Pending before the Court is Defendant Arpaios Motion to Modify Deadline.

(Doc. 1680). The Motion is denied. The Court set forth the particular remedy questions

22

it wished the parties to address in its Findings of Fact. When it invited the parties to

23

address any other matters that they desire to bring to the attention of the court, it

24

contemplated matters pertaining to civil remedies. The Court will not permit Defendant

26

Arpaio to raise substantive challenges to the Courts Findings of Fact. (Doc. 1680 at 5).

As he notes, there have been 20 days of hearings on this issue. The Court advised the

28

parties that all issues of fact must be presented during the hearing and gave the parties a

full opportunity to make arguments pertaining to that factual evidence. The Court will
not now, after its detailed review of the evidence and exhaustive factual findings, provide

any party with a new opportunity to reargue the facts.

This clarification should focus the filings of the parties. Should the parties agree
that there are substantial areas of contemplated agreement, they may raise the matter at

the hearing on May 31 together with any proposals regarding the finalization of any such
agreements for the Courts consideration. The Courts schedule remains in place.
IT IS HEREBY ORDERED that Defendant Arpaios Motion to Modify the
Deadline (Doc. 1680) is denied.
