1. Whenever meeting with a Commissioner or a member of a Commissioners staff at the
request of the Commissioner or the Commissioners staff member, any Commission staff member has the right to have a staff member in their supervisory chain or a member of the Legal Division present at such meeting. 2. No matter may be brought before the Commission for a vote at its public meetings by a staff member or a Commissioner without that staff member or Commissioner providing at least 24 hours written notice to the Commission or the remaining Commissioners which advises that the matter in question will be brought before the body. The written notice provided shall, at a minimum, include a brief description of the matter that will be raised that is sufficient to allow the Commission and appropriate staff to prepare for any discussions that will relate to the matter in question. This 24-hour requirement may be waived if the waiver request is submitted to all three Commissioners and at least two of the three Commissioners consent to such waiver. 3. Absent a specific authorizing vote by the Commission, no Commissioner or staff member shall issue a written communication which interprets the policies or positions of the Commission regarding matters that have not been clearly addressed by the Commission through an order, rule, regulation or practice, without including a disclaimer that the positions or interpretations set forth in such written communication are those of the writer and do not reflect the official position of the Commission. This requirement also extends to oral communications which could bind the Commission and to press releases issued by Commissioners in their individual capacity.
