Chapter1
TitleandDefinitions
1. (a)ThisLawshallbecalledtheEmploymentandSkillDevelopmentLaw.
(b)ThisLawshallbeinforce3monthsafternotificationisannounced.
2. Theexpressionscontainedinthislawshallhavethemeaningsgivenasunder:
(a) Employermeansthepersonwhohastherighttoappointtheemployeeortheperson
who is delegated to appoint this employee in the Government department and
Organization,theCooperativesocietyinwhichpermanentortemporaryemployeesof
above the limited numbers are working, Private or Jointventure business, any
Organization,theCompany.
(b) Employeemeansthepersonwhoworksforremunerationofskilljob,fairlyskilljob,non
skill job in the Government department and Organization, the Cooperative society,
Private or JointVenture, any Organization, the Company. In this expression the
apprenticeisalsoincluded.
(c) IndustryandServicemeansfactory,onetypeoralltypesofworkshops,onetypework
oralltypes'works,mill,branchworkshop,branchwork,branchworkshop department
andonetypeoralltypesofbranchworkdepartment,whicharesituatedinanylocation,
stipulated by the Ministry of Labour, Employment and Social Security for the matters
underthislaw.
(d) Wage, Salary mean in addition to normal wage, salary earned by working, overtime
wage and allowance are included if overtime and allowance are entitled. In this
expressiontheremunerationtocoverthespecialexpenseduetothenatureofthework
isnotincluded.

(e) Training mean pre worksite training, on job training, skill training, high skill training,
training related to employment transfer, which open for the employment seekers and
employeestoenhancetheirknowledge,technicalabilityandskilldevelopment.
(f) TrainingSchoolmeanstheschoolfoundedandopenedtogivetrainingformeetingthe
technicalskillnormfortheemploymentseekersandemployees.
(g) Skillmeanthetechnicalcapabilityrequiredtoworkinaccordwiththestipulations.
(h) Technical Skill Norm means technical capability norm required to work in accord with
the recognized or specified technical skill set up by the skill development body for all
kindsofworkunderthislaw.
(i) CentralBodymeanstechnicalskilldevelopmentcentralbodyformedunderthislaw.
(j) RegisteredCertificatemeansthecertificateissuedtothetrainingschoolandtechnical
skill assessment departments by the technical skill development committee under this
law.
(k) TechnicalSkillAssessmentDepartmentmeansthedepartmentrecognizedandpoweris
entrustedbythetechnicalskilldevelopmentcommittee,asitmeetsthespecifiednorm.
(l) TechnicalSkillCertificatemeansthecertificateissuedbythetechnicalskillassessment
departmentwiththeapprovaloftechnicalskilldevelopmentcommittee.
(m) SkillEmployeemeanstheemployeewhoreceivesthetechnicalskillcertificateissuedby
the technical skill assessment department with the approval of the technical skill
developmentcommittee.
(n) Fundmeansthetechnicalskilldevelopmentfundfoundedunderthislaw.
(o) Putinfeemeansthemoneypaidtothetechnicalskilldevelopmentfundbytherelevant
employerunderthislaw.
(p) TheMinistrymeanstheministryofemployee,theemploymentandthesocialsecurity.

Chapter2
SeekingEmploymentandEmployee
3. TheMinistryshallarrangeeasyopportunitiesandjobstoassistinthejobseekertoselectjob
suitabletohisage,capability,togetthejob,tobestableinthejobandtodevelopinthe
skill,toassistintheemployertogetthesuitableandcompatiblewiththejob.
4. (a)foranymatterundersection3,theMinistry:
(1) shallsetupemploymentandlabourexchangeofficeasnecessary;

(2) shallcarryoutthenecessaryarrangementtorevealtheemploymentopportunities,
to assist in the employment seeker and to assist in the employer to get the
employee who is suitable and compatible with the employment, to open
government employment and labour exchange office, to allow the local private
employmentagencycompanieswhichareprovidingfreeservicetotheemployment
seekers,andothermeans.
(b)Iftheemploymentseekerrefusetoaccepttheemploymentofferedbytheemployment
andlabourexchangeofficegivingthereasonthatregardingthesaidemploymentthereisa
dispute between the employee and employer, the remuneration earned by the other is
morethanthesimilaremploymentforhim,heshallhavetherighttoenjoytheotherbenefit
andopportunitiesavailableinthesaidLabourOffice.
(c)Inconnectionwiththeemploymentwhich isvacantatpresentandgoingtobevacant,
theMinistryshallarrangetoasktheemployerforinformingthevacantemploymentinhis
business to the relevant employment and labour exchange office in accord with the
stipulations.

