This Programme is Accredited by the Mediation Board of Trinidad & Tobago
Insurance companies are driven to manage claims and resolve disputes by engaging in direct negotiations with their
policyholders and Third Party Claimants. However, matters do end up in litigation or arbitration or referred to the Office of the
Financial Services Ombudsman (OFSO). Litigation and arbitration are typically costly, time-consuming, uncertain and ultimately
unsatisfying, regardless of the outcome.
Over 5,000 Civil cases are filed in the courts each year. Our courts are stretched to capacity. In 2010 and 2013, the Judiciary
sponsored two court annexed mediation projects which were administered by the Dispute Resolution Centre. 75% of the
referred cases were medical negligence, personal injury, running down actions and commercial and contractual disputes. The
settlement rate ranged from 70% to 83% with a customer satisfaction rate of 95%. At the opening of the 2015/6 Law Term,
the Chief Justice reiterated that the deployment of alternative dispute resolution (ADR) mechanisms, including Mediation,
would be an essential part of any effective justice system and has set a 2016 deadline for the introduction of mandatory
mediation.
SPECIAL PURPOSE ADR COMMITTEE
It is against this backdrop that in June 2015 ATTIC convened a Special Purpose ADR Committee, comprising the General
Insurance Directors of ATTIC, the Law Association of Trinidad & Tobago (LATT) and the Dispute Resolution Centre (DRC). The
role and purpose of the ADR Committee is to develop best practices for managing insurance disputes in an efficient and
commercially rational manner. The solution must have the legislative teeth to make a real dent on the problem; rely on a high
quality, readily-available infrastructure for quick and seamless integration with the insurers internal processes; and prepare
insurers for the eventual passage of the Insurance Bill and the expected requirement for insurers to enrol in an alternative
dispute resolution scheme, approved by the Central Bank, within sixty (60) days after this Bill comes into force.
SUITABILITY OF MEDIATION FOR INSURANCE DISPUTES
Insurance disputes are prime cases for mediation because it allows the parties to gain the insight of an agreed-upon, neutral
expert in insurance law and practice. It allows the parties to candidly identify (through the mediator) their true obstacles to
settlement and to address complex scientific and economic issues that are often not well-suited for litigation, such as the
allocation of loss among potentially liable insurers. It allows the parties to settle issues in a more comprehensive and often
creative fashion than may be possible in litigation, with the assistance of someone who has a good understanding of industry
practice and what the market will bear in similar circumstances. For these reasons, ATTIC embraces this initiative since it
enhances internal process efficiencies in claims administration and settlement as well as the reputational risk profile of the
insurance Industry as a whole.

The TTII is pleased to partner with the DRC for the delivery of a customised 5-day Mediation Skills workshop for Insurers. This
programme will equip insurers will the internal capacity to navigate difficult conversations and situations and also help
participants understand their role in the dispute resolution process, as it relates to ATTICs ADR Project. The DRC is

encouraged by the proactive approach of ATTIC/TTII and is pleased to offer SPECIAL DISCOUNTED RATES of
