Following the receipt of the Right to Information request, the RHH Redevelopment Project Team
commenced negotiations with the Applicant. The negotiations were entered into as the request was too
onerous in its current format and would unreasonably divert the resources of the RHH Redevelopment
Project Team from its other work.
In order to assist the Applicant to make an application in a form that would remove the grounds for
refusal, the RHH Redevelopment Project Team wrote to the Applicant on 19 February 2016 and
proposed the following wording to the Applicant:

The date indicated in the original tender documentation that installation of the temporary facility
would occur.
1b
The date indicated in the Guaranteed Construction Sum Offer program that installation of the
temporary facility would occur.
A copy of any briefing notes relating to the date the temporary inpatient facility will be installed on
site.

The subject, date and page length of any documents, advice, reports, emails or other
correspondence relating to the date the temporary inpatient facility will be installed on site.
On 9 March 2016, the RHH Redevelopment Project Team wrote to the Applicant and indicated that:

Briefing notes relating to the date the temporary inpatient facility will be installed on
site will be assessed for disclosure in accordance with the Right to Information
Act 2009.
1b
The RHH Redevelopment Project Team have determined that in accordance with Section 19 of
the Right to Information Act 2009, this request is voluminous based on the number of days it would
take to process the request and the cost to the RHH Redevelopment Project Team.
1a
Briefing notes relating to the date the temporary inpatient facility will be installed on
site will be assessed for disclosure in accordance with the Right to Information
Act 2009.
A number of briefing notes relating to the date the temporary inpatient facility will be installed on site
have been located and these are listed in the Schedule of Documents which is attached to this decision.
It should be noted that a number of documents have been redacted. However, the documents have not
been redacted on the basis of the information being exempt from release in accordance with Part 3
Exempt Information of the Act.
Rather, the information that has been redacted is information which is outside the scope of the request
from the applicant. In this case, the redacted information does not relate to the temporary inpatient
facility or the date that the temporary inpatient facility will be installed on the site.
Section 1.2.3 of the Right to Information Act 2009 Ombudsmans Manual states that:
Section 7 of the Act gives a right to information, not documents.
Since the right is a right to information, it will frequently be appropriate to give an
applicant for assessed disclosure only part of a document that part which contains the
information that the applicant seeks. The other part may be outside the request, or may
contain exempt information (s 18(2)).

The RHH Redevelopment Project Team has located a schedule outlining the timeframe for the
construction and installation of the temporary inpatient facility. The schedule is dated 6 December 2015
and was provided to the RHH Redevelopment Project Team on 21 January 2016.
The schedule outlining the timeframe for the construction and installation of the temporary inpatient
facility is listed in the Schedule of Documents and is being released in full.

The Tasmanian Industry Participation Plan submitted by Fairbrother Pty Ltd as part of their Tender for
the Temporary Inpatient Facility works is attached and is being released in full.

sub-contract for the temporary inpatient facility.
On 22 February 2016, the Applicant indicated that she was satisfied with the proposed alternative
wording.

On considering the request for a copy of the Pricing Schedule contained in the standard sub-contract for
the temporary inpatient facility, the delegated officer determined that in accordance with
Section 37(2)(c) of the Right to Information Act 2009, the disclosure of the information may be reasonably
expected to be of substantial concern to the third party.
As such, on 24 March 2016, and in accordance with Section 37 (2) of the Right to Information Act 2009,
the RHH Redevelopment Project Team wrote to the Managing Contractor (John Holland Fairbrother
Joint Venture) and:

notified the Managing Contractor that an application for assessed disclosure had been received by
the Tasmanian Health Service and that the Tasmanian Health Service must assess whether the
information requested must be disclosed to the applicant or is exempt from disclosure
requested that, within 15 working days from the date of the notice, the Managing Contractor
provide their view as to whether the information should be provided.
On 13 April 2016, the Managing Contractor wrote to the RHH Redevelopment Project Team and
indicated that John Holland Fairbrother Joint Venture do not have any objections to the release of the
Pricing Schedule as requested in the Right to Information Request.
As such, the Pricing Schedule contained in the standard sub-contract for the temporary inpatient facility
is listed in the Schedule of Documents and is being released in full.

modules from the place they are built to Liverpool St, Hobart.
Following the receipt of the Right to Information request, the RHH Redevelopment Project Team
commenced negotiations with the Applicant. The RHH Redevelopment Project wrote to the Applicant
and indicated that the cost of transporting the temporary inpatient facility modules is contained within
the $22 million cost for the temporary inpatient facility and would therefore be answered under
question 4.
On 22 February 2016, the Applicant withdrew this request.
