COUNTER-AFFIDAVIT

I, Alvin Saludez y Valdez, of legal age, a resident of Brgy. Camangaan,

Moncada, Tarlac, after being duly sworn in accordance with law, hereby
depose and state that:
1. On December 5, 2013, around 12:05 in the morning, _____________;

3. I was taken aback by the presence of the police, but more than that, I was
overwhelmed by their accusation that I was at that moment selling drugs to
their alleged poseur buyer;
8. I deny that I had in my person any illegal drugs on December 5, 2013. I
also deny receiving money from anyone as consideration for the said drugs
on the same date.
9. The truth of the matter is that I was ____________, I never committed any
crime which could justify my arrest.

WHEREFORE, in view of the foregoing, I humbly pray that the criminal

charges against me be dismissed for being based on evidence gathered
through an illegal search and that I be released immediately, my arrest being
unlawful from the outset.
