OBSERVATION
The Court hearing was delayed as usual, it was originally scheduled at 8:30 but the
hearing only started at around 9:15. One of the parties were late and they for
postponement of the trial. Since the parties have not yet submitted themselves to
the PMC, the court agreed and they were sent to the PMC downstairs

COMMENTS/REACTION
It was a fast proceeding. The parties already admitted that they cannot proceed
with the case because of the absence of one of the parties. It seems that it is one of
the usual reasons while the case is being reset because of the absence of one of the
parties. It shows if the party is willing to proceed with the case. Also the court now
mandates that they undergo before they can proceed to pre-trial proper. As the
court looks to declog the dockets by lessening the case which goes the full route

OBSERVATION
This was the second case called for the day, the parties were present and pre-trial
proceeded. The parties, with the assistance of the clerk of court, submitted the
evidence to the court which included documents such as the land title of the
plaintif and the lease contract between the parties.
COMMENTS/REACTION
The court was able to conduct pre-trial proceedings. In the pre-trial proceedings, the
parties were prepared in the filing of their evidences. The Court was able to produce
to plan the conduct of the subsequent hearings and now they can plan ahead with
their respecvtive presentation before the court.

This was the third case of the day. However the parties were not present in the trial
court. The public prosecutor was constrained to move for a resetting

It is one of the sad realities of our legal system. The court being a passive body,
waits for persons who will prosecute hiscase before it. It cannot decide on its own as
there are rights that is to be protected. It cannot arbitrarily decide without evidence
and corollarily it cannot proceed without the presence of the parties,

OBSERVATION
Both parties are absent before the trail court but their respective counsels are
present. The counsels presented before the court a compromise agreement. On the
motion of the prosecution a judgement was rendered based on the compromise
agreement. Hence the case was dismissed.

COMMENTS/REACTION
Another mode of disposing of a case is the agreement of parties to settle the case
by them. The Court would now be relieved of the duty to hear the case as the
parties had agreed to not pursue with the case. A compromise agreement between
them would save them from the inconvenience of attending the hearing every now
and then, which would enable them to their lives normally.

OBSERVATION
Both parties are not present in the trial court. There was no appearance from both
parties since the start of the proceedings. As such the court was forced to
provisionally dismiss the case without prejudice.
COMMENTS/REACTION
The Court disposed the case provisionally because of the failure of the parties to
appear before the court for a long time. This is the prerogative of the court to
enable it to relieve itself of the case and remove it from their dockets.

Trial Witness Presentation

OBSERVATION
The witness was absent because of health reasons. The counsel moved for
postponement because of the absence of the witness. The prosecution did not
object to the motion of the witness.
COMMENTS/REACTION
Another one of the reasons why delays occur in Court proceedings is because of
unexpected delays such as this one. Its disappointing on our part as court
observers that we are not able to watch a full blown witness examination. It is the
responsibility of the parties to promptly inform the court about the appearance of
the witness so as to immediately remove them from the calendar of cases.

Motion for issuance of writ of execution

OBSERVATION
The plaintif along with his counsel appeared before the court. They brought with
them the decision of the RTC with regards to their claim had attained finality. They
filed the written motion for the issuance of a writ of execution. The court, there
being no appearance from the other party, granted the motion.
COMMENTS/REACTION
The motion for execution is necessary for the recovery of the judgment award. The
Court immediately granted the motion since the Judgement of the RTC has attained
finality. The court of origin has the responsibility of efecting the execution of the
judgement. And it did just that by issuing the said motion for execution. It is said to
be the last phase of the legal poceedings even beyond the judgement.
