The Answer:
For much of our history, America was a
predominantly agrarian society. Lawmakers
therefore took into account that November was
perhaps the most convenient month for farmers
and rural workers to be able to travel to the polls.
The fall harvest was over, (remember that Spring
was planting time and summer was taken up with
working the fields and tending the crops) but in the
majority of the nation the weather was still mild
enough to permit travel over unimproved roads.

[CIVICS, continued from page 2]

Nonpartisan Elections
In a nonpartisan race, candidates do not identify
themselves with a party label, such as Democratic, Republican, Independent, and so on. Nonpartisan candidate elections are held in conjunction
with the primary election. All voters regardless of
party affiliation may participate in the nonpartisan candidate elections.
In a nonpartisan race when there are three or
more candidates and no one receives over 50%
of the vote, the two candidates receiving the most
votes will advance to the General Election for a
runoff in November.

Why Tuesday? Since most residents of rural America had to travel a significant distance to the county seat
in order to vote, Monday was not considered reasonable since many people would need to begin travel on
Sunday. This would, of course, have conflicted with
Church services and Sunday worship.
Why the first Tuesday after the first Monday? Lawmakers wanted to prevent election day
from falling on the first of November for two reasons. First, November 1st is All Saints Day, a Holy
Day of Obligation for Roman Catholics. Second,
most merchants were in the habit of doing their
books from the preceding month on the 1st. Apparently, Congress was worried that the economic
success or failure of the previous month might prove

Examples of nonpartisan elections include:

General Elections
General elections are held the first Tuesday after
the first Monday in November, in even numbered
years. This is primarily the election for national,
state and county offices.

Why Vote By Mail

In 2012,on the eve of the election, a pollster was confident that the Democratic candidate would win. But
on the morning of election day, the pollster said the
Democrat would certainly lose.
On election day morning, there was a terrific rainstorm. The pollster knew that Democrats would stay
home not wanting to put themselves in danger of
having an accident in the storm, getting soaked waiting to vote, worrying about the inconvenience.
It is a general belief that Republicans always vote.
There are more Democrats than Republicans, but Democrats only win when they
are strongly motivated to come to the polls.
If Democrats vote by mail, they are not inconvenienced
by rain, snow, sleet, or long lines. [And if you die after
Go to Contents
you mail your ballot, it still counts.]

Amendments to the Florida Constitution and

local referenda may also appear on the General
Election ballot. In November 2016, there are multiple amendments to vote on.
In a General election, all registered voters may
vote for any candidate or question on the ballot
regardless of party affiliation.

What It Means To Be A Democrat

Vote by Mail Facts

Democrats come from all areas of the country, all

backgrounds, and all walks of life, but we share
beliefs and values that help shape a strong state
and nation.
Democrats believe in:
1. Equal opportunity for all.
2. Rewarding honest, hard work with a living
wage and a fair tax system.

political slogan.
4. Quality free, public education that gives
all children an opportunity to reach their
potential.
5. Freedom from government interference in
our private lives.
6. Fairness and equality for all Americans,
regardless of race, gender, religion, sexual
orientation, or sexual identity.
7. Security in our homes, safety in our
streets, and a strong national defense.
8. Strengthening our economy in ways that
benefit everyone, not just the wealthiest
among us.
9. Supporting government programs that
help societys most vulnerable.
10. Separation of Church and State which
protects both church and state.
11. Protecting our environment.
12. A voting system that is fair for every
American and ensures that every vote
counts.
13. A government that is respected at home
and abroad.
14. A strong United States - morally,
economically, and militarily.
Democrats believe in government that works!

aggressive temptation to extract illicit gain through
concealment and collusion, do us all a favor and

First Realize that you can create a Relationship
of Trust by

by Maureen F. Glasheen Esq.

Formal or
Informal

This talk from 2009 presented in 6 parts in the

next 6 issues of The Enlightened Voter eloquently
describes what are the Six Rules of Relationships of
Trust and how many of our legislators and business
critters should go to jail for breaking those rules! [ed.]

agreement, intentionally or unintentionally.

When you sign a revocable living trust you are
creating a formal written Relationship of Trust.

Part 2 of 6

And when you ask your brother to find a good car

for you for not more than $20,000, then you are
really asking him to be your gut. You have asked
him, in effect, to:

Timeless The Six Rules are timeless because

the human need for Relationships of Trust in all
sorts of matters is timeless. A similar scenario is
happening today. One Army reservist says to his
brother or best friend, Hey Buddy would you keep
an eye out for my family and my business affairs
while Im in Afghanistan? Sure, no problem.

1.
2.
3.

If he accepts, then you two have informally created

what the law recognizes as a Relationship of
Trust or agency relationship
without the need for
special words, a writing or
compensation! Ditto on
running for office.

On the other hand, if the Kings brother (referred

to on page 3 of The Enlightened Voter, May 2016
issue) is named Prince John, the King has a big
problem.
The Poster Child for the Faithless Fiduciary
Prince John is the epitome of disloyalty
motivated by greed for money and power. He is
the poster child for the faithless fiduciary and the
self-serving public servant.

Second understand that the label you put on

it is not important to the court. The court will
not allow you to label a Relationship of Trust as
an Arms Length Relationship in order to avoid
your obligations. It looks at the elements (1, 2, 3
above) of the relationship to determine whether
the relationship is an Arms-Length relationship
or an Agency/Relationship of Trust. If it finds that
it is a Relationship of Trust all of the Six Rules
apply, whether you intended it or not, whether
you understood it or not.

