Lawunconstitutionalbecauseofsomedefectsin
thelaw'sproceduralframework.
In1972,HouseBillNo.393wasfiledin
Congress,whichwouldestablishaprobation
systeminthePhilippines.Thisbillavoidedthe
objectionablefeaturesofAct4221thatstruck
downthe1935lawasunconstitutional.Thebill
waspassedbytheHouseofRepresentatives,but
waspendingintheSenatewhenMartialLawwas
declaredandCongresswasabolished.

In1975,theNationalPoliceCommissionInterdisciplinarydraftedaProbationLaw.After18technical
hearingsoveraperiodofsixmonths,thedraftdecreewaspresentedtoaselectedgroupof369jurists,
penologists,civicleadersandsocialandbehavioralscientistsandpractitioners.Thegroupoverwhelmingly
endorsedtheestablishmentofanAdultProbationSysteminthecountry.
OnJuly24,1976,PresidentialDecreeNo.968,alsoknownasAdultProbationLawof1976,wassigned
intoLawbythePresidentofthePhilippines.
Thestartupoftheprobationsystemin19761977wasamassiveundertakingduringwhichalljudgesand
prosecutorsnationwideweretrainedinprobationmethodsandproceduresadministrativeandprocedural
manualsweredevelopedprobationofficersrecruitedandtrained,andthecentralagencyandprobation
fieldofficesorganizedthroughoutthecountry.FifteenselectedprobationofficersweresenttoUnitedStates
fororientationandtraininginprobationadministration.Upontheirreturn,theywereassignedtotrainthe
newlyrecruitedprobationofficers.
TheprobationsystemstartedtooperateonJanuary3,1978.Asmoreprobationofficerswererecruitedand
trained,morefieldofficeswereopened.Thereareatpresent204fieldofficesspreadalloverthecountry,
supervisedby15regionaloffices.

TheOrganization
TheProbationAdministrationwascreatedbyvirtueofPresidentialDecreeNo.968,TheProbationLawof
1976,toadministertheprobationsystem.UnderExecutiveOrderNo.292,TheAdministrativeCodeof
1987whichwaspromulgatedonNovember23,1989,theProbationAdministrationwasrenamedParole
andProbationAdministrationandgiventheaddedfunctionofsupervisingprisonerswho,afterserving
partoftheirsentenceinjailsarereleasedonparolepardonwithparoleconditions
EffectiveAugust17,2005,byvirtueofaMemorandumofAgreementwiththeDangerousDrugsBoard,the
Administrationperformsanotheradditionalfunctionofinvestigatingandsupervisingfirsttimeminordrug
offenderswhoareplacedonsuspendedpursuanttoRepublicActNo.9165.

Mandate
TheParoleandProbationAdministrationismandatedtoconserveand/orredeemconvictedoffendersand
prisonerswhoareundertheprobationorparolesystem.

Goals
TheAdministration'sprogramssetstoachievethefollowinggoals:
Promotethereformationofcriminaloffendersandreducetheincidenceofrecedivism,and
Provideacheaperalternativetotheinstitutionalconfinementoffirsttimeoffenderswhoarelikelyto
respondtoindividualized,communitybasedtreatmentprograms.

Functions
Tocarryoutthesegoals,theAgencythroughitsnetworkofregionalandfieldparoleandprobationoffices
performsthefollowingfunctions:
toadministertheparoleandprobationsystem
toexercisesupervisionoverparolees,pardoneesandprobationers
topromotethecorrectionandrehabilitationofcriminaloffenders.

MajorRehabilitationPrograms
RESTORATIVEJUSTICE(RJ)isaphilosophyandaprocesswherebystakeholdersinaspecificoffense
resolvecollectivelyhowtodealwiththeaftermathoftheoffenseanditsimplicationsforthefuture.Itisa
victimcenteredresponsetocrimethatprovidesopportunityforthosedirectlyaffectedbythecrimethe
victim,theoffender,theirfamiliesandthecommunitytobedirectlyinvolvedinrespondingtotheharm
causedbythecrime.Itsultimateobjectiveistorestorethebrokenrelationshipsamongstakeholders.
TheRestorativeJusticeprocessprovidesahealingopportunityforaffectedpartiestofacilitatetherecovery
oftheconcernedpartiesandallowthemtomoveonwiththeirlives.
TheVOLUNTEERPROBATIONAIDE(VPA)PROGRAMisastrategybywhichtheParoleand
ProbationAdministrationmaybeabletogeneratemaximumcitizenparticipationorcommunity
involvement.Citizensofgoodstandinginthecommunitymayvolunteertoassisttheprobationandparole
officersinthesupervisionofanumberofprobationers,paroleesandconditionalpardoneesintheir
respectivecommunities.Sincetheyresideinthesamecommunityastheclient,theyareabletousherthe
reformationandrehabilitationoftheclientshandson.
IncollaborationwiththePPO,theVPAhelpspavethewayfortheoffender,victimandcommunitytoeach
healfromtheharmresultingfromthecrimedone.Theycaninitiateacircleofsupportforclientsand
victimstopreventfurthercrimes,therebybeparticipantsinnationbuilding

TheTHERAPEUTICCOMMUNITY(TC)isaselfhelpsociallearningtreatmentmodelusedinthe
rehabilitationofdrugoffendersandotherclientswithbehavioralproblems.TCadherestopreceptsofright
livingResponsibleLoveandConcernTruthandHonestytheHereandNowPersonalResponsibility
forDestinySocialResponsibility(brotherskeeper)MoralCodeWorkEthicsandPrideinQuality.
TheTherapeuticCommunity(TC)isanenvironmentthathelpspeoplegethelpwhilehelpingthemselves.It
operatesinasimilarfashiontoafunctionalfamilywithahierarchicalstructureofolderandyounger
members.Eachmemberhasadefinedroleandresponsibilitiesforsustainingtheproperfunctioningofthe
TC.Therearesetsofrulesandcommunitynormsthatmemberscommittolivebyandupholduponentry.
Theprimarytherapistandteacheristhecommunityitself,consistingofpeers,staff/probationandparole
officersandevenVolunteerProbationAides(VPA),who,asrolemodelsofsuccessfulpersonalchange,
serveasguidesintherecoveryprocess.