Chapter3
SigningEmploymentAgreement
5. (a) (1) If the employer has appointed the employee to work for an employment, the
employment agreement shall be made within 30 days. But it shall not be related with
governmentdepartmentandorganizationforapermanentemployment.
(2) If pre training period and probation period are stipulated before the appointment
thesaidtraineeshallnotberelatedwiththestipulationofsubsection(1).
(b)Thefollowingparticularsshallbeincludedintheemploymentagreement:
(1)thetypeofemployment;
(2)theprobationperiod;
(3)wage,salary;
(4)locationoftheemployment;
(5)thetermoftheagreement;
(6)workinghour;
(7)dayoff,holidayandleave;
(8)overtime;

(9)mealarrangementduringtheworkhour;
(10)accommodation;
(11)medicaltreatment;
(12)ferryarrangementtoworksiteandtravelling;
(13)regulationstobefollowedbytheemployees;

(14) if the employee is sent to attend the training, the limited time agreed by the
employeetocontinuetoworkafterattendingthetraining;
(15)resigningandterminationofservice;
(16)terminationofagreement;
(17)theobligationsinaccordwiththestipulationoftheagreement;
(18)thecancellationofemploymentagreementmutuallymadebetweenemployerand
employee;
(19)othermatters;
(20)specifyingtheregulationoftheagreement,amendingandsupplementing;
(21)miscellaneous.
(c)Theworksiteregulationscontainedintheemploymentagreementshallbeincompliance
withanyexistinglawandthebenefitsoftheemployeeshallnotbelessthanthoseofthe
anyexistinglaw.
(d) According to the employment agreement, the Ministry shall issue the notification for
paying the stipulated compensation to the employee by the employer, if the work is
completedearlierthanthestipulatedperiodorthewholeworkoranypartofithaveto
be terminated due to unexpected condition or the work has to be terminated due to
variousconditions.
(e)Theemploymentagreementmadeundersubsection(a)shallberelatedwithdailywage
workers, piece rate workers who are appointed temporarily in the government
departmentandorganization.
(f)Theworksiteregulationsandbenefitscontainedintheemploymentagreementmutually
madebetweentheemployerandemployeeoramongtheemployeesshallbeamended
asnecessary,inaccordwiththeexistinglaw.
(g) The employer shall send a copy of the employment agreement made between the
employerandemployee,totherelevantemploymentandlabourexchangeofficewithin
thestipulatedperiodandshallgettheapprovalofit.

(h)Theemploymentagreementmadebeforetheenforcementofthislawshallbeconfirmed
uptotheendofthetermoftheoriginalagreement.

Chapter4
FormingEmploymentandSkillDevelopmentTeamsandTheirDutiesand
Responsibilities
6. TheUnionGovernment
(a) shall form the central body for employment and skill development consisting of the
followingpersonnel:

(b) Informingundersubsection(a),thetechnicalexpertrelatingtotheskilldevelopment
forlabourshallbeappointedasmember.
11. Thedutiesandresponsibilitiesoftheskilldevelopmentteamsareasfollows:
(a) classificationofemploymentskillnorm,drawingandenacting;
(b) priority classification for the skill development of the employees and laying down the
policiesrelatingtotheskilltraining;
(c) prescribingthearrangementrelatingtotheskillassessment;
(d) issuingtheregisteredcertificatetothetrainingschoolorskillassessmentdepartments;
(e) layingdownthearrangementrelatingtotheissuingofskillassessmentcertificate;
(f) managingafterformingtheskilldevelopmentfundfortheemployees;
(g) supervisingthecommitteesandsubcommitteesformedbyit.
12. (a)theskilldevelopmentteamshallformthefollowingcommitteestoperformtheduties
(1) Thecommitteeforskillnormtobespecifiedandtraining;
(2) Thecommitteeforskillnormassessmentandacknowledgement.
(b) The skill development team shall form the subcommittees as necessary, under the
committeeofsection12subsections(a).
13. In connection with the duties and powers of the respective committees formed under
section12subsections(a)
(a) The committee for skill norm to be specified and training and the committee for skill
norm assessment and acknowledgement shall draw after coordinating, the relevant
establishmentcommitteewiseandtheworkprogram.

