S.1853-A/A.6256-A: Exempts agricultural employers

from paying for unemployment benefits for federally ineligible farm labor. This bill addresses a major
loophole in New Yorks labor law by exempting employers from paying unemployment insurance on H2A visa
temporary farm workers. A YES vote supports the
NFIB position. Passed the Senate, 3428; not voted
on in the Assembly.

S.2029/A.2990: Requires employers to make a conditional offer of employment before inquiring, written or
oral, about any criminal convictions of a prospective
employee. This is an unnecessary mandate, as any
applicant who would be disqualified from employment
due to criminal conviction post-offer would be disqualified pre-offer. A NO vote supports the NFIB
position. Not voted on in the Senate; passed the
Assembly, 9849.

S.2707-A/A.6937: Enacts the New York State fair pay act.


Current federal statute requires protections for employees doing work substantially equal in skill, effort,
responsibility, etc. This legislation would unnecessarily
open small business to frivolous lawsuits and would be
completely duplicative. A NO vote supports the
NFIB position. Not voted on in the Senate; passed the
Assembly, 9142.

S.3525-A/A.5062-A: Provides for the establishment


of the New York Health plan, a socialized healthcare
plan for every New York resident, funded by significant
assessments on both employers and upper-bracket
filers of personal income. This legislation contains no
cost-containment provisions and would dramatically
increase the cost of healthcare in New York, which
already assesses more than $5 billion in surcharges and
other taxes. A NO vote supports the NFIB position. Not voted on in the Senate; passed the Assembly,
8653.

S.5131/A.7808: Authorizes and directs the public service


commission to study the impact on consumers and

perform a cost benefit analysis of the Reforming the


Energy Vision (REV) initiative. A YES vote supports
the NFIB position. Passed in the Senate, 3328; not
voted on in the Assembly.

S.5597/No Same As: Eliminates the expiration and


makes permanent provisions of law establishing
the property tax cap. The property tax cap is the
most useful tool in addressing New Yorks exorbitant
property tax burden. It only makes sense to make
this mechanism permanent and not subject to future
legislative action. A YES vote supports the NFIB
position. Passed the Senate, 5012; not voted on in
the Assembly.

S.5661/A.4780: Requires regulations promulgated


for systematic and sustained efforts to find work for
unemployment benefits to include a claimants need to
provide childcare. The unemployment insurance reform
passed a few years ago has only begun to reign in the
high costs for employers and has brought solvency to
the fund itself. This bill would begin to undermine some
of these critical reforms. A NO vote supports the
NFIB position. Not voted on in the Senate; passed the
Assembly, 9644.

S.6406-C/A.9006-C: Enacts into law major components


of legislation necessary to implement the state education, labor, housing, and family assistance budget for
2016-17. Specific provisions of this legislation included
a dramatic increase in the minimum wage and the
most expansive paid leave mandate in the nation. A
NO vote supports the NFIB position. Passed the
Senate, 611; passed the Assembly, 10439.

S.7336/A.9904: Establishes a prohibition on the imposition of any tax, fee, or local charge on carry-out
merchandise bags. Imposing this tax and/or fee on
plastic bags would impose additional costs on retailers,
grocery stores, restaurants, and other establishments.
A YES vote supports the NFIB position. Passed
Senate, 3524; not voted on in the Assembly.
