
by appointing on acting charge basis, the senior
most civil servant;
who possesses at least three fourth of the
prescribed length of service or the experience
for the post or both, as the case may be;
and is otherwise eligible for promotion except for
the prescribed length of service and the
experience.

ii-

Post reserved for initial recruitment


Where the appointing authority is satisfied on
report of the selecting authority that no suitable
officer is available to fill a post in a grade 17
and above;
it is expedient not to allow the post to remain
unfilled;
it may appoint to that post on acting charge
basis the senior most officer eligible for
promotion to that post.
The post is likely to remain vacant for period of
six months or more.
On recommendations of the Departmental
Promotion Committee or the Provincial Selection
Board
but such appointment shall not be deemed to
have been made on regular basis for any
purpose

10-B Appointment on current charge basis

Shall be made as under:


Where a post is likely to remain vacant for a
period of less than one year
and the appointing authority does not consider
it expedient to make an appointment on ad hoc
basis,
it may appoint the senior most civil servant,
who in the opinion of the appointing authority,
is eligible and suitable for promotion.
An appointment made on current charge basis
shall come to an end on appointment of a
person on regular basis
or on the expiry of one year,
whichever is earlier.
Appointment by transfer
11- Shall be made as under:

If transfer is prescribed in the relevant service


rules as method of appointment to such post.

if the person holds an appointment on regular


basis in the same basic scale and rank as that of
the post to which appointment by transfer is
proposed to be made
provided he possesses the qualifications prescribed
for initial recruitment to such posts; or
(ii)
From amongst persons holding appointments
in Federal Government and other provinces of Pakistan

if the person fulfills conditions of appointment to


the post to which he is transferred.

12- No appointment or promotion can be made against


a post which is not covered under service rules.
13- Appointment by promotion on officiating basis.

(i)

Where a post falls vacant as a result of

deputation,
posting outside cadre,
leave,
suspension
or appointment on acting charge basis of the
incumbent
or is reserved under the rules to be filed by
transfer, if none is available for transfer,
the appointing authority may make appointment
by promotion against such post on officiating
basis:

A post reserved for regular promotions on


deferment if a Civil Servant due to any reason may
be filled by promotion on officiating basis.

(ii)
No person shall be promoted on officiating
basis unless he possesses the qualifications and
experience prescribed for the post
his promotion as such is recommended appropriate
selection authority.
(iii) An officiating promotion shall not confer any
right of promotion on regular basis
but shall be liable to be terminated as soon as a
person becomes available for promotion on regular
basis.
(iv) Officiating promotion shall be made on the
same terms and conditions to pay as are prescribed for
regular appointment by promotion.
14- All persons holding posts in the same functional
unit

who possess the minimum qualifications and


experience prescribed for a higher post reserved for
departmental promotion,
shall be eligible for promotion.
15- (1)
A person in the service of an autonomous or
semi-autonomous organization
who
possesses
minimum
qualifications, experience

educational

or comparable length of service prescribed for the


post shall be eligible for appointment to the said
post
on deputation,

for a period not exceeding three years at a time, on


such terms and conditions as may be sanctioned
by the Government in consultation with the
lending organization.
(2)
A civil servant who fulfills the conditions and
is considered suitable
may be sent on deputation to an autonomous or
semi autonomous organization,
on such terms and conditions as may be decided
by appointing authority in consultation with the
borrowing organization.
Initial Appointment
16- Posts in BS 16 and above and such other posts in
BS-11 to BS-15 as may be entrusted to the Commission, shall
be made on the basis of examination and test to be conducted
by the Commission. The posts in BS-11 to BS-15 of following
departments shall be made on recommendations of the
Commission.

Initial appointment to all posts in grades I and
above except those filled under rule 16, shall be made
on the basis of examination or test to be held by
the appropriate committee or the board.
After
advertisement
of
the
vacancies
in
newspapers, in the manner to be determined by
the Government.
17-A The child of a civil servant who dies or is
invalidated during service
shall be entitled to 10 additional marks for posts
in BS-6 and above reserved under this rules for
initial recruitment provided to qualifies the
test/examination.

be appointed against a post in BS 1 to BS 5

in the department in which such civil servant had


served without observing formalities.
18- (1)
A candidate for initial appointment to a post
must possess the prescribed educational qualifications
and experience.
Age relaxation shall be admissible under the
relevant rules.
Provided that experience, where prescribed, would
include equivalent experience to be determined by
the Government in a profession
or in the service of an autonomous or semiautonomous organization;

or a private organization.
(2)
(i) Where recruitment is to be made on the
basis of a written examination,
age shall be reckoned as on the first of January of
the year in which the examination is proposed to
be held; and
(ii)
in other cases, as on the last date fixed for
submission of applications for appointment.

The candidate must be a citizen of Pakistan.

20- Vacancies in various posts shall be filled from


persons domiciled in the Province of Punjab.

21-A No change in date of birth shall be admissible as
recorded at the time of joining service.

Process of appointment shall be completed within


190 days of the receipt of recommendations of
commissioner.

If a candidate fails to join duty within stipulated


period, his selection shall stand automatically
cancelled.

Part IV Ad Hoc Appointments


22- (1)
When a post is required to be filled, the
appointing authority shall forward a requisition to the
selection authority immediately after decision is taken to
fill the post.
(2)
After forwarding a requisition to the selection
authority, the appointing authority may,

Relaxations of Rules
23.

The Chief Minister may,


for special reasons to be recorded in writing,
relax any of the rules in any individual case of
hardship,
to the extent prescribed by him.