Expectations The Six Rules of the

Relationships of Trust articulate the core of all of
our expectations of every person we place into a
position of power or influence over us.
We Need a Relationship of Trust How can
we protect ourselves from all these Prince Johns?
We protect ourselves by becoming mindful when
we are creating a Relationship of Trust and
becoming more discerning about the persons in
whom we repose trust. We must carefully assess
the attitude/values of your prospective employee,
agent, trustee or public officer. Do they have an
appreciation for goodness? Or do they mock the
idea of acting for the benefit of another?

Third Ask yourself the same question the

court asks, What kind of relationship do we have
here? Nothing is more dangerous than to assume
you are in a Relationship of Trust when the other
person does not. How many times have you
referred to someone as my broker without a clue
as to whether they were knowingly committed to
acting in your best interest?

Step Aside? When another asks you to serve

as public officer, trustee, agent or employee, ask
yourself, What is the state of my mind? Resolve
to, with constant mindfulness, accomplish others

Or was their careless use of

language designed to create the
appearance of rapport in order to

to use your lack of expertise
and desire for protection to take
advantage of you?
Finally, protect yourself by knowing the Rules.

Practical Test What is the

practical everyday person test?
Does this person have my best
interest at heart?
Do not assume that he does just
because you need to believe that
he does.
This, by the way, is pretty good advice for your
teenage daughters and granddaughters when it
comes to friends and, especially, boyfriends.

Look for the 6 rules starting in our

August issue of The Enlightened Voter.

Fourth Ascertain whether they understand

the significance of their own words. Are they
intending to create a real Relationship of Trust in
which you will have a legal right to expect their
undivided loyalty and they have a legal duty to
act in good faith, solely in your best interest?

Dear Mitch McConnell:

Article II, Section 2 of the Constitution
by Elizabeth Warren, Reader Supported News

Do Nothing! Only a few hours after Justice Antonin Scalia suddenly died, Republican Senate Majority Leader Mitch McConnell declared that the vacancy on the Supreme Court shouldnt be filled until
the next President is sworn in next January.
Senator McConnell said the American people should have a voice in the selection of the next Supreme
Court justice. Hes right and, in fact, they did when President Barack Obama won the 2012 election
by five million votes.
Theres No Except Article II, Section 2 of the Constitution says the President of the United
States nominates justices to the Supreme Court, with the advice and consent of the Senate. I can't find
a clause that says "...except when there's a year left in the term of a Democratic President.
Arrogant and Irresponsible President Obama is still the President of the United States. If some
Senators dont like the person that President Obama nominates, they can make their case to the American people and vote no. But it would be arrogant and irresponsible for Senate Republicans to preemptively paralyze the nomination process laid out by our Constitution before President Obama even
announces a nominee simply because they dont like the guy who was elected to do the nominating.
Empty Talk Senate Republicans took an oath just like Senate
Democrats did. Abandoning
the duties they swore to uphold
would threaten both the Constitution and our democracy itself.
It would also prove that all the
Republican talk about loving the
Constitution is just that empty
talk.

anywhere you want? Well it's all made possible by
socialism.

[Continued from page 7, WAYS 1-15]

2. Highways/Roads
Those roads and highways you drive on every single day are completely taxpayer funded. Your tax
dollars are used to maintain, expand, and preserve our highways and roads for every one's use.
President Eisenhower was inspired by Germany's
autobahn and implemented the idea right here in
America. That's right, a Republican president created our taxpayer funded, national highway system. This was a different time, before the Republican party came down with a vicious case of rabies
that never went away.

7. Student Loans and Grants

Did you go to college? If you did, your family might not have been rich enough to pay your
way through. So you got your education anyway
through student loans and grants from the federal government at taxpayer expense. Of course you
have to pay back the loans, but if not the government, do you know anyone else who was going to
lend you tens of thousands of dollars? Probably
not. So the taxpayers lent you the money and you
paid it back with slight interest. The government
grants you accepted were gifts from the taxpayer
and the federal government that you did not have
to pay back. Socialism got you through school.

3. Public Libraries
Yes. That place where you go to check out books
from conservative authors telling you how horrible socialism is is in fact socialism. Libraries are
taxpayer funded. You pay a few bucks to get a library card and you can read books for free for the
rest of your life.

8. Bridges
Along with our highways, our government uses
your taxpayer dollars to build bridges. This allows
the public to travel across rivers without having to
sail or swim.

4. Police
Ever had a situation where you had to call the police? Then you have used a taxpayer funded socialist program. Anyone can call the police whether
they pay taxes or not. They are there to protect and
serve the community, not individuals. This is complete socialism on a state level, but still socialism
all the same. Would you rather have to swipe your
credit card before the police will help you?

9. Garbage Collection
Do you like having your garbage collected once a
week instead of having to drive it to the landfill
yourself? Thank socialism.

79% Of Americans Want To Overturn That

Decision. On the one-year anniversary of the
landmark decision, a survey conducted by Hart
Research found that only 22 percent of American
voters were even familiar with the Citizens United case. However, the same study showed that 79
percent of Americans were in favor of passing an
amendment to overturn the decision and clarify
that corporations should not have the same rights
as people.
Requirements For An Amendment. An amendment to the US Constitution requires a two-thirds supermajority in both the House and Senate and ratification by three-quarters of state Legislatures or to call
for a Convention of the US Legislature by two-thirds
of the state Legislatures, followed by ratification of the
amendment by three-quarters of the states. ###