(b) Thecommitteeforskillnormtobespecifiedandtrainingshallperformthefollowings:

(1) drawingthetypeofemploymentandtrueandcorrectskillnormafterreferringwith
theinternationalnorms;
(2) drawingthesyllabusinaccordwiththeskillnorm,specifyingthetrainingnorm;
(3) specifyingthequalityofthetraininginstructor;
(4) specifyingequipment,apparatusandteachingaidnorm;
(5) trainingschoolregistrationandkindoftrainingregistration;
(6) coordinatingforthetechnicalskilldevelopment;
(7) after scrutinizing, submitting to the skill development team relating to the
applicationforregistercertificate.
(c) The committee for skill norm assessment and acknowledgement shall perform the
followings:
(1) specifying the assessment norm in accord with the employment skill norm to be
specified;
(2) registration of skill assessment department and registration of skill assessment
program;
(3) after scrutinizing, submitting to the skill development team relating to the
applicationfortheregisteredcertificate;
(4) specifyingassessmentmethod,specifyingqualitycontrolsystemsanddutiesforthe
assessorsandqualitywarrantyoftheskillassessmentdepartment;
(5) technologicalcoordinationfortheskilldevelopment;
(6) specifying the grade and arranging the competition for the employment skill
development;
(7) issuingacknowledgementcertificateastheoutstandingpersonifheperformsinthe
competitionsignificantly.

Chapter5
EmployeeSkillDevelopmentandDoingTrainingProgram
14. Theemployershallcarry outthetrainingprograminaccordwiththeworkrequirementin
line with the policy of the skill development team to develop the skill relating to the
employmentfortheworkerswhoareproposedtoappointandworkingatpresent.

15. TheEmployer:

(a) shall carry out the training for each work or compounding the work individually or
groupwise by opening onjob training, training systematically at worksite, sending
outsidetrainingandtrainingbyusinginformationtechnologysystem,forarrangingthe
trainingprogramtoenhancetheemploymentskilloftheworkers;
(b) appointing the youths of 16 years as apprentice, shall arrange the training for
technology relating to the employment systematically in accord with the regulations
prescribedbytheskilldevelopmentteam.

Chapter6
RegistrationandFoundingoftheTrainingSchoolandSkillAssessmentDepartments
16. (a)Theemployerortheserviceprovidershallapplythroughtherelevantcommitteestothe
skilldevelopmentteamtoacquiretheregistrationcertificateinaccordwiththestipulations.
(b)Theforeignerwhocomesandwantstoopenthetrainingschooloranyskillassessment
department,heshallapplythroughtherelevantcommitteestotheskilldevelopmentteam
toacquiretheregistrationcertificateinaccordwiththeexistinglaws.
17. Theskilldevelopmentteam:
(a) shall allow or refuse to issue the registration certificate after asking the relevant
committeesformedundersection12,toscrutinizewhetheritisincompliancewiththe
stipulationsornot,inconnectionwiththeapplicationundersection16;
(b) shall issue the registration certificate to the applicant after paying for the registration
feesinaccordwiththestipulatedregulations,ifitispermittedtoissueit;
(c) shall allow to apply again within 30 days, if it is refused to issue the registration
certificate.
18. The registered certificate holding training school and skill assessment departments shall
applythroughtherelevantcommitteetotheskilldevelopmentteamtoextendthetermof
theregistrationinaccordwiththestipulations,iftheywanttocontinuetherelevantwork
afterexpiringthetermoftheregistration.
19. The skill development team shall have the right to cancel the registered certificate of the
said training school or the skill assessment department, if it is found that they are not in
compliancewiththestipulationscontainedintheregisteredcertificate.
20. Theobligationsoftheregisteredtrainingschoolareasfollows:

(a) Receiving the consent after drawing the following training program and submitting to
theskilldevelopmentteam;
(1) theskillnorm,
(2) thesyllabus,
(3) thestatementforthelocationofthetrainingschool,thebuildingandapparatus,
(4) thenameoftheinstructorandhisqualification,
(5) thetrainingperiod,
(6) thetrainingsystemforusinginthetraining,thetrainingaids,
(7) thetrainingcertificate,
(8) thetrainingfee,
(9) theotherparticularsprescribedbythecommitteefortheskillnormtobespecified
andtraining.
(b) signingtheagreementrelatingtothetraineeandthetraining;
(c) maintainingthecurriculumvitaeofthetrainees;
(d) submitting the report relating to the training to the skill development team within 15
daysaftercompletingthetraining;
(e) submitting to the skill development team minimum 30 days in advance before
transferring,ifthetrainingschoolisrequiredtotransfertoanotherpersonwhowantsto
openthetrainingschool;
(f) transferringthetraineeswiththeremainingtrainingexpansestoanyotherworksimilar
trainingschool,ifthetrainingschoolisrequiredtoclose.
21. Thefounderoftheregisteredtrainingschool:
(a) shall have the right to appoint the foreign experts and instructors who receive work
permit issued by the relevant ministry. Their stay period shall be in accord with the
existinglaw;
(b) shallhavetherighttoimporttheteachingaidsinaccordwiththeexistinglaws;

22. Theobligationsoftheregisteredskillassessmentdepartmentareasfollows:
(a) Receivingtheconsentaftersubmittingthefollowingskillassessmentprogramtotheskill
developmentteam;
(1) theassessmentprogrambasedontherecognizedskillnorm,
(2) thestatementofthelocationofthedepartment,thebuildingandtheapparatus,
(3) thenamesoftheassessorsandtheirqualification,

(4) theassessmentperiod,
(5) theassessmentaidsforusingintheassessmentdepartment,
(6) thestatusofthequestionstobeassessed,
(7) theskillnormandmethodusingintheassessment,
(8) thefeestobecollectedfromtheassessedpersons,
(9) otherparticularsprescribedbythecommitteeforskillassessment.

(b) To acquire the recognized certificate, fixing of the stipulated regulations for the
applicantwhoseskilltobeassessedandassessmentprogramtobespecified;
(c) Tomaintainthecurriculumvitaeoftheassessedpersons;
(d) Tosubmitthereporttotheskilldevelopmentteamwithin15daysafterskillassessment
havebeenmade;
(e) Toissuerecognizedcertificatetothepersonswhopassedtheskillassessmentwiththe
approvaloftheskilldevelopmentteam;
(f) To transfer the assessed persons with the remaining expense to other similar type of
skillassessmentdepartment,iftheskillassessmentdepartmentisrequiredtoterminate;
(g) To submit to the skill development team minimum 30 days in advance before
transferringtheskillassessedpersonstootherskillassessmentdepartment.
23. Theregisteredskillassessmentdepartment:
(a) shallhavetherighttoappointtheforeignexpertsandassessorswhoreceivedthework
permitissuedbytherelevantministry.Theirstayperiodshallbeinaccordancewiththe
existinglaw;
(b) shall have the right to import the assessed aids in accord with the existing laws. Shall
havetherighttoapplytotherelevantskillassessmentdepartmenttobeassessed.

Chapter7
Conductingtheskillcompetition
24. The committee for skill assessment and recognition shall implement in accord with the
stipulations to arise step by step skill competition for the skill development depending on
thetypeofwork.Tocarryouttheresearchworksthroughtheresultsofskillcompetition.
25. The employee who received the skill recognized certificate is entitled to participate in the
relevantskillcompetitionheldinthecountryandabroad.

