This cause came on to be heard on the transcript of record from the United
States District Court for the Eastern District of New York, and was submitted
by counsel.
Defendant Eulises Tovar appeals from a judgment entered in the United States
District Court for the Eastern District of New York following a jury trial before
Charles P. Sifton, Chief Judge, convicting him of conspiracy to possess with
intent to distribute heroin, in violation of 21 U.S.C. 846, and sentencing him
principally to 210 months' imprisonment. On appeal, Tovar contends primarily
that the district court erred in admitting other-crimes evidence, that the
evidence was insufficient to support his conviction, and that he was denied
effective assistance of counsel. For the reasons that follow, we find no basis for
reversal.
prejudice from the prioract evidence did not substantially outweigh its
probative value was not an abuse of discretion.
