MODULE AIMS & OBJECTIVES


The aim of this unit is to provide learners with an understanding of aspects of employee
relations, collective bargaining, conflict resolution in the workplace and the skill to apply them,
particularly in business situations.
ASSIGNMENT BRIEF
This assignment is designed to make non lawyers aware of the basic principles of employee
relations which can be applied in the practical aspects of Business.
TASK ONE
P1. Answer the following questions
(a) In deciding whether an individual in an employee (or not), what are the key factors that
Court will take into consideration?
(b) What are definition(s) currently available for who an employee is?;
(c) Discuss whether lapdancers are considered to be employees in the UK based on such
definitions, with reference to case law (if any)?;
P2. Discuss the following
a) What protection the Public Interest Disclosure Act 1998 has had on whistle-blowers;
b) Does requiring a Christian to work on Sunday amount to direct or indirect
discrimination?;

P 3.1 Answer the following questions
(a) To what extent can trade unions choose its members?
(b) In what circumstances can a citizen prevent industrial action?

P 3.2 Discuss the following briefly,;


(a) Is resorting to arbitration or mediation a viable option for companies in resolving trade
disputes?
(b) To what extent is it possible for an employee to complain about his workplace online?
(c) Based on (b) above, in what circumstances is an employer justified in dismissing such an
employee?
P.3.3 Answer the following;
(a) Discuss the correct procedure that needs to be followed before a trade union engages in
industrial action.
(b) Discuss the effect Article 6 of the European Convention on Human Rights has had on
employees and employers.

TASK THREE (P4)


Create a homemade video, regarding the following;
Your organisation has been requested to create an instructional video targeted for employers, to
inform them of anti-discrimination laws in place in the country, and steps that an employer
must take to avoid allegations of discrimination.
Prepare such instructional video
Please keep in mind the following guidelines in completing TASK THREE (P4)

The video should be minimum of 3 minutes in duration;

STUDENT IDs of participants must be clearly set out at the start or end of the video;

Any dialog must be clear/audible;

Candidates are permitted to use text, to depict statements;

There can be up to a maximum of six (6) candidates in a group;

Each candidate must individually submit a copy of the video along with his/her
assignment;

All candidates in the group will be awarded the same grade for task 3 (P4);

Candidates will ONLY be awarded credit on accuracy of facts/arguments put forward;

Candidates will NOT be awarded extra credit for the quality of the audio/video in the
home movie, nor acting prowess;

their choice;

Margins: 1 from each side
Numbering: at the bottom right hand corner

All the Figures, Tables, Diagrams etc. should be numbered


Label sketches properly and neatly.
Write on only one side of the paper.
Utilize a table of contents and section headings where applicable.
Use size A4 paper.
Provide a title page and a front cover.
Do not forget to sign the plagiarism statement on the cover sheet of your assignment.
Please note that plagiarism is treated as a serious offence and therefore the work you
produce must be individual and original although may work in groups in some instance
All sources of information must be referenced using Harvard referencing where a
reference listing should be included at the end of the assignment
Assignments returned to students for re-working must be re-submitted within 10 days
(Please refer to Student Handbook on Assignments Re-submission).
Failure to re-submit the previously marked assignment with the re-submitted assignment
will mean that results cannot be released for the respective unit.
Please note that the technical failures which occur during the assignment processing period
are not counted as an excuse for late submissions. As a precaution you are expected to have
a backup file (a copy of your assignment) by all means saved in the system to avoid sudden
system crashes and technical failures.
The ethical procedures of the course strictly maintain a data security policy on students
