Course Description :Industrial and Labour legislation is one of the most important
institution of modern society to controls and regulates the relationship between employer
and employees .It is very necessary to maintain the healthy relationship between the
employer and employees. Industrial peace and harmony are vital for higher and continued
production. When men, women and children are employed in industrial settings there is
always the scope of their exploitation leading to industrial disharmony and unrest..
Exploitation becomes more pronounced when the labour force is largely unorganized, jobs
are a few while the job seekers are many and labour is mostly illiterate . Labour laws among
others ensure that the persons are not employed under conditions which tend to be
detrimental to their health , safety and welfare. Managers at various levels should be
conversant with the laws affecting the employed persons and at the same time they
understand the concept and evolution of Industrial Relations.

Course Learning Outcomes(CLO):


Upon successful completion of the course,the students should be able to:
LO 1 To Understand the basic concept,, evolution, constitutional guide lines and
theoretical perspectives of Industrial relations.
LO2.To Understand and appreciate the emergence and relevance of trade Unionism
and
the various issues concerning trade unions in India.
Lo 3 To know the importance and significance of collective bargaining and pre
requisites of successful bargaining.
LO 4 To Understanding the reasons of Industrial disputes and their prevention and
settlement.
LO 5 To Understand and grasp the relevant concepts like factory, hazardous
process,health, safety and welfare and the various other provisions of The Factories
Act,1948.

LO 6 To Know about the matters to be provided in standing orders and the


provisions for their modification.

LO 7 To develop an understanding of registration of trade unions, minimum


requirement of membership, type of funds of registered trade union and allied issues
about trade unions in India.
LO 8 To comprehend issues like fixing and revision of minimum wages and the role
of various committees and boards in fixing and revision of minimum wages.
LO 9 To grasp the notion of off set and on set of allocable surplus and minimum and
maximum bonus payable..
LO 10 To understand the importance of Payment of Wages and comprehend issues
like fixation of wage period ,time of payment of wages and authorized deduction from
wages.
LO11 To understand the notion of compensation paidin cases of accidents,issues like
special provisions relating to certain category of employees,penalty and rules related
to compensation.

Course Outline

Industrial Relations An overview: Concept, History and theoretical


perspectives of Industrial relations. Industrial relations and constitution of
India.ILO ,National Commission Labour and principles of labour legislations.
Trade unions-Concept Evolution and Functions: Trade Union in India
.History and Evolution of trade unions in India, objectives, Reasons for joining
trade unions, problems and various issues..Employers Associations.
Collective Bargaining-concept, significance and levels of collective
bargaining. Process and prerequisites of successful bargaining and
hindrances to collective bargaining.
Industrial discipline and Grievance handling ,industrial disputes and
their prevention and settlement of Industrial disputes. Recommendation of
Second National Commission on Labour.
The Factories Act,1948-Need for governing working conditions in
factories-statutory Health ,Safety and welfare measures-regulation on
working hours and leave provisions-special provisions in respect of
employment of young persons, women and in hazardous processes etc

Industrial Disputes Act,1947 Industrial disputes and the grievance


redressal machinery. Authorities, their power ,procedure and duties.
Provisions regarding strikes and lock outs, Lay off and retrenchment and
other allied provisions.
The Employment(Standing Orders) Act,1946 Statutory requirement
about standing orders laying down the terms and conditions of employment
, requirement of their certification and procedure for modification and
appeals etc.
The Trade Unions Act,1926 Concept and relevance of trade unionsregistration and rights and liabilities of registered trade unions, penalties
and procedure etc
The Minimum Wages Act,!948 Concept of fixing of minimum wages,role of
advisory committees, procedure for fixation and revision of minimum wages,
cognizance of offences and penalties related to violation of the provisions of
the Act..
The Payment of Bonus Act,1965 Concept of bonus-computation of
available surplus- eligibility,disqualification and payment of minimum and
maximum bonus,-set off and set on and other important provision of the Act.
The Payment of Wages Act,1936 Background and definitions of wagesresponsibility of payment and fixation of wage period-deductions from
wages-imposition of fine on employed person-powers of inspectors-authority
to hear claims and recovery of amount-unpaid group and single applicationpenalty for offences under the Act..
The Employees Compensation Act,1923 Concept of compensationbackground- employers liability for compensation-penalty for non payment
on time-commissioners-power and procedureof commissioners etc
