AFFIDAVIT

I, Smti. Sima Dutta, wife of Late Rishikesh Dutta, resident of Narsing Road,
Shibam Apartment Ground, Ambicapatty, P.S. - Silchar, Cachar, Assam, aged
about 56 years, by religion Hindu and by profession housewife, solemnly affirm
and state as follows :-
1. That Smti Sharmista Das is my daughter.
2. That Smti Sharmista Das was married at the age of 24 yrs to Shri Rananjay
Das alias Rupam Das, S/o Shri Rupendra Mohan Das alias Ratul Das,
resident of C/o Shri Sumit Endow, Moulavi Road, Ambicapatty, P.S. -
Silchar, Cachar, Assam, on 22/01/2003 under the Special Marriage Act,
1954.
3. That after her marriage her husband and in-laws started demanding
dowry and subjecting her to ill treatment and cruelty.
4. That ultimately her husband left her with two daughters on 3/09/2009 and
it is reported that he married another girl and has been living with her in
Shillong, Maghalaya.
5. That the in-laws of my daughter, in the meantime, gradually intensified
their cruel treatment and both physical and mental harassment towards
my daughter. At last they drove her away from their house on 15/9/2009
forcibly robbing her of all jewellery and other necessary items.
6. That my daughter since 15/09/2009 has been residing with me with her
two daughters.
7. That my daughter filed a case which was registered as Silchar P.S. Case
No. 2126 on 3/11/2009 U/S 498A, IPC against Rananjay Das, Rupendra
Mohan Das, alias Ratul Das, Mitra Das and Joydeep Roy Choudhury.
8. That Mr. S. K. Chauhan, officer-in Charge of Silchar Police Station, forced
me to pay him Rs. 5000.00 (fifty thousand) only on 03/11/2009 in
connection with this case. I paid him the sum before my daughter at the
police station.
9. That I was again compelled to pay Rs. 900.00 (Nine hundred) only at the
police station before my daughter to a lady constable later that day.
10. That I was also forced to pay another sum of Rs. 1200.00 (twelve hundred)
only on 12/11/2009 in connection with this case to the officer in-charge of
Silchar police station.
11. That later my daughter on 10/03/2010 filed another case for recovering
her cloths, jewellery and other items that she received as gifts at her
wedding which was registered as Silchar P.S. Case No. 509/10 U/S 379
and 406 of IPC.
12. That my daughter also filed another application in the Court of District
Magistrate for a search warrant U/S 94 of the Cr. P.C. and the same was
issued on 16/03/2010.
13. That S. I. Narayan Tamuli was made the investigating officer of case No.
509/10 and he was also entrusted with the execution of the said search
warrant.
14. That S.I. Narayan Tamuli in connection with both the cases demanded Rs.
3000.00 (three thousand) only from us which we paid through Smti Mithu
Sen on 17/03/2010 and Smti Sen paid it before my daughter.
15. That we again were compelled to meet the demand of Rs. 20,000.00
(twenty thousand) only made by S. I. Naryan Tamuli. This amount was
also paid by Mithu Sen on 17/03/2010 before my daughter in the premises
of the police station.
16. That S. I. Narayan Tamuli demanded from my daughter, Mithu Sen and
Aleya Islam Laskar another sum of Rs. 50,000.00 (fifty thousand) only
when they visited the police station on 20/3/2010 to know about the
progress of the investigation.
17. That I made the statements above with sole intention to meet the ends of
justice.
VARIFICATION
I, Sima Dutta, do hereby verify that the statements made in Para 1 to 16,
both inclusive, true to the best of my knowledge and belief. I solemnly affirm
and state that I made these statements in full knowledge, consciousness and
sound mind. No material facts have been concealed.