Chapter8
FoundingandUsingtheEmployeeSkillDevelopmentFund
26. Founding a fund for the skill development of the employees of industry and services
business,theskilldevelopmentteamshallhavetherighttouseforthefollowingmattersin
accordwiththestipulations:
(a) trainingfortheskilldevelopmentandskillenhancementfortheemployees;
(b) trainingagainfortherequiredskillfortheemployeeswhoareterminatedfromservice
duetoanyreasonandwanttochangeanyotherwork;
(c) loanorsupportmoneyforthemattersundersubsection(a)and(b).
27. TheskilldevelopmentteamshallformtheFundmanagementcommitteecomprisingofthe
government,theemployerandtheemployeerepresentatives.
28. Thedutiesandresponsibilitiesofthefundmanagementcommitteeareasfollows:
(a) supervisingtheputinfeesregularlytothefund;
(b) managingthefundwiththeconsentoftheskilldevelopmentteam;
(c) depositingtheinvestingmoneyoutofthefundinanybankinaccordwiththefinancial
regulationsorbuyingandsavingthedebentures;
(d) receivingthedonationwiththeapprovalofskilldevelopmentcommitteeifthereisany
donor;
(e) auditingtobereceivedrelatingtoputtinginandusingthefund.
29. The fund management committee shall have the right to use the fund for any of the
followingmatterinaccordwiththeregulationstipulatedbytheskilldevelopmentteam:
(a) sendingtoanyparttimeorfulltimetrainingfortheskilldevelopmentoftheemployee,
openingthetrainingandsupportingorgivingloantotheemployerwhoshallextendthe
trainingprogram;
(b) reissuingafterscrutinizinginaccordwiththestipulationsifaskingtopaytheexpenses
incurredrelatingtothetrainingforthesaidemployees;
(c) performingothermattersstipulatedbytheskilldevelopmentteam;
30. (a)Theemployeroftheindustryandservicebusinessshallputintothefundmonthlyasput
infeeswithoutfailforthetotalwagesofthesubordinatesandthesupervisors'salaryfornot
lessthan0.5%;
(b)Putinmoneypaidundersubsection(a)shallnotbedeductedfromthewageandsalary
oftheemployees.

31.Theskilldevelopmentteam:

(a) relating to the put in money which is to be paid to the fund by the employer under
section30,subsection(a)shallspecifybasedontheworksector,typeofwork,sizeofwork
andnumberofemployees;

(b) shall have the right to exempt from putting into the fund if any employer can submit
securereason.

32.Theskilldevelopmentteamshallsupervisethetrainingopenedbytheforeignerrelatingto
themonetarymatterinaccordwiththeexistinglaws.
33.Theskilldevelopmentteamshallformtheadvisorycommitteetoacquiretheadvicerelating
tothemanagementofthefundandusingit.

Chapter9
OffenceandPenalties
34.Ifanyoneisconvictedofcommittingtheimitationonskillrecognizedcertificate,heshallbe
punishedwithimprisonmentfornotmorethan7yearsandwithafine.
35. If anyone is convicted of committing the conducting of employment exchange business
withoutthepermissionoftheministryorreceivingthefeesfromtheemployees,heshallbe
punishedwithimprisonmentfornotmorethanthreeyearsorwithafineorwithboth.
36. If anyone is convicted of violating any prohibition of the rules, regulations, by law,
notification,orderanddirectiveunderthislaw,heshallbepunishedwithimprisonmentfor
notmorethanoneyearorwithafineorwithboth.
37.Ifanyoneisconvictedofsubmittingthefalsestatementorfalsesayingknowingthatitisnot
true, to any employment and labour exchange office or any representatives doing for the
said office work to get the employment or employee, he shall be punished with
imprisonmentfornotmorethanoneyearorwithafineorwithboth.
38.Ifanyemployerisconvictedofcommittinganyofthefollowingmatters,heshallbepunished
withimprisonmentfornotmorethansixmonthsorwithafineorwithboth:

(a)failingtosignemploymentagreementundersection5,subsection(a);

(b)failingtopayputinmoneyundersection30,subsection(a).

39.Ifanyoneisconvictedofviolatinganymatterscontainedintheemploymentagreement,he
shallbepunishedwithimprisonmentfornotmorethanthreemonthsorwithafineorwith
both.

Chapter10
Miscellaneous
40.Iftheemployerfailstopaybacktheloanfromthefundwithinthespecifiedperiod,thesaid
loanshallbecollectedasthearrearsoflandrevenue.
41.Inimplementingthestipulationsunderthislaw:

(a)theministryshallissuethenecessaryrules,regulationsandbylawwiththeconsentof
theUnionGovernment;

(b)theministryandthelabourdirectorateshallissuethenecessarynotification,order,
directiveandtheprocedures.

42.EmploymentandTrainingAct,1950shallberepealedbythislaw.
